implementing Act No. 143 / 1992 Coll., on the salary and remuneration of on-call duty in the budget and in certain other organisations and bodies
The Government of the Czech and Slovak Federal Republic orders pursuant to § 21 and § 23 (1) (a) to (e) and (g) and § 2 of Act No. 143 / 1992 Coll., on the salary and remuneration for on-call duty in budgetary and in certain other organisations and bodies (hereinafter referred to as "the Act"):
This Regulation
(a) it provides for the provision of salary to employees of the employer under the responsibility of the Federation;
(b) determine the arrangements for granting the salary in a currency other than the Czechoslovak currency;
(c) establish rank for customs officials;
(d) lay down special one-off cash requirements for members of the armed forces, security corps and services in service.
Classification
(1) The employer shall classify the staff member according to the work carried out primarily in the grade according to the catalogue of works and functions set out in Annex 1 (hereinafter referred to as "the catalogue").
(2) For works and functions in a catalogue not listed by the employer, the internal salary regulation sets out examples of works or, where appropriate, names of functions which he classifies in classes by comparing with examples of works in the catalogue.
(3) The employer shall place the lead employee in the grade corresponding to the work primarily performed, but at least in the grade in which the most demanding work of his subordinate staff is included.
(4) For inclusion in the grade, the catalogue sets out a qualification assumption for education.
(5) The employer may, by means of an internal salary regulation, determine the focus of education, the field of education and other qualification requirements, such as training courses.
(6) The employer may grant an exemption from the qualification requirement of education for:
(a) staff of security corps and services in service and for staff of special services in the armed forces and in the customs administration;
(b) an artist and an athlete who carries out an artistic or sporting activity in an employment or service relationship.
(7) The employer may include a staff member who does not meet one degree in the qualification requirement of education but who has, through professional experience, demonstrated the necessary exceptional expertise for the performance of his or her duties in the grade referred to in paragraph 1.
(8) Paragraphs 6 and 7 shall not apply where the performance of the work or function under a special provision requires a qualification presumption of education.
(9) Staff members who are a member of the armed forces shall be admitted to the lowest grade corresponding to the level of education achieved after being admitted to service until the date of provision or appointment.
Salary tariffs and scales
(1) For the determination of salary from the salary tariff (hereinafter referred to as the "fee fee"), the employer shall apply pay rates with grades or pay rates with spread; the scales of the rates are set out in Annex 2. The Government of the Czech and Slovak Federal Republics may, by way of derogation, fix the upper limit of the salary tariff for employees of the Federal Security Information Service, employees of the Protection and Rapid Service in the Federal Police Force and special services in the armed forces.
(2) In applying pay tariffs with grades, the staff member shall be entitled to a fare corresponding to the grade and grade according to the length of professional experience achieved, from the first day of the calendar month following the date on which he reached the required period of professional experience; if that date was due on the first day of the calendar month, the higher salary shall be due from that date.
(3) When applying salary tariffs with a spread, the staff member shall be entitled to a fare within the range of the relevant grade, granted according to the fulfilment of the qualification assumptions and requirements, the length of professional experience achieved and the results achieved.
(4) Staff members for whom a restriction on the exercise of another gainful activity is applied under a special law shall be increased by 25% of the upper limit of the margin of the relevant grade, set in accordance with paragraph 2 or 3; The increase shall be rounded to ten crowns upwards.
(5) Until the period of professional experience, staff members shall be counted as:
(a) employment in an employment relationship or in a similar employment relationship in the field corresponding to an agreed type of work or service relationship;
(b) the exercise of military basic (replacement) and other services and civil services, 1)
(c) maternity and other maternity leave, (2) a maximum of six years,
(d) assessed as a period of employment for pension purposes under the laws on judicial and extrajudicial rehabilitation.
(6) Other periods of employment or exercise may be counted against the period of professional experience according to the degree of use of theoretical knowledge and practical skills acquired in a relative or other field of activity for the work and function performed, but not more than two thirds.
(7) Closer conditions for the application of pay tariffs with grades or pay tariffs with spacing and for the calculation of professional experience are laid down by the employer in the internal salary regulation.
Management supplement
(1) According to the degree of management and the complexity of the management work, the employer's leading employee, who is the central administration and the head of which is not the minister, is responsible for the management charge which is:

(2) The employer's manager, other than those referred to in paragraph 1, is responsible for the management fee, according to the degree of management and the complexity of the management work.

