DECLARATION
of 14 August 2007
implementing certain provisions of the Education Act for schools and school establishments established by the Ministry of Defence
According to Section 172 (5) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (Education Act), as amended by Act No. 342 / 2006 Coll., hereinafter referred to as "the Act":
Annual report
(K § 11 of the Act)
(1) The Annual Activity Report of the School contains:
(a) basic details of the school, which are the name, seat, characteristics of the school, management data, remote access address, organisational structure of the school;
(b) the characteristics of the school year, the performance of the school's main tasks;
(c) an overview of the fields of education taught by the school and included in the school register;
(d) school staff and data on continuing training of teaching staff;
(e) the details of the admission procedure, which are the number of applicants applied for, the number of applicants who came to the admission procedure, the number of received, the number of received, the level of received candidates, all indicators also broken down by sex,
(f) data on the number of pupils and students;
(g) data on the training process, which are results and measures in the field of methodological work;
(h) data on the results of the education of pupils and students, including the results of senior examinations and discharge;
(i) activity and presentation of the school in public, including foreign events;
(j) data on prevention of social adverse events;
(k) data on school involvement in lifelong learning,
(l) data on school involvement in development and international programmes;
(m) details of the results of the inspection activity;
(n) information on the status and modernisation of the training base;
(o) basic data on school management.
(2) The Annual Activity Report of the School is prepared by the School for the period preceding the school year by 15 October and submitted by 31 October to the Ministry of Defence. The school director shall publish the annual report at the school and in a way that allows remote access.
Education of gifted pupils and students
(K § 19 of the Act)
(1) The School creates conditions for the development of the talent of pupils and students, in particular by organising the object Olympics, professional competitions and interest and industrial activities.
(2) The school director may, in the organisational rules of the school, lay down the obligations of teaching staff to choose the gifted pupils according to their knowledge, competences and skills and may lay down specific conditions for the selection and study of the gifted candidates.
Individual training plan
(K § 19 of the Act)
(1) The school director may, at the request of a pupil or student, at the request of a minor student, at the request of his legal representative, lay down an individual training plan for the pupil or student after assessing his knowledge, abilities and skills.
(2) The individual training plan contains:
(a) educational objectives;
(b) methods and methods of education;
(c) training conditions (timetable and material-technical security);
(d) the allocation of teaching staff for consultation;
(e) the methods and time limits for verifying the knowledge, competence and skills acquired.
(3) The school director shall inform the student or student and the legal representative of the minor. The individual training plan, signed by the school director, pupil or student and the legal representative of a minor student, becomes part of the student's personal documentation.
Number of pupils and students
(Paragraph 23 (3) of the Law)
(1) The lowest number of pupils in a full school is 45. The lowest number of students in the upper vocational school with full years is 15.
(2) The lowest possible number of pupils in the classroom in each year of secondary school is 15. The highest possible number of pupils in the classroom in each year of secondary school is 30, unless otherwise specified. Taking into account the pedagogical, hygienic and spatial conditions, the school director may, where justified, determine a higher number of pupils in the classroom, in particular when transferring pupils from another secondary school, changing the field of study and repeating the year; However, the number of pupils in the class shall not exceed 33.
(3) Study groups shall be set up in the various years of the higher vocational school. The lowest number of students in the study group is 5 and the highest 15 students.
Classes and study groups divided and joined
(Paragraph 26 (4) of the Law)
(1) The school director may, in accordance with school education programmes, divide classes into groups. The number of groups and the number of pupils in the group shall be determined according to the conditions of the school and the nature of the subject of instruction and in accordance with the requirements for safety and health of pupils, for spatial and material security and for the effectiveness of education.
(2) If the number of pupils under 15 falls, the school director will cancel the class at the end of the school year and the pupils will be transferred to other classes of the same class and expertise if they have more than one class. If there are no other classes, the class remains with fewer pupils.
(3) If the number of students in the study group falls below 5, the school director will cancel the study group at the end of the school year and the students will be transferred to other study groups of the same year and expertise if they have more study groups. If there are no other study groups, the study group remains with fewer students.
(4) Study groups may be divided into sub-groups in accordance with an accredited training programme.
