amending certain regulations of the Government in the field of agriculture in the context of an emergency epidemic in 2020
The Government mandates pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation on certain conditions for granting subsidies on the afforestation of agricultural land and on the establishment of crops of rapidly growing timber on agricultural land intended for energy use
In Article 16 of Decree-Law No 308 / 2004 Coll., laying down certain conditions for the granting of subsidies on afforestation of agricultural land and on the establishment of crops of fast growing timber on agricultural land intended for energy use, paragraphs 3 and 4 are added:
"(3) For 2020, the application for reimbursement referred to in Article 5 (8) may be submitted to the Fund by 15 June 2020.
(4) Where the application for a refund is received for 2020 after the period referred to in paragraph 3, Paragraph 5 (9) shall apply mutatis mutandis. ';
Transitional provision
Applications for 2020 initiated under Government Regulation 308 / 2004 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation 308 / 2004 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies for afforestation of agricultural land
In Government Regulation No. 239 / 2007 Coll., on the establishment of conditions for the granting of subsidies for afforestation of agricultural land, as amended by Government Regulation No. 148 / 2008 Coll., Government Regulation No. 83 / 2009 Coll., Government Regulation No. 480 / 2009 Coll., Government Regulation No. 369 / 2010 Coll., Government Regulation No. 448 / 2012 Coll., Government Regulation No. 298 / 2013 Coll., Government Regulation No. 400 / 2013 Coll., Government Regulation No. 29 / 2014 Coll., Government Regulation No. 308 / 2014 Coll., Government Regulation No. 113 / 2015 Coll., Government Regulation No. 61 / 2016 Coll., Government Regulation No. 49 / 2017 Coll. and Government Regulation No. 64 / 2020 Coll., Section 10, Section 10a, which includes the title:
Time limits for submission of applications for a refund for the cessation of agricultural production in 2020
(1) For 2020, the application for a refund for the cessation of agricultural production referred to in Article 4 (2) may be submitted to the Fund by 15 June 2020.
(2) Where, for 2020, an application for a refund for the cessation of agricultural production is received after the period referred to in paragraph 1, Paragraph 4 (3) shall apply mutatis mutandis. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No 239 / 2007 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No 239 / 2007 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on certain conditions for granting national additional payments to direct aid
In Government Decree No. 112 / 2008 Coll., establishing certain conditions for the granting of national additional payments to direct aid, as amended by Government Decree No. 480 / 2009 Coll., Government Decree No. 86 / 2010 Coll., Government Decree No. 87 / 2011 Coll., Government Decree No. 107 / 2012 Coll., Government Decree No. 332 / 2012 Coll., Government Decree No. 298 / 2013 Coll., Government Decree No. 29 / 2014 Coll., Government Decree No. 50 / 2015 Coll., Government Decree No. 185 / 2015 Coll., Government Decree No. 61 / 2012 Coll., and Government Decree No. 426 / 2017 Coll., a new Paragraph 12 of Paragraph 12a, including the title is inserted:
Deadline for payment in 2020
(1) For 2020, the application for payment referred to in Article 2 (2) may be submitted to the Fund by 15 June 2020.
(2) If the application for subsidy is received for 2020 after the deadline referred to in paragraph 1, Paragraph 12 (1) shall apply mutatis mutandis. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No 112 / 2008 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No 112 / 2008 Coll., as effective from the date of entry into force of this Regulation.

Application period for 2020
(1) For 2020, the application for grant referred to in Article 4 (1) may be submitted to the Fund by 15 June 2020.
(2) If, for 2020, a request for subsidy is received after the deadline referred to in paragraph 1, Paragraph 4 (2) shall apply mutatis mutandis.
(3) For 2020, the application for a change of classification under Paragraph 7a (9) may be submitted to the Fund by 15 June 2020. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No. 147 / 2008 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 147 / 2008 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies on forestry-environmental measures
In Government Regulation No. 53 / 2009 Coll., on the establishment of conditions for granting subsidies to forestry environmental measures, as amended by Government Regulation No. 83 / 2009 Coll., Government Regulation No. 480 / 2009 Coll., Government Regulation No. 369 / 2010 Coll., Government Regulation No. 108 / 2012 Coll., Government Regulation No. 448 / 2012 Coll., Government Regulation No. 75 / 2013 Coll., Government Regulation No. 400 / 2013 Coll., Government Regulation No. 29 / 2014 Coll., Government Regulation No. 308 / 2014 Coll., Government Regulation No. 113 / 2015 Coll., Government Regulation No. 29 / 2016 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 314 / 2017 Coll., and Government Regulation No. 64 / 2020 Coll., under § 11a you do not add new § 11b., which includes the title:

