DECLARATION
of 8 July 2022
on the protection of selected species of snails and apes in breeding
The Ministry of Agriculture provides, pursuant to Article 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 501 / 2020 Coll., ("the Act ') for the implementation of § 14c (4) of the Act:
GENERAL PROVISIONS
Subject matter
(1) This decree regulates the conditions for breeding selected species of shale and lidoops, requirements for construction, security, size and equipment of premises, housing conditions and requirements for aids, feeding and drinking of selected species of shale and lidoops referred to in § 14a (4) of the Act.
(2) This decree does not apply to:
(a) experimental animals kept by the keeper of the experimental animals, supplied by the supplier of the experimental animals or used by the user of the experimental animals;
(b) animals treated by a veterinarian and placed at the same time in an establishment intended to be treated by a veterinarian;
(c) animals kept for the purpose of carrying out dressage in accordance with the legislation governing animal husband1),
(d) an islet (Lynx lynx), a wolf (Canis lupus) or a brown bear (Ursus arctos) in respect of handicapped animals kept in accordance with the legislation governing the protection of handicapped animals during breeding (2).
Definition of terms
(1) For the purposes of this decree:
(a) the breeding area of the area in which the selected species are kept by sash or lidoopi;
(b) an internal breeding area designed for the breeding of selected species by clams or lidoops situated within the building; in particular, housing, bedroom, sleeping box, indoor box, birthing box or nursery shall be considered as an internal breeding area;
(c) an outdoor breeding area designed and enclosed for the breeding of selected species of shale or apes located outside the construction; the outdoor breeding area shall be considered in particular the outdoor enclosure;
(d) the weaning area separated by a enclosed space intended for temporary residence of selected species of shale or lidoops, which is used for the protection of animals at the time of veterinary treatment and treatment, baby delivery, feeding, cleaning, repair or modification of premises in which the animals are kept permanently; a weaning yard or a weaning box shall be considered as a weaning area;
(e) a bunk-bed raised area to rest the animals;
(f) hammy hanging equipment intended for resting animals,
(g) by the barrier of durable material placed as a continuation of the boundaries to the necessary depth in the ground,
1. Suspected, i.e. solid foundations in the country to which the second to eighth parts of the country are based or which are carried out on a solid basis,
2. metal rods reaching the solid substrate and located at a distance apart to ensure that the animal cannot escape; or
3. entangled metal mesh or welded net placed vertically to the depth specified in the parts of the second to eighth, or placed in a solid subsoil or horizontally below the surface, at a distance of at least 1 m on either side of the boundary,
(h) the overhang of the upper part of the breeding area boundary, which is directed inside the breeding area, is composed of a mesh, metal rods or plates of different material and serves to ensure the integrity of the breeding area boundary.
(2) For the purposes of this decree, the width of the dry trench shall be measured horizontally from the edge of the dry trench located at the outer wall of the breeding area boundary to the opposite upper edge of the dry trench. In the case of a moat, width means the width of the water level.
General breeding conditions for selected species of snails and apes
(1) The breeder of animals of selected species of snails or apes must:
(a) provide the animals with freedom of movement, taking into account their natural needs, so that they are not subjected to unnecessary suffering;
(b) have a storage area available; other indoor or outdoor breeding area may also be used for the function of the weaning area;
(c) have a breeding area available for the separation of the animal where the separation of the animal requires its health status, isolation, quarantine, treatment or stage of biological activity, or where the animal is subject to temporary aggressive behaviour of other animals, provided that more than one animal is kept;
(d) keeping separately animals which are characterised by permanent intolerance or are themselves exposed to the permanent aggressive behaviour of other animals under the conditions set out in Parts Two to Eight;
(e) ensure, at least once a day, an inspection of animals and breeding areas, including their equipment and safety, in particular the boundaries, and remove any defects detected within the shortest possible time, so as not to endanger the health and life of the animals;
(f) have stable or mobile lighting at your disposal to allow for proper inspection of animals and equipment;
(g) ensure that, according to its physiological needs, the animal has sufficient access to daylight, with the alternation of day and night;
(h) carry out regular cleaning of breeding premises and their surroundings and adequate maintenance of breeding premises;
(i) ensure the feeding and feeding of animals in accordance with their physiological needs; and
(j) provide animals with access to water which does not endanger their health.
