Resolution of the Government of the Czech Republic on the adoption of crisis measures

ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 30 April 2020
on the adoption of crisis measures
Following the Government Resolution 194 of 12 March 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency in accordance with Article 5 and Article 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on emergency management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the crisis situation, the adoption of emergency measures, by virtue of Article 6 (1) (b) of the Crisis Act.
Government with effect from 11 May 2020 at 00am
I. prohibits
1. the personal presence of pupils and students in primary, secondary and higher vocational education in schools and educational establishments under Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended, and in the events organised by these schools; the prohibition of a personal presence under this point does not apply to a personal presence
(a) pupils holding a final examination or applying for a senior examination, pupils in the conservatory and students in the senior year in higher vocational schools, in particular for the purpose of preparing and participating in the final examination, the final examination or discharge, the attendance of which is not compulsory for those pupils and students and those pupils or students must be groups of up to 15 pupils;
(b) pupils in the ninth grade of primary school in order to prepare for the admission to secondary school, the attendance of which is not compulsory for those pupils and those pupils must be groups of up to 15 pupils;
(c) education in schools established in diagnostic institutes, children's homes with school and educational institutions and in diagnostic classes according to Act No. 109 / 2002 Coll., on the performance of constitutional education or protective education in educational establishments and on preventive educational care in educational establishments and amending other laws, as amended;
(d) education in schools at health institutions;
2. the personal presence of children, pupils and students and other participants in pet education at school institutions for interest education and at competitions and shows organised for children, pupils and students of schools and educational establishments under Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended; the prohibition shall not apply to leisure centres subject to the condition that no more than 15 participants in the group are present;
II. Saves that
1. the personal presence of students in university studies under Act No. 111 / 1998 Coll., on higher education institutions and amending and supplementing other laws (the Act on higher education), as amended, was only allowed under the conditions of the presence of up to 15 students in the group; This restriction does not concern clinical and practical teaching and practice,
2. the personal presence of pupils at primary artistic education in primary art school and language education in a language school with the right of state language examination under Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (the Education Act), as amended, and during the events organised by those schools, was only allowed under the conditions of the presence of a maximum of 15 pupils in the group,
3. the personal presence of persons on education in one-year foreign language courses with daily teaching in the institutions included in the list of educational institutions providing one-year foreign language courses with daily teaching according to Act No. 117 / 1995 Coll., on State Social Support, as amended, was only allowed subject to the condition of the presence of a maximum of 15 persons in the group;
III. Orders that
1. a child, a pupil, a student, a participant and a person referred to in point I or II, or his legal representative and a legal representative of a child at a nursery school, has provided a written declaration of the absence of symptoms of a viral infectious disease (e.g. fever, cough, shortness of breath, sudden loss of taste and smell, etc.) prior to their first entry into school, school establishment or educational institution; This does not apply to children and pupils of schools in a medical institution,
2. the child, pupil, student, participant or person referred to in point I. or II has been personally present at a school, school establishment or educational institution only if it is without acute health problems consistent with a viral infection.
IV. Repeals the Government Resolution of 23 April 2020 No 455, issued under No. 197 / 2020 Coll.