Amendment of the Government Regulation on certain conditions for granting direct payments to farmers and amending certain related government regulations
In Government Regulation No. 50 / 2015 Coll., on the establishment of certain conditions for the granting of direct payments to farmers and amending certain related government regulations, as amended by Government Regulation No. 113 / 2015, Government Regulation No. 185 / 2015 Coll., Government Regulation No. 61 / 2016 Coll., Government Regulation No. 236 / 2016 Coll., Government Regulation No. 423 / 2016 Coll., Government Regulation No. 48 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 427 / 2017 Coll., Government Regulation No. 43 / 2018 Coll., Government Regulation No. 293 / 2018 Coll. and Government Regulation No. 350 / 2019 Coll., a new Paragraph 34a, including the title, is inserted after Section 34:
Time limits for submission of applications for direct payments to farmers in 2020
(1) For 2020, the application for direct payment to farmers referred to in Article 2 (3) may be submitted to the Fund by 15 June 2020.
(2) If the application for subsidy is received for 2020 after the deadline referred to in paragraph 1, Paragraph 8 (4) shall apply mutatis mutandis. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No. 50 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 50 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting payments in Natura 2000 areas on agricultural land
In Government Decree No. 73 / 2015 Coll., on the conditions for granting payments in Natura 2000 areas on agricultural land, as amended by Government Decree No. 113 / 2015 Coll., Government Decree No. 64 / 2016 Coll., Government Decree No. 49 / 2017 Coll., Government Decree No. 43 / 2018 Coll. and Government Decree No. 64 / 2020 Coll., the following Section 12b is inserted after Section 12a, including the title:
Deadline for submission of payment applications for 2020
(1) For 2020, the application for payment referred to in Article 3 (3) may be submitted to the Fund by 15 June 2020.

Amendment of the Government Regulation on the conditions for granting subsidies on animal welfare measures
In Government Decree No. 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended by Government Decree No. 113 / 2015 Coll., Government Decree No. 62 / 2016 Coll., Government Decree No. 17 / 2017 Coll., Government Decree No. 49 / 2017 Coll., Government Decree No. 34 / 2018 Coll., Government Decree No. 58 / 2019 Coll. and Government Decree No. 332 / 2019 Coll., the following Section 20a is inserted after Section 20, including the title:
Deadline for submission of the application for subsidy for 2020
(1) For 2020, the application for the grant referred to in Article 5 (1) may be submitted to the Fund by 15 June 2020.

