amending Government Regulation No 298 / 2022 Coll., on the determination of electricity and gas prices in an exceptional market situation and on the determination of the related maximum permissible extent of customer asset benefit, as amended

Government Decree No 298 / 2022 Coll., on the determination of electricity and gas prices in an exceptional market situation and on the determination of the related maximum permissible extent of customer assets, as amended by Government Decree No 343 / 2022 Coll., Government Decree No 442 / 2022 Coll., Government Decree No 28 / 2023 Coll. and Government Decree No 77 / 2023 Coll., are amended as follows:
1. In Paragraph 8a (1) (d), the words "depreciation and cost interest 'are replaced by the words" adjustments to operating values and cost interest and similar costs and reduced by adjustments to fixed assets and stocks'.
2. In Article 8a (5), the words "t month or period of several consecutive months in 2023, ref reference period," shall be deleted.
3. Paragraph 8a (7), including footnote 3, reads as follows:
"(7) Values of asset benefit ranges of the category A to E fixed in EUR shall be reduced by the amount of other aid to cover the costs of the purchase of electricity and gas provided by a large enterprise and by the amount of aid to cover the costs of heat provided by a large enterprise in the case of the purchase of heat at a point of more than 10 000 GJ per calendar year for the period from 1 February 2022 to the end of the period for which electricity or gas prices are fixed by this Regulation, pursuant to a directly applicable European Union3) or by a decision of the European Commission approving other aid measures pursuant to Article 107 (3) (b) of the Treaty on the Functioning of the European Union. The value of the assets benefits of categories B to E, determined by the relative value of the eligible costs, shall be reduced by the amount of other aid to cover the costs of purchasing electricity and gas provided to a large entrepreneur and by the amount of aid to cover the thermal energy costs of a large enterprise in the case of heat collection at a point of more than 10 000 GJ per calendar year for the period from 1 January 2023 to the end of the period for which electricity or gas prices are fixed by this Regulation, under the directly applicable European Union3) or by a decision of the European Commission approving other aid measures pursuant to Article 107 (3) (b) of the Treaty on the Functioning of the European Union. Support under the first and second sentences shall not be regarded as compensation for indirect costs provided under the law governing the terms of greenhouse gas emission allowance trading.
(3) For example, Commission Regulation (EU) No 651 / 2014 of 17 June 2014 declaring, in accordance with Articles 107 and 108 of the Treaty, certain categories of aid compatible with the internal market, as amended, Commission Regulation (EU) No 2022 / 2472 of 14 December 2022 of 14 December 2022 of the Commission Regulation (EU) No 107 / 2014 of the European Union on aid to undertakings active in the production, processing and marketing of fishery and aquaculture products, as amended, Commission Regulation (EU) No 1408 / 2013 of 18 December 2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union for de minimis aid, as amended, Commission Regulation (EU) No 1408 / 2013 of 18 December 2013 on the application of Articles 107 and 108 of the Treaty on the Functioning of the European Union.
4. In Article 8b, at the end of the text of paragraph 1, the words "the members of this grouping of persons who, during the period for which electricity or gas prices are fixed by this Regulation, have received an asset benefit by taking electricity or gas at a specified price 'shall be added.
5. In Paragraph 8d (8), the words "or after the deadline 'are deleted.
6. The following Section 8da is inserted after Section 8d, which includes the title:
Correction of data in the report on the assessment of the existence of excessive asset benefits
The large entrepreneur shall be entitled to correct the facts or data in the report on the assessment of the existence of over-asset benefits by the end of the second calendar month following the end of the calendar month in which he carries out the assessment at the latest. The rectification of facts or data shall be carried out by the submission of a new report on the assessment of the existence of excessive assets in accordance with Section 8d (7). '.
7. In Annex 1, Part C to E:

Efficacy
This Regulation shall take effect on 1 July 2023.