(2) In the cleaning and maintenance of breeding premises and the feeding of feed, the breeder shall ensure that the animals are placed in storage. No one is allowed directly into animals. Only other enclosed areas may enter the breeding areas; This shall not apply if service doors are entered into the breeding premises for the establishment and removal of substrates or other bulky materials.
(3) The provisions of paragraph 2 of the first and second sentences do not apply to breeding
(a) chabrac hyenas (Parahyaena brunnea), brisling hyenas (Hyaena hyaena), wolf (Canis lupus) or sardine (Lynx lynx); or
(b) non-independent pups selected by sow species at a time when no adult animal is present in the breeding area.
(4) The provisions of paragraph 2, second sentence, shall not apply to cases where the animal is in general anaesthesia, unless there is another animal in the breeding area.
(5) It is prohibited to cross individuals of different species from the large cat subfamily (Pantherinae). The crossing of individuals of different species of the Bear family (Ursidae) is prohibited. The crossing of individuals of different species of the lidoopi family (Hominidae) is prohibited.
Requirements for feeding selected species of sow
(1) The breeder must not serve frozen fodder to selected species; This does not apply to the case where frozen feed is administered to the animal as food enrichment. Frozen feed shall not be the main part of the feed ration.
(2) When keeping selected species, the breeder must ensure that the feeding is consistent with the physiological needs of selected species and consists mainly of meat, skin, fur and bones.
Requirements for lidoop feeding
(1) When keeping lidoops, the breeder must submit feed to animals at least three times a day and ensure that it meets their physiological needs.
(2) When keeping gorillas, the breeder must ensure that the feed consists mainly of vegetables, granules with high fibre content and a sieve in the form of twigs, shoots, leaves or flowers.
(3) When keeping chimpanzees, the breeder must ensure that the feed consists mainly of vegetables, animal ingredients in the form of insects, cooked eggs or meat and a nibble in the form of branches, shoots, leaves or flowers.
(4) When keeping orangutans, the breeder must ensure that the feed consists mainly of vegetables, fruit, seeds, nuts and cucumbers in the form of twigs, shoots, leaves or flowers.
General requirements for breeding areas for the breeding of selected species of deer and apes and their equipment
(1) The breeder of selected species of snails or apes must ensure that breeding premises
(a) they are easily accessible and accessible to persons carrying out farming and care activities for selected species of shale or apes,
(b) allow for proper supervision, care and safe monitoring of the performance of the breeder's duties;
(c) correspond to their size and equipment to the biological and social needs of the species concerned;
(d) they are made of materials and are equipped with materials and articles which are clean and are healthy, non-irritating to animals, do not disturb their well-being and do not cause them injury;
(e) comply with the requirements for temperature requirements of the species concerned;
(f) be ventilated, free of unwanted moisture and unwanted draught; and
(g) they have been secured against the entry of persons different from the breeder and persons authorised by him.
(2) The breeder of selected species of snails or apes must ensure that breeding areas are equipped to provide shelter for animals, stimuli to stimulate natural manifestations of behaviour, allow natural activity and care for the body surface. The equipment of the breeding premises shall be so located as not to restrict the freedom of movement of the animal.
(3) If the animal does not have access to the internal breeding area, the breeding area shall be equipped to provide shelter for the animals against adverse weather conditions.
(4) The breeder of selected species of snails or apes must ensure that:
(a) the entry into the breeding premises is secured by a combination of at least two safety features against the release of kept animals; and
(b) the entry into the internal breeding premises and all outdoor breeding premises have been marked with written information concerning the prohibition of entry of persons different from the breeder and his authorised persons.
(5) It is prohibited to keep selected species of shale or apes in an apartment or non-residential area not intended for animal husbandry. It shall be prohibited to use premises or parcels which are not enclosed in the manner set out in Parts Two to Eighth for the purposes of runs or walks, as appropriate.