Time limits for submission of applications in 2020
(1) For 2020, the application for inclusion referred to in Article 3 (4) may be submitted to the Fund by 15 June 2020.
(2) For 2020, the application for a change of classification referred to in Article 6 (1) may be submitted to the Fund by 15 June 2020.
(3) For the year 2020, the application for an increase in the allocated area referred to in Article 7 (3) may be submitted to the Fund by 15 June 2020.
(4) For 2020, an application for a reduction of an area included in accordance with Article 8 (2) may be submitted to the Fund by 15 June 2020, unless an application for a reduction of an area included in accordance with Article 8 (2) (a) or (b) is concerned.
(5) For 2020, the application for the grant referred to in Article 9 (1) may be submitted to the Fund by 15 June 2020.
(6) If, for 2020, a request for subsidy is received after the deadline referred to in paragraph 5, Paragraph 9 (4) shall apply mutatis mutandis.
(7) For 2020, the application for a change of classification in relation to the grubbing-up referred to in Article 14 (1) (b) may be submitted to the Fund by 15 June 2020 at the latest.
Assessment of mandatory training in integrated production for 2020
If, in 2020 at the latest by 31 December 2020, the applicant undergoes the training provided by the Central Audit and Examination Institute for Agriculture, the condition set out in § 12 (5) (i) or § 13 (5) (i) is met.
Assessment of compliance with the livestock stocking density for 2020
In the case of an application for a grant for 2020, the non-compliance referred to in Article 17 leading to the procedure under Title Four shall not be considered as a non-compliance if the non-compliance occurs between 1 June and 15 June 2020. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No 75 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No 75 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for implementing organic farming measures
In Government Decree No. 76 / 2015 Coll., on the conditions for the implementation of organic farming measures, as amended by Government Decree No. 113 / 2015 Coll., Government Decree No. 64 / 2016 Coll., Government Decree No. 236 / 2016 Coll., Government Decree No. 18 / 2017 Coll., Government Decree No. 49 / 2017, Government Decree No. 43 / 2018 Coll., Government Decree No. 57 / 2019 Coll. and Government Decree No. 332 / 2019 Coll., Section 27a is amended as follows:
Time limits for submission of applications for 2020
(1) For the year 2020, the application for an increase in the allocated area referred to in Article 4 (3) may be submitted to the Fund by 15 June 2020.
(2) For the year 2020, the application for a reduction of the allocated area referred to in Article 5 (2) (b) may be submitted to the Fund by 15 June 2020.
(3) For 2020, the application for the grant referred to in Article 6 (1) may be submitted to the Fund by 15 June 2020.
(4) If, for 2020, a request for subsidy is received after the deadline referred to in paragraph 3, Paragraph 6 (5) shall apply mutatis mutandis.
Assessment of compliance with the livestock stocking density for 2020
In the case of an application for a subsidy for 2020, the non-compliance referred to in Article 11 (1) (e) resulting in a procedure under Part Three shall not be considered as a non-compliance if the non-compliance occurs between 1 June and 15 June 2020. ';
Transitional provision
Applications for 2020 initiated under Government Regulation No. 76 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 76 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies under the afforestation measures and amending certain related government regulations
In Government Regulation No. 185 / 2015 Coll., on the conditions for granting subsidies under the afforestation of agricultural land measures and amending certain related government regulations, as amended by Government Decree No. 61 / 2016 Coll., Government Decree No. 19 / 2017 Coll., Government Decree No. 49 / 2017 Coll., Government Decree No. 234 / 2019 Coll. and Government Decree No. 64 / 2020 Coll., the following Section 12a is inserted after Section 12, including the title:
Time limits for submission of an application for aid for setting up a forest or application for aid for forest management in 2020
(1) An applicant intending to submit an application for aid for the setting-up of forest land pursuant to Article 5 in 2020 shall deliver to the Fund the declaration referred to in Article 4 by 15 June 2020.
(2) For the year 2020, the application for a forest management subsidy pursuant to Article 6 (1) or for an application for an aid for the cessation of agricultural production pursuant to Article 6 (2) may be submitted to the Fund by 15 June 2020.
(3) Where, for 2020, an application for a forest management subsidy or an application for an end-of-agricultural production subsidy is received after the period referred to in paragraph 2, Paragraph 6 (3) shall apply mutatis mutandis. ';

Applications for 2020 initiated under Government Regulation No. 185 / 2015 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 185 / 2015 Coll., as effective from the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies under forestry, environmental and climate services and forest protection measures and amending certain related government regulations
In Government Regulation No. 29 / 2016 Coll., on the conditions for granting subsidies under forestry and climate services and forest protection measures and amending certain related government regulations, as amended by Government Regulation No. 36 / 2017 Coll., Government Regulation No. 49 / 2017 Coll., Government Regulation No. 314 / 2017 Coll. and Government Regulation No. 64 / 2020 Coll., the following Section 15a is inserted after Section 15, including the title:
Time limits for submission of applications in 2020
(1) For 2020, the application for inclusion referred to in Article 3 (3) may be submitted to the Fund by 15 June 2020.
(2) For 2020, the application for grant referred to in Article 7 (1) may be submitted to the Fund by 15 June 2020.
(3) If, for 2020, a request for subsidy is received after the deadline referred to in paragraph 2, Paragraph 7 (2) shall apply mutatis mutandis.

Amendment of the Government Regulation on the conditions for granting payments to mountain areas and other areas with natural or other specific constraints and amending the related Government Regulations
Government Regulation No. 43 / 2018 Coll., on the conditions for granting payments to mountain areas and other areas with natural or other special constraints and amending certain related government regulations, as amended by Government Regulation No. 197 / 2018 Coll. and Government Regulation No. 64 / 2020 Coll., is amended as follows:
1. In Paragraph 14a, the following paragraph 3 is added:
"(3) For applications submitted in 2020, when calculating the stocking density of the applicant livestock on each day of the control period from 1 June to 30 September in accordance with Article 6 (2) (b), the dates on which the stocking density of livestock is less than 0,3 livestock units shall not be assessed. ';
2. After Paragraph 14a, the following Section 14b is inserted:
Time limits for submission of payment applications for 2020
(1) For 2020, the application for payment referred to in Article 3 (3) may be submitted to the Fund by 15 June 2020.
(2) Where the application for payment is received for 2020 after the deadline referred to in paragraph 1, Article 4 (4) shall apply mutatis mutandis. ';

Applications for 2020 initiated under Government Regulation No. 43 / 2018 Coll., as effective before the date of entry into force of this Regulation, shall be completed under Government Regulation No. 43 / 2018 Coll., as effective from the date of entry into force of this Regulation.
