DECLARATION
of 31 January 2022
amending Decree No 267 / 2017 Coll., on localisation and identification of caller on call to emergency numbers, and Decree No 117 / 2007 Coll., on numbering plans of electronic communications networks and services, as amended
The Ministry of Industry and Trade, in cooperation with the Ministry of Interior, pursuant to Section 150 (3) of Act No. 127 / 2005 Coll., Act No. 468 / 2011 Coll. and Act No. 374 / 2021 Coll., as amended by Act No. 33 (9) on Electronic Communications, Act No. 247 / 2008 Coll., Act No. 110 / 2007 Coll., Act No. 127 / 2005 Coll., on Electronic Communications and Act No. 258 / 2014 Coll., as amended by Act No. 153 / 2010 Coll., Act No. 153 / 2011 Coll., Act No. 468 / 2011 Coll., Act No. 214 / 2013 Coll., Act No. 258 / 2014 Coll., and Act No. 374 / 2021 Coll.
Amendment of the localisation order and caller identification when calling 911 numbers
Decree No 267 / 2017 Coll., on localization and identification of caller on call to emergency numbers, is amended as follows:
1. In the title of the Order, the title of Section 2, Section 2 (2) and (4) and in Section 7 (2), the words "caller 'are replaced by the words" emergency communication participant'.
2. In Article 1 (b), the words "caller at the start of the call 'are replaced by the words" participant in emergency communication at the start of the call'.
3. in Article 1 (e), the words "emergency call number" are replaced by the words "emergency number" and the words "emergency call centre" are replaced by the words "emergency communication centre."
4. In Article 2 (1), the words "and surname 'are replaced by the words" surname'.
5. in Article 2 (3) (b), the words "from the register of territorial identification" shall be replaced by the words "from the basic register of territorial identification, addresses and real estate (" the register of territorial identification ")."
6. The heading of Section 3 reads:
"Transmission of data to a database manager."
7. The group title above § 4 reads:
"Transmission of data from the Emergency Communications Centre database."
8. Paragraph 4 (1) reads as follows:
"(1) An entrepreneur providing a publicly available electronic communications service enabling end-users to make calls via a public fixed communication network shall transmit to the emergency communication centre at each emergency communication by means of a system signal according to the network signalling plan of the public communications networks issued by the Czech Telecommunications Office pursuant to Section 62 of the Electronic Communications Act (hereinafter referred to as the" network signalling plan ") the telephone number from which the communication is made. '
9. In Paragraph 4 (2), the word "entity 'is replaced by the words" emergency communication centre' and the words "emergency communication number 'are replaced by the words" emergency communication'.
10. in Articles 5 (1) and 10 (2), the word "entity" is replaced by "emergency communication centre."
11. in Article 5 (2), the words "emergency calls" are replaced by the words "emergency communications" and the words "emergency calls" are replaced by the words "emergency calls";

Localization of the geographical location of the emergency communication participant in public mobile communications networks
(1) In the case of emergency communication via a call from a public mobile communications network, the operator providing a publicly available interpersonal communication service based on the numbers of the emergency communication centre shall transmit data determining:
(a) the area index;
(b) the geographical location of the emergency communication participant's base station in the WGS84 system; or
(c) the geographical location of the sector centre of gravity of the last known base station of the emergency communication participant in the WGS84 system.
(2) On request from the emergency communication centre, the operator providing the public mobile communication network in which the emergency communication network was established shall transmit the geographical location of the primary station of the emergency communication participant in the WGS84 system or the geographical indication of the identified sector of the base station in the WGS84 system, including the azimuth of antenna routing, by means of a data network. In order to identify an emergency communication participant, the emergency communication centre shall use the emergency communication participant's telephone number or mobile telecommunications identifier. ';
13. in Article 7 (1), "Article 6" is replaced by "Article 6 (1)."
14. in Paragraph 7 (2), the word "entity" is replaced by the words "emergency communication centre."
15. in Article 8, the word "subject" is replaced by "emergency communication centre."

Localization of the geographical location of a participant in emergency communication via the Internet
Where a public, fixed or public, mobile, emergency communication network via the Internet does not allow the localisation of the emergency communication participant pursuant to § 2 or 6, the emergency communication centre shall proceed in coordination with the relevant operator providing that network in order to transmit the existing necessary information for the localisation of the emergency communication participant. ';
17. in Paragraph 10 (1), the words "to the appropriate specialised workplace of the entity which is designed to receive an eCall call" shall be replaced by the words "to the most appropriate emergency communication centre intended to receive an eCall service" and the words "to ensure the connection of an eCall call centre to receive an eCall call."
18. In Article 10 (2), the word "entity 'is replaced by" emergency communication centre';
19. The heading of Section 11 reads:
"Call for emergency numbers without a SIM card."
20. In Article 11, the words "European single emergency number 112 'are replaced by the words" emergency numbers' and the words "subject 'are replaced by the words" emergency communication centre'.
21. In the Annex, at the end of the text in point 4, the words "allocated to the operator providing voice communication services in a fixed communications network 'are added.
Amendment of the Decree on numbering plans for electronic communications networks and services
Decree No. 117 / 2007 Coll., on numbering plans of electronic communications networks and services, as amended by Decree No. 231 / 2008 Coll., Decree No. 267 / 2009 Coll., Decree No. 53 / 2011 Coll. and Decree No. 124 / 2012 Coll., are amended as follows:
1. in Articles 1 (1), 3, 10 (1) and 13 (3), the words "public telephone networks" are replaced by the words "public communications networks."
2. In Article 4 (3), "public fixed telephone networks' is replaced by" public fixed communications networks' and "public mobile telephone networks' is replaced by" public mobile communications networks'.
3. In Section 5, the words "public telephone networks' are replaced by the words" public communications networks'.
4. In Article 5 (2), the words "public fixed telephone network 'are replaced by the words" public fixed communications network' and the words "public mobile telephone network 'are replaced by the words" public mobile communications network'.
5. in Sections 9, 25, 27a and Annex 1, "telephone" is replaced by "communication."
6. In Paragraph 10 (1), the words "public telephone networks' are replaced by" public communications networks', the words "public fixed telephone networks' are replaced by the words" public fixed communications networks' and the words "public mobile telephone networks' are replaced by the words" public mobile communications networks'.
7. In Article 10, the following paragraph 6 is added:
"(6) The single European emergency number 112 and the shortened telephone numbers with the code SAC = 15 shall not be allocated.";
8. In Section 26, the word "network 'is replaced by the word" networks' and the words "emergency numbers' are added at the end of the sentence.
9. In Annex 1, the words "publicly available telephone service 'are replaced by the words" voice communication service' and the words "publicly available telephone services' are replaced by the words" voice communication services'.
10. In Annex 1, point 4.1, the words "emergency number 'are replaced by the words" emergency number'.
11. In Annex 1, point 6, the row for access code 61 is replaced by rows 610 to 614 and 615 to 619:
"610 to 614 Public mobile communications network The provision of electronic communications services other than interpersonal communications services throughout the European Union (1). 615 to 619Reserve for a public mobile communications network '.

This decree shall take effect on the day of its publication.