(5) The teaching of foreign languages shall always take place in groups formed for the relevant foreign language. The highest number of pupils or students in the group is 15.

(Paragraph 29 (3) of the Act)
(1) All accidents involving pupils and students in the activities referred to in Paragraph 29 (2) of the Act (hereinafter referred to as "the accident ') shall be recorded in the accident book no later than 24 hours after the school or educational establishment has become aware of the accident.
(2) The book of accidents is held together for pupils and students. It shall state:
(a) the serial number of the accident;
(b) the name and, where appropriate, the name, surname and date of birth of the injured party;
(c) the date and time of the occurrence of the accident;
(d) the place where the accident occurred;
(e) the number of hours of training immediately before the accident occurs;
(f) the total number of persons injured;
(g) the type of injury and the injured part of the body,
(h) the source of the injury;
(i) causes of injury;
(j) the names and surnames of the witnesses;
(k) the name and, where appropriate, the name, surname and working title of the person who recorded the data.
(3) Personal data which are part of the accident record may be processed only for the purpose of recording accidents or, where appropriate, as a basis for drawing up an accident record.
Injury record
(Paragraph 29 (3) of the Act)
(1) A record of an accident shall be drawn up by the school or school establishment whenever:
(a) an accident resulting in the absence of a pupil or student at a school reaching at least two consecutive teaching days;
(b) an accident which has not resulted in the absence of a pupil or a student at school, but is likely to be compensated for by a student or a student for the pain and discomfort caused by the accident; or
(c) a fatal accident which, for the purposes of this decree, means health damage which has caused death following an accident or the consequences of which a pupil or student has died within one year of the occurrence of the accident at the latest.
(2) At the request of a legal representative of a minor student, an adult pupil, a student or a Ministry of Defence, the school shall immediately record an accident which is not referred to in paragraph 1.
(3) An accident record shall be drawn up on a form the model of which is set out in the Annex hereto.
(4) An accident record shall be drawn up without delay, no later than 5 working days after the date of the accident. An accident record for the previous calendar month shall be sent no later than the fifth day of the following month; in the case of a fatal accident, no later than 5 working days after the date of its detection.
(5) One copy of the accident record shall be transmitted by the school to the adult pupil or student, in the case of a minor pupil to his legal representative.
(6) The record of the accident referred to in paragraph 1 shall be sent:
(a) the Ministry of Defence,
(b) health insurance undertakings;
(c) in the event of a severe and fatal injury to the Military Police.
(7) The school or school establishment updates the accident record without undue delay
(a) where compensation has been granted for pain or compensation for the inconvenience of social application caused by the accident; or
(b) in the case of a fatal accident, where the death occurred after an accident alert has been made.
Injury report
(Paragraph 29 (3) of the Act)
(1) He shall inform the school or school establishment of the accident of a minor without undue delay of his legal representative.
(2) If they indicate that an offence has been committed in connection with the accident, the school or school establishment shall report to the Military Police without undue delay.
(3) The school or school establishment shall, without undue delay, report to the Ministry of Defence on an accident resulting in the absence of a pupil or student in a school or a school establishment affecting at least two consecutive teaching days and a fatal accident.
School holidays
(Paragraph 24 (5) of the Law)
(1) The period of school holidays consists of autumn holidays, Christmas holidays, midterm holidays, spring break, Easter holidays and main holidays.
(2) Autumn holidays last 2 days and are added to the public holiday on October 28; their beginning is the same as the beginning of the autumn holidays established by the Ministry of Education, Youth and Sports.
(3) Christmas holidays last from 23 December to 2 January of the following calendar year inclusive. If December 23 is on Tuesday, the holidays begin before Monday. If January 3 falls on Friday, the holiday ends on Friday.
(4) Half-yearly leave lasts one day and falls for Friday from 29 January to 4 February.
(5) Spring break lasts one week. The dates are identical to the dates of spring break set by the Ministry of Education, Youth and Sports according to the school's headquarters.
(6) Easter holidays are for Friday preceding Easter Monday and Tuesday following Easter Monday.
(7) The main holidays last from the end of the second half of the school course until the start of the first half of the new school year, the dates set out in Section 21.
