DECLARATION
of 26 May 2021
amending Decree No. 458 / 2009 Coll., fixing the daily rate for the costs of executing the house arrest penalty and using the electronic control system and the method of payment thereof, as amended by Decree No. 151 / 2016 Coll.
According to Article 152 (2) of Act No. 141 / 1961 Coll., on the Criminal Procedure, the Ministry of Justice provides for a judicial procedure (Criminal Code), as amended by Act No. 330 / 2011 Coll., Act No. 150 / 2016 Coll. and Act No. 220 / 2021 Coll.:
In Article 2 (2) of Decree No 458 / 2009 Coll., which sets out the daily rate for the costs associated with the execution of the house arrest penalty and the use of the electronic control system and the method of payment thereof, the first sentence is replaced by the following: "If the costs associated with the use of the electronic control system for the replacement of the custody system are not reimbursed, the court may, taking into account the length of the sentence imposed or the estimated duration of the use of the electronic control system, decide on the obligation of the sentenced to cover the costs associated with the execution of the house arrest or the use of the electronic control system after the execution of at least one month's domestic arrest penalty or after the use of the electronic control system."
Efficacy
This Decree shall take effect on 1 January 2022.
