of 27 June 2023
on equidae and pet animals carcases
The Ministry of Agriculture provides pursuant to Section 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 18 / 2012 Coll., Act No. 359 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 139 / 2014 Coll., Act No. 250 / 2014 Coll., Act No. 264 / 2014 Coll., Act No. 302 / 2017 Coll., Act No. 368 / 2019 Coll., Act No. 246., Act No. 246 / 2022 Coll., for the implementation of § 40 (4) and § 41 (a) of the Veterinary Act:
§ 1
Subject matter
This decree regulates the application of directly applicable European Union1)
(a) the conditions for the disposal of horse carcases by the breeder on his own land with the agreement of the Regional Veterinary Administration;
(b) more detailed animal health and veterinary requirements for the animal cemetery and for the disposal of pet carcases by burial in the animal cemetery.
§ 2
Conditions for the disposal of horse carcases by the breeder on his own land
(1) The place intended for the burial of horse carcases shall be selected in such a way that, after the burial of the horse carcases, the water source may not be contaminated (2), shall not be situated in the flood area for the flow of 20 years of water and shall be at least at least
(a) 10 m from the places where the livestock or other equidae are kept;
(b) 200 m from the border of the protection zone of first-degree aquatic resources and at least 30 m from the body of surface water5),
(c) 50 m from the nearest building for housing or family recreation (3);
(d) 50 m from the nearest road (4), with the exception of access infrastructure; and
(e) 10 m from the border of the adjacent parcel.
(2) The distance referred to in paragraph 1 (e) may be less if the owner of the adjacent parcel so agrees. The written consent, in addition to the identification of the two owners of adjacent parcels, the identification of those parcels, the purpose of the consent, the date of its granting and the signature of the consent-giver, shall also include the agreed distance of the place intended for the burial of the equine carcases from the border of the neighbouring parcel.
(3) The size and depth of the excavation must correspond to the size of the body buried in the horse carcases. The kickoff date shall be above the ground water level. The horse carcases shall not be stowed in the excavation in the packaging and shall be filled with a soil-covered layer of at least 1,5 m to the terrain level and other at least 20 cm above the terrain level.
(4) Only one horse carcases may be buried in one place for burial for at least 10 years. Before the end of the festering period, an additional equestrian cadaver may be stored in the same place if it can be placed above the level of the last-buried equestrian cadaver in such a way that the layer of limpid soil between them is at least 0,5 m and the requirement for a layer of soiled soil above the carcases referred to in paragraph 3 is complied with.
(5) The distance between the nearest edges of the adjacent areas for the burial of the equine carcases shall be at least 1 m.
§ 3
Veterinary and sanitary requirements for the animal cemetery
(1) The land intended for the establishment of a pet cemetery must be fenced or otherwise secured in order to avoid digging up the carcases of pet animals by other animals.
(2) The pet cadaver must be buried no later than 48 hours after the death of the animal, unless cooling or freezing is ensured by the time the cadaver is buried.
(3) The place intended for the burial of pet carcases in the animal cemetery shall be selected in such a way that, after the burial of pet carcases, the water source cannot be contaminated (2), shall not be situated in the flood area for the flow of 20 years of water and shall be at least at least
(a) 10 m from the places where the animals are kept;
(b) 200 m from the border of the protection zone of first-degree aquatic resources and at least 30 m from the body of surface water5),
(c) 50 m from the nearest building for housing or family recreation (3);
(d) 50 m from the road (4), with the exception of access infrastructure; and
(e) 10 m from the border of the adjacent parcel.
(4) The size of the dig shall correspond to the size of the body buried in the pet cadaver. The kickoff date shall be above the ground water level. If the cadaver is stored in a dig in the package, the packaging in the soil must be degraded and must not damage the environment. The carcases shall be filled with a layer of soiled soil at least 80 cm up to the ground level and other at least 10 cm above the ground level. A cadaver of small pet animals weighing up to 3 kg shall be filled with a soil-covered layer of at least 40 cm to the ground level and other at least 10 cm above the ground level.
(5) Only one cadaver can be buried in one place for the burial of a pet cadaver for at least 5 years. However, more carcases may also be buried in one place for the burial of carcases as far as they are pet carcases of the same breeder buried at the same time; the melting time is at least 5 years in this case.
(6) Before the end of the period, another pet cadaver may be stored in the same place if it can be placed above the level of the last-buried cadaver so that the layer of lightened soil between them is at least 30 cm and the requirement for a layer of soiled soil above the carcases referred to in paragraph 4 is complied with.
(7) The distance between the nearest edges of adjacent places intended to bury the pet carcases shall be adjusted to the size of the carcases, but not less than 30 cm.
§ 4
Record keeping
(1) The equine breeder shall keep records, in accordance with Section 6 of Chapter IV of Annex VIII to Commission Regulation (EU) No 142 / 2011, containing the species of equine animals buried on his own parcel, the date and place of burial, located by GPS coordinates or by an indication on the cadastral map, and the identification of the animal buried); records shall be kept for at least 10 years.
(2) The animal cemetery operator shall keep, in accordance with Section 6 of Chapter IV of Annex VIII to Commission Regulation (EU) No 142 / 2011, records containing the type of pet animal buried in the animal cemetery, the date and place of its burial and the identification of the animal buried; records shall be kept for at least 5 years.
§ 5
Final provision
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 6
Repeal
Decree No. 82 / 2014 Coll., on pet carcases, is repealed.
§ 7
Efficacy
This Decree shall take effect on 1 July 2023.