Education measures
(Paragraph 31 (1) of the Law)
(1) The school or school establishment director may, on his or her own decision or at the initiative of another legal or natural person, give the pupil or student a commendation or other award for exceptional manifestations of humanity, civil or school initiative, a deserving or brave act or for long-term successful work.
(2) A class teacher may, on his or her own decision or at the initiative of other teachers and school staff, award praise or other award to a pupil or student for a significant speech of school initiative or long-term successful work.
(3) In the event of a breach of the obligations laid down in the school rules, the student or student may be ordered, depending on the seriousness of the infringement, except for suspension from the school with a probationary period of up to one year and exclusion from the school also:
(a) a class teacher warning,
(b) the reprimand of the class teacher; or
(c) the reprimand of the school director.
(4) In the event of a breach of the obligations laid down in the internal rules, a pupil or a student may be ordered, in addition to conditional exclusion from a school establishment, for a trial period of up to one year and exclusion from a school establishment, also:
(a) a warning to the principal of the school establishment;
(b) the reprimand of the principal of the school establishment.
(5) Rules on the granting and imposition of educational measures are part of the school or internal rules.
(6) The class teacher, school director or school establishment director shall immediately notify the award or imposition of educational measures to the pupil or student, in the case of a minor pupil, to his legal representative.
(7) The award or imposition of educational measures shall be recorded in the documentation of the school or school establishment.
Theoretical teaching
(K § 71 of the Act)
(1) The principal of the school shall determine in the daily form of education the beginning and end of theoretical teaching by starting generally at 8: 00, not earlier than 7: 00, and ending generally at no later than 20: 00. The maximum number of compulsory classes in one day with lunch break is eight hours, exceptionally nine hours, without lunch break is seven hours.
(2) A break of between 15 and 20 minutes is normally allocated after the second teaching hour. A 10-minute break is usually included among the other lessons. The length of the lunch break is at least 30 minutes.
Practical teaching
Contract on the content, scope and conditions of practical teaching
(K § 71 and 103 of the Act)
The contract on the content, scope and conditions of practical teaching shall include:
(a) the type of activities to be carried out by pupils in practical training;
(b) place of practical training;
(c) the timetable for practical teaching, its duration and the date of commencement;
(d) the number of pupils participating in practical training;
(e) the provision of technical aids used in practical teaching and the way in which pupils are transported to the place of practical teaching;
(f) how pupils are remunerated for productive work;
(g) measures to ensure safety and health, including protective measures to be taken, in particular with regard to personal protective equipment and responsible staff or the way in which they are determined;
(h) other data on which both parties agree.
Training
(K § 71 of the Act)
(1) Professional training consists in the acquisition of basic skills, activities and habits under the Framework Training Programme. It shall be managed by a competent master, teacher or instructor.
(2) The morning lesson shall begin not earlier than 7 p.m. and the afternoon lesson shall end not later than 20 p.m.. In justified cases, the school director may determine the beginning of the morning teaching of second, third and fourth pupils from 6 p.m. and the end of the afternoon teaching of third and fourth pupils at 22 p.m. The weekly timetable for teaching pupils shall be adjusted so as to rest for at least 12 hours between the end of one day and the beginning of the following.
(3) Usually after the second hour of vocational training, a break of 15 to 20 minutes is included. If pupils are trained in the workplaces of military departments, the breaks are in agreement with the staff of the military unit. The duration of breaks shall not be counted against the duration of the teaching day.
Exercise
(K § 71 of the Act)
The exercise shall be carried out as part of the subjects or as a separate subject. In training, pupils verify and enhance theoretical knowledge, practice and acquire relevant skills.
Apprenticeship and vocational experience
(K § 71 of the Act)
(1) Apprenticeship and vocational experience are carried out to the extent provided for by the framework training programme in schools or at the workplaces of military departments and military facilities, and, where appropriate, at the workplaces of employers authorised to work in the field of education.
(2) Teaching and vocational experience in schools is taught by a teacher of practical teaching or a teacher of professional subjects. It may also be carried out at the workplaces of military services or military facilities for the management and supervision of persons designated by the head of the workplaces of military services or military facilities.