(3) An employer's chief employee, the Office of the President of the Republic, the Office of the Federal Assembly, the Prosecutor General of the Czech and Slovak Federal Republic, the Federal Ministry of Defence, the Federal Ministry of Interior and the Customs Administration, with which a different basic organisational structure is applied, according to the degree of management and the complexity of the management work, is subject to a management fee according to Annex 3.
(4) The employer's chief employee, the Federal Security Information Service, is subject to the management fee provided for in Section 5 (1) of the Act. The employer shall determine more detailed conditions in the internal salary regulation.
Service surcharge
(1) Staff members who are a member of the customs administration shall have the status and shall be entitled to the value surcharge which:

(2) The rating fee is equal to the rank for which the staff member fulfils the qualification requirements of education and the total service of years. The provisions of the previous sentence shall not apply to cases of exceptional promotion.
(3) The conditions for determining the rank of customs officials are set out in Annex 4.
Special surcharge
(1) For the performance of work in a difficult and healthy work environment, chemical pollutants, dust (aerosols without toxic effects), vibrations, ionising radiation, electromagnetic radiation, infrared radiation (heat), lasers, for work in an infectious working environment at the risk of a professional disease, for direct contact with allergens, for chemical carcinogens and for increased air pressure, and for work in air-conditioned particularly difficult areas, a special surcharge of 1,50 Kccs up to 4 Kccs shall be provided for each hour of this work. The difficult and healthy harmful working environment is laid down in specific provisions.
(2) A special supplement of 20 Ccs to 40 Ccs for each hour of this work shall be provided for working in breathing insulating devices, asbestos suits, underwater and in the event of destruction, laboratory, delaboration and explosive test. When working under water with explosives, a special surcharge of 30 CZK to 60 CZK shall be provided for each hour of this work.
(3) For work at heights above 10 m high at unsecured workplaces (without scaffolding, without forklifts, etc.), a special surcharge of 5 CZK to 15 CZK for each hour of this work shall be provided.
(4) In the performance of services and activities in the protection of the interest of the State in which life or other serious risks may be at risk, as well as in the performance of specific tasks for the state's armed emergency or in exceptional measures outside the time of the state's armed emergency and activities with exceptional mental burden, staff shall be granted a special surcharge of 200 Kčs up to 1 200 Kcs per month, in the specialised departments of the Federal Ministry of Defence, the Federal Police College and the Police Council of 200 Kčs up to 1 500 Kcs per month and in the Federal Security Information Service of 200 Kčs up to 1 800 Kcs per month.
(5) Staff assigned as an executive flyer or on-board staff shall be provided with a special fee of 200 Ccs up to 1 200 Ccs per month. Special surcharge is increased
(a) under the responsibility of the Federal Ministry of Defence, meeting the requirements of combat use and flying of a specified number of hours by up to 600 CZK per month;
(b) in the case of air transport, between 0,06 and 0,70 CZK per kilometre flown;
(c) when providing emergency or emergency services by 200 Ccs per helicopter operating day.
(6) Staff assigned to the post with which the exercise of the paratroop activity is linked shall be granted a special surcharge of 200 Kčs to 500 Kčs per month. Special surcharge is increased
(a) for ground and air training of a paratrooper according to the risk level by up to 500 Ccs per month;
(b) for each parachute test jump of 150 Ccs up to 300 Ccs.
(7) The special allowance granted under the preceding paragraphs for regular work may be fixed by a monthly lump sum. In the event of a substantial change in working conditions, the employer is obliged to redetermine the lump sum.
(8) The closer conditions for determining the specific premium and its amount are laid down by the employer in the internal salary provision.
Personal surcharge
(1) Staff members may be granted a monthly personal allowance up to the amount of:
(a) 40% of the upper margin of the relevant grade; or
(b) 100% of the upper margin of the relevant grade, if applicable, for staff
1. classified in the 10th to 12th grade as an excellent expert; or
2. carrying out scientific activities; or
3. who is an extremely talented artist or high-level sportsman and performs artistic or sporting activities in a professional or service relationship; or
4. Federal Security Information Services, Special Security Information Services in the Armed Forces and Customs Administration, Protection and Rapid-Use Services in the Federal Police Force, or if there is a police officer or an occupational officer assigned to the performance of a managerial or professional function with another employer who is subject to Act No. 1 / 1992 Coll., on wages, remuneration for on-call and on average earnings.
(2) The conditions for granting a personal supplement may be negotiated in a collective agreement or laid down by the employer in the internal salary provision.
Remuneration
(1) Staff members may be remunerated
(a) for the successful achievement of exceptional or particularly important work tasks and for the quality of work achieved in the long term;
(b) for every five years of service in the armed forces, security corps and services in the service;
(c) to assess work benefits on the occasion of 50 years of age and on the first termination of employment after entitlement to an old-age or invalidity pension;
(d) for providing personal assistance in fire protection, natural events or other similar exceptional cases.
(2) The remuneration referred to in paragraph 1 (a) may be granted from the management fund.
(3) Closer conditions for the provision of remuneration may be negotiated in a collective agreement or laid down by the employer in an internal salary provision.
Salary abroad
(1) Staff members with a place of employment in accordance with a contract of employment abroad may be paid 64% of the salary in a currency other than Czechoslovak.
(2) The conversion of 64% of the salary of a staff member in a non-Czechoslovak currency shall be carried out for each Member State during the period concerned by the same conversion rate.
Special one-off cash requirements
(1) A single amount of 10 000 Kcs may be granted to a member of the armed forces, security corps and services in the service relationship who undertakes to perform the service in selected positions for at least six years after the establishment of the service; the range of functions shall be defined by the employer in the internal salary regulation.
(2) A member whose service has ended before the undertaking referred to in paragraph 1 has been fulfilled shall be obliged to pay back a proportion of the amount provided if his service has ended
(a) release at its own request,
(b) release from service, except as a result of organisational changes or health reasons;
(c) loss of rank.
(3) An officer in the armed forces's service may, in exceptional, particularly justified cases, provide one-off, non-refundable monetary assistance at his request.
Common, transitional and final provisions
(1) A staff member shall be entitled to a flat-rate salary from the date on which he was assigned to the relevant grade and, in the case of a staff member in service, from the date on which he took up his duties.
(2) The management fee, the value premium and the special monthly amount shall be payable to the staff member from the first day of the calendar month following the date on which the conditions for entitlement to it have been fulfilled; if that date was the first day of the calendar month, it shall be due from that date.
The salary under the law and this Regulation shall be paid for the first time in May 1992.