Requirements for the boundaries of the breeding area for the breeding of selected species of deer and apes
(1) The border of the breeding area must be made from solid and durable material which prevents the release of the animal. Breeding areas shall not be enclosed by an electric barrier only. The border of the breeding area shall be kept regularly, in particular the damage and defects of the materials used being prevented.
(2) The breeder of selected species of shale or lidoop must ensure that the breeding premises are located in a separate demarcated area within the building or within a separate enclosed area. The border of the area in which the breeding area is located, including access points, shall be designed, implemented and maintained in such a way as to prevent unauthorised entry of persons into the area in which the breeding area is located and at the same time to reasonably prevent the release of animals. The border referred to in the second sentence shall not be carried out solely by an electric border.
(3) The electrical barrier shall be considered as a boundary only in combination with the other type of boundary referred to in Parts Two to Eight. If the breeder has to use an electric fence to limit the breeding area under this decree, he shall be obliged to provide its backup power in the event of a power failure.
Requirements for the size and equipment of breeding premises for the breeding of selected species
(1) The requirements for the size and equipment of breeding premises for the breeding of selected species of herring referred to in Parts Two to Seven apply to adult animals or to the breeding of pups which are kept separately from adult animals. In the case of breeding of pups together with parents, it is possible to keep animals of selected species until the age of 2.5 years in the breeding area intended for adult animals without the requirement to extend the breeding area and without the requirement of further equipment.
(2) The requirements for the size and equipment of breeding premises for the breeding of selected species of herring referred to in Parts Two to Seven do not apply to the breeding of animals placed separately for the reason referred to in Section 3 (1) (c).
(3) All breeding areas of selected species of sash, the size of which is set in m2 by this decree, shall be so implemented and maintained that the ratio of individual sides of the breeding area allows the animal to move freely in accordance with its biological and ethological needs.
(4) Where the breeding area for selected species is equipped with a water surface, the water surface shall be so constructed and maintained that the ratio of the individual sides of the water surface and its depth allow the animal to satisfy its biological and ethological needs.
Requirements for size and equipment of breeding areas for lidoop farming
(1) The size and equipment requirements for breeding areas for lidoops referred to in Part Eight apply to adult animals or to cubs which are kept separately from adult animals. In the case of the breeding of pups together with parents, it is possible to keep lidoops until the age of 10 in the breeding area intended for adult animals without the requirement to expand the breeding area and without the requirement of further equipment.
(2) The size and equipment requirements for breeding areas for lidoops referred to in part eight shall not apply to the breeding of an animal placed separately for the reason referred to in Article 3 (1) (c).
(3) All breeding facilities for lidoop breeding, the size of which is set in m2 or m3 by this decree, shall be carried out and maintained so that the ratio of the individual sides of the breeding area allows the animal to move freely in accordance with its biological and ethological needs.
CONDITIONS OF ANIMAL ORIGIN OF THE SHELM (CARNIVORA) ORIGIN OF CHICKEN FROM THE SUBJECT OF THE BIG CAT (PANTHERINAE) OF ALL SPECIES
Conditions for the breeding of the Ussuria tiger (Panthera tigris altaica)
(1) In the case of the breeding of a Ussuria tiger (Panthera tigris altaica), the breeder must ensure the following requirements for the construction and security of breeding areas:
(a) the breeding area must be enclosed on all sides, except for the ceiling;
(b) the boundaries must be carried out
1. fixed walls,
2. Metal bars,
3. safety laminated glass,
4. welded or entangled mesh,
5. welded or metal mesh,
6. dry moats; or
7. water trenches,
(c) the boundaries referred to in (b) (1) to (5) shall be supplemented by:
1. an electrical barrier situated inside the breeding area above the ground in front of the lower part of the boundary which prevents the animal from having access to the boundaries in an immediate manner and in the rake; or
2. by a barrier in the form of a suspect of a depth of not less than 40 cm or in the form of a woven metal mesh or welded net held vertically or horizontally below the surface within a distance of not less than 1 m on either side of the boundary,
(d) the boundaries referred to in (b) (6) and (7) shall be supplemented by an electrical barrier situated within the breeding area at the upper edge of the boundaries;
(e) the height of the boundaries referred to in (b) (1) to (5) shall be at least 4 m
1. including a overhang of 0,5 m or more; or
2. with an electric barrier located inside the breeding area at the upper edge of the boundaries,
(f) the width of the dry trench referred to in (b) (6) shall be at least 9 m with an outer wall of at least 4 m high; and
(g) the width of the moat referred to in point (b) (7) shall be not less than 7,5 m with an outer wall of not less than 4 m high, showing
1. not less than 1,2 m above the surface and supplemented by a overhang of not less than 0,5 m or an electrical barrier; or
2. at least 2 m above the surface.