Education and accommodation facilities
(Paragraph 121 (1) of the Law)
(1) The school education and accommodation facilities provide pupils and students with accommodation and educational activities linked to the educational activity of the secondary school and higher vocational school.
(2) Teachers or students are listed in the school education and accommodation establishment by school year. Every platoon is run by a platoon leader who's a professional soldier. Platoons are merged into companies whose commander is an occupational soldier.
(3) Teachers and students are accommodated in rooms separately by gender and by school year.
(4) Pupils trained in the daily form of education are placed in a school education and accommodation establishment on the basis of an application submitted by a legal representative of a minor or an adult student. The application shall be submitted before the start of the first year of school, together with the submission of the registration form. The school director shall inform in writing the legal representative of a minor student or an adult pupil of the acceptance of the application and of the placement in the educational and accommodation establishment.
(5) Other pupils and students are placed in a school education and accommodation establishment on the basis of an application submitted by a legal representative of a minor, an adult or a student. The Director of the educational and accommodation establishment shall set a deadline for its submission and publish it in a manner that allows remote access.
(6) The placement of a pupil or student in a school education and accommodation facility shall be terminated if:
(a) the student or student has ceased to be a secondary school student or a university student;
(b) the pupil or student is allowed to discontinue the education;
(c) the pupil or student has been excluded from the educational and accommodation facilities (7).
Material security
(Paragraph 122 (5) of the Law)
(1) The physical security of pupils is governed by a separate legislation1).
(2) The material security of pupils and students who are professional soldiers and students who are civil servants (2) is governed by a separate legislation3).
(3) Students who are not professional soldiers or civil servants are granted accommodation and meals for remuneration.
Payment for school meals
(Paragraph 123 (5) of the Act)
Meals are provided to students who are not professional soldiers or civil servants at a price which represents the purchase price of raw materials for food preparation.
Payment for accommodation
(Paragraph 123 (5) of the Act)
(1) The level of remuneration for accommodation in the Ministry of Defence accommodation for students who are not professional soldiers or civil servants is determined by the Ministry of Defence, taking into account accommodation facilities and the level of services provided.
(2) The amount of the payment for accommodation in the accommodation is unchanged even if the student is not accommodated for all days in the calendar month. Where a student is accommodated only part of a calendar month due to the organisation of the school year in which he is a student, the amount of payment for accommodation shall be determined in proportion to the number of days during which he is staying. The bill of payment for accommodation will be made by the Ministry of Defence's accommodation facility by the end of each semester at the latest.
Conditions for recognition of prior education
(K § 71 and 103 of the Act)
(1) A condition for recognition of a comprehensive education is the successful completion of education in a secondary school, a higher vocational school or a university in the Czech Republic or abroad, supported by evidence or in another demonstrable way. Evidence of successful completion of education abroad must be provided with a notation clause or certificate of equivalence of the educational attainment (4).
(2) The recognition of part-time education is subject to the completion of certain years of another secondary school, higher vocational school or higher education in the Czech Republic or abroad, or other education, in particular in vocational courses or language school with the right of state language examination, evidenced by evidence or other demonstrable means.
(3) In recording the recognition of the education achieved on the certificates, the school shall enter the relevant section for the evaluation of the pupil the term "recognised 'with reference to the explanatory note on the back of the certificate. The compulsory documentation of the school shall be treated mutatis mutandis.
Organisation of secondary school education
(Paragraph 24 (5) of the Law)
(1) The school teaching period in the school year starts on 1 September and ends on 30 June of the following calendar year; they are divided into first semester and second semester.
(2) The first half-year shall begin on 1 September and end on 31 January of the following calendar year. The second half-year shall begin on 1 February and end on 30 June of the same calendar year.
(3) If the beginning of the first semester is Friday, the lesson begins on the following Monday. If the end of the second semester is Monday, the lesson ends on the previous Friday.
(4) Where, in accordance with the framework training programme of a given field of education, vocational training, vocational training or training takes place during the period of major holidays, the teaching shall end in the second half of the period before the date laid down in paragraphs 2 and 3; the teaching shall be reduced by the number of teaching days corresponding to the duration of vocational training, vocational training or sports.