4.1. Preparation of supporting documents for administrative procedures, consisting in particular of checking the elements in terms of substance and legal and, where appropriate, preparing a proposal to supplement the specified elements.
4.2. Determination of administrative fees and simple benefits.
4.3. Handling of correspondence according to instructions and general procedures.
4.4. Implementation of administrative acts relating to the preparation and conduct of judicial proceedings, consisting in particular of the summons of participants to the hearing, the drawing up of decisions and the administrative handling of the postponement agenda according to the instructions.
4.5. Implementation of the acts of an official reporter within the meaning of criminal law or the law on the prosecution, the provision of file services at the prosecution, including the processing of anonyms, the control of complexity and content in terms of specified formalities, the conduct of surveillance files.
4.6. The management of the Administration of the Head of Organisation and Deputy Head of the Central Authority.
4.7. Securing the running of libraries, ordering, receiving, sorting books and printing materials, their layout, evaluation and decommissioning.

5. PAYMENT CLASS
Function: Expert Officer
Qualification assumption: full secondary education
Examples of works:
5.1. Preparation of documents for administrative decisions, calculation of administrative fees and levies.
5.2. Measurement of individual doses in questionable cases.
5.3 Monitoring of tasks arising from generally binding legislation, government and representative bodies' resolutions and their delegation to executive agencies.
5.4. Compilation of statistical material for analysis and analysis.
5.5. Organising the proceedings of the Registry, recording of the court proceedings, the submission and oral statements of the parties, requests for exemption from judicial fees and the provision of a representative, marking the enforcement clause on copies of the decision, establishing and maintaining registers of courts and prosecutors.
5.6. Processing of records of the management bodies' meetings and monitoring of their performance, as well as other secretarial work for the head of the central authority.
6. PAYMENT CLASS
Function: Senior Official
Qualification assumption: full secondary education
Examples of works:
6.1. Separate processing of administrative acts with a defined sub-scope in a comprehensive field of expertise.
6.2. Professional processing of documents for administrative decisions issued in the first and second stages of administrative proceedings.
6.3. Implementation of tax controls according to the framework guidelines, ensuring all the tasks necessary for the enforcement of decisions.
6.4. Enforcement and enforcement of criminal penalties.