(2) When keeping a Ussurian tiger, the breeder shall ensure the following requirements for the size of the breeding areas:
(a) for the breeding of one or two animals, the outdoor breeding area shall be at least 300 m2;
(b) for the third and each other animal, if kept, there shall be at least another 150 m2 of outdoor breeding area; and
(c) the internal breeding area, if established for the rearing of the animal, shall have an area of at least 20 m2 for each animal and a height of not less than 2,2 m.
(3) When keeping a Ussurian tiger, the breeder shall ensure the following requirements for the equipment of the breeding premises:
(a) the artificially reinforced area shall not be more than a third of the surface of the outdoor breeding area, the remaining part of the outdoor breeding area shall be covered by the natural surface;
(b) the outdoor breeding area must be structured and equipped with raised places to rest the animal, in particular trees or bunk beds;
(c) an outdoor weaning area for each animal or an internal breeding area with an internal weaning area for each animal must be included;
(d) the internal breeding area, if established for the rearing of the animal, must be equipped with raised resting places, in particular bunk beds;
(e) a shelter from adverse weather conditions for each animal must be part of the breeding area; and
(f) part of the outdoor farming area shall be a water area at a depth of not less than 50 cm and a surface of not less than 2 m2.
(4) The breeder must not let a Ussurian tiger into the outdoor breeding area if the moat is continuously frozen and the ice clearance is below 4 m.
Conditions for keeping tigers in warm areas
(1) In the case of the breeding of tigers of warm areas, i.e. Chinese tiger (Panthera tigris amoyensis), Indian tiger (Panthera tigris tigris), Indian tiger (Panthera tigris tigris corbetti), Malaysian tiger (Panthera tigris jacksoni), Indian tiger (Panthera tigris sumatrae), Indian tiger (Panthera tigris), non-species tiger (Panthera tigris), cross-species cross-species (Panthera tigris sumatrae), a non-species tigrass tiger (Panthera), the breeder must ensure the requirements for the design and security of the breeding areas referred to in Section 10 (1).
(2) When keeping a tiger of warm areas, the breeder shall ensure the following requirements for the size of the breeding areas:
(a) for keeping one or two animals, the outdoor breeding area shall be at least 200 m2;
(b) for the third and each other animal, if kept, there shall be at least another 100 m2 of outdoor breeding area; and
(c) the internal breeding area shall have an area of at least 12 m2 for each animal and a height of at least 2 m.
(3) When keeping a tiger of warm areas, the breeder shall ensure the following requirements for the fitting of breeding areas:
(a) the artificially reinforced area shall not be more than a third of the surface of the outdoor breeding area, the remaining part of the outdoor breeding area shall be covered by the natural surface;
(b) the outdoor breeding area must be structured and equipped with raised places to rest the animal, in particular trees or bunk beds;
(c) the animal must have access to its internal breeding area at temperatures not below 15 ° C;
(d) the internal breeding area must be equipped with raised resting places, in particular bunk beds; and
(e) part of the outdoor breeding area shall be a water area with a depth of at least 50 cm in the deepest place and a surface of at least 2 m2.
(4) The breeder must not allow the tiger of warm areas into the outdoor breeding area if the moat is continuously frozen and the ice clearance is below 4 m.
Conditions for lion breeding (Panthera leo)
(1) When keeping a lion (Panthera leo), the breeder shall ensure the following requirements for the design and security of breeding areas:
(a) the breeding area must be enclosed on all sides, except for the ceiling;
(b) the boundaries must be carried out
1. fixed walls,
2. Metal bars,
3. safety laminated glass,
4. welded or entangled mesh,
5. welded or metal mesh,
6. dry moats; or
7. water trenches,
(c) the boundaries referred to in (b) (1) to (5) shall be supplemented by:
1. an electrical barrier situated inside the breeding area above the ground in front of the lower part of the boundary which prevents the animal from having access to the boundaries in an immediate manner and in the rake; or
2. by a barrier in the form of a suspect of a depth of not less than 40 cm or in the form of a woven metal mesh or welded net held vertically or horizontally below the surface within a distance of not less than 1 m on either side of the boundary,
(d) the boundaries referred to in (b) (6) and (7) shall be supplemented by an electrical barrier situated within the breeding area at the upper edge of the boundaries;
(e) the height of the boundaries referred to in (b) (1) to (5) shall be:
1. not less than 4 m including overhang of a width of not less than 0,5 m;
2. at least 4 m with an electrical barrier situated within the breeding area at the upper edge of the border; or
3. at least 3,5 m with a pre-set electrical barrier with at least four conductors placed above each other inside the breeding area which prevents the animal from having access to the boundaries immediately;
(f) the width of the dry moat referred to in point (b) (6) shall be at least 8 m with an outer wall of at least 4 m high; and
(g) the width of the moat referred to in point (b) (7) shall be not less than 7,5 m with an outer wall of not less than 4 m high, showing
1. not less than 1,2 m above the surface and supplemented by a overhang of not less than 0,5 m or an electrical barrier; or
2. at least 2 m above the surface.
(2) When keeping a lion, the breeder shall ensure the following requirements for the size of the breeding areas:
(a) for keeping one or two animals, the outdoor breeding area shall be at least 200 m2;
(b) for the third and each other animal, if kept, there shall be at least another 100 m2 of outdoor breeding area; and
(c) the internal breeding area shall have an area of not less than 12 m2 for each animal and a height of not less than 2,5 m.
(3) When rearing a lion, the breeder shall ensure the following requirements for the fitting of breeding areas:
(a) the artificially reinforced area shall not be more than a third of the surface of the outdoor breeding area; the remaining part shall be covered by the natural surface;
(b) the outdoor breeding area must be structured and equipped with raised places to rest the animal, in particular trees or bunk beds;
(c) the animal must have access to its internal breeding area at temperatures not below 15 ° C; and
(d) the internal breeding area shall be equipped with raised places to rest the animal, in particular bunk beds.
(4) The breeder must not let the lion into the outdoor breeding area if the moat is continuously frozen and the ice clearance is below 4 m.
Conditions for the rearing of leopards of cold areas and irbis
(1) In the case of the rearing of leopards of cold areas and irbises, that is to say, Chinese leopards (Panthera pardus japonensis), Manchurian leopards (Panthera pardus orientalis), Persian leopards (Panthera pardus saxicolor) or irbisa (Panthera uncia) (hereinafter referred to as "leopharts of cold areas or irbis'), the breeder shall ensure the following requirements for the design and security of breeding areas when the outdoor breeding area is closed up:
(a) the breeding area must be bounded on all sides, including the ceiling;
(b) the boundaries must be carried out
1. fixed walls,
2. Metal bars,
3. safety laminated glass,
4. welded or entangled mesh, or
5. welded or metallic nets; and
(c) the boundaries referred to in point (b) shall be supplemented in such a way as to prevent the animal from trapping;
1. an electrical barrier situated inside the breeding area above the ground in front of the lower part of the border which prevents the animal from having access to the border immediately; or
2. by a barrier in the form of a suspect of a depth of not less than 40 cm, or in the form of a woven metal mesh or welded net deposited vertically or horizontally below the surface within a distance of not less than 1 m on either side of the boundary.
(2) When keeping a leopard of cold areas or irbisa, the breeder shall ensure the following requirements for the design and security of breeding areas, as far as the upper open outdoor breeding area is concerned:
(a) the breeding area must be enclosed on all sides, except for the ceiling;
(b) the boundaries must be carried out
1. fixed walls,
2. Metal bars,
3. safety laminated glass,
4. welded or entangled mesh, or
5. welded or metal mesh,
