DECLARATION
of 18 January 2010
amending Decree No. 2 / 2006 Coll., implementing certain provisions of the Education Act as amended by Decree No. 323 / 2008 Coll.
According to Section 172 (5) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 342 / 2006 Coll. and Act No. 242 / 2008 Coll., (hereinafter referred to as "the Act"):
Decree No. 2 / 2006 Coll., implementing certain provisions of the Education Act, as amended by Decree No. 323 / 2008 Coll., for schools and educational establishments established by the Ministry of Interior, is hereby amended as follows:
1. In Paragraph 2 (1), the second sentence is replaced by the following: "In accordance with an accredited training programme, for teaching in certain subjects or other integrated parts of a study group, the sentence may be divided into sub-groups, or may combine study groups and sub-groups."
2. in § 2 (2) at the end of the text of point (b) and in § 30 (1) at the end of the text of point (a), the words "or other comprehensive part of the teacher" shall be added;
3. in Article 2 (2) (d):
"(d) the nature of the knowledge, skills and attitudes acquired,"
4. In Article 2, the following paragraph 3 is added:
"(3) The teaching of foreign languages takes place in groups formed for the relevant foreign language. The highest number of pupils in the group is 23. The group may be composed of pupils from several classes of the same year. ';
5. In Article 11 (3), "and (b) 'is replaced by" to (c)';
6. Paragraph 11 (4) reads as follows:
"(4) A certificate certifying basic education or compulsory education shall be presented by the tenderer immediately after its issue; if it is not issued at the time of filing the application, it shall do so no later than the date on which it becomes a pupil of the school. ';
7. Sections 12 to 15, including the headings, read:
Application procedures and deadlines for the first round of the admission procedure
(K § 64 of the Act)
(1) The applicant shall submit an application for a daily form of education to the principal of the secondary school by 15 March.
(2) A candidate applying for a non-daily form of education shall submit an application to the Director of a secondary school by 20 March.
Announcement of the first round of the admission procedure and the replacement deadline
(K § 64 of the Act)
(1) The principal of the school shall declare the first round of the admission procedure by 31 January by publishing in a public place accessible to the school and in a way that allows remote access.
(2) The entrance exam, if decided by the school director, shall take place in the first round of the admission procedure on working days from 22 April to 7 May.
(3) Admission examinations in the first round of the admission procedure to a non-daily form of education, to an extension study, to obtain a secondary education with a graduate examination, if provided for by the school director, shall take place in the periods from 2 to 17 May.
(4) In the event of the announcement of further rounds of the admission procedure, the date by which applications for training may be submitted at the latest shall be announced.
(5) An invitation to take the first round entrance exam shall be sent by the school director to the tenderer no later than 14 days before the first round and no later than 7 days before the first round. The invitation shall include information on the requirements for the entrance examination established by the school director, the expected number of applicants admitted and the criteria for the admission procedure.
(6) Information on the absence of an entrance exam will be published by the school director without undue delay in a place accessible to the public at the school and in a way that allows remote access and that the admission examination is not carried out in writing.
(7) Candidates who, for serious reasons for the entrance exam, do not appear within the prescribed time limit and who make a written apology to the school director not later than 3 days after the deadline for the entrance exam, shall set a replacement deadline for the examination to be carried out no later than 1 month after the initial date of the entrance examination. The invitation to take the entrance exam shall be sent by the school director no later than 5 days before the examination. There are no serious reasons for taking the entrance examination at another school.
Publication of the results of the admission procedure
(K § 64 of the Act)
(1) The principal of the school shall publish in a public place accessible to the school and in a manner which allows remote access within 3 working days of the date of the last examination or of the publication of information on its failure to perform the examination.
(a) the ranking of tenderers according to the outcome of the evaluation of the admission procedure;
(b) an overview of the tenderers received and not received;
(c) the criteria for the admission procedure.
(2) The order of tenderers shall be published under the registration number. The registration number shall be assigned to the applicant at the school on the day of the entrance examination before the start of the examination.
(3) For the next round of the admission procedure, the applicant shall, at his request, issue the application form to the principal of the school who has announced the next round.
Appeals in admissions
(K § 64 of the Act)
(1) The principal of the school shall designate and publish, without undue delay, after the first round of the admission procedure in a public place accessible at the school and in a way that allows remote access, the number of vacant places for appeal proceedings.
(2) The Director of the School shall refer the Ministry of the Interior (hereinafter referred to as "the Ministry"), together with the appeal of the criteria for the admission procedure under which he has followed. "
8. The following Section 15a is inserted after Section 15, including the title and footnote 5b:

The provisions of the Decree setting out the details of the organisation of the admission procedure for secondary schools5b) shall apply mutatis mutandis to the details of the registration form.

9.
Admission to higher than first year
(K § 64 of the Act)
The school director may accept candidates to a higher education year in a secondary school. The school director may, after examining the documents of the applicant for prior education, determine the content, date, form and criteria of the examination, in accordance with the framework training programme of the relevant field of education. ';
10. Paragraph 19, including the title and footnotes Nos 9 and 10, reads as follows:
Comprehensive test
(K § 71 of the Act)
(1) The examination shall be carried out by the pupil in the case of:
(a) in the case of repair tests 9); or
(b) in writing, if an adult pupil or a legal representative of a minor pupil asks for his or her comic check due to doubt as to the accuracy of the assessment10).
(2) The Committee for Comprehensive Trials is at least three members. The Director of the School shall appoint the Commission. Its chairman is the principal of the school or a teacher appointed by it, other members are the examiner of the subject or other comprehensive part of the teaching and the associate who is qualified to teach the same or related subject or other integrated part of the teaching.
(3) The test result shall be determined by the panel by a majority vote. A report shall be drawn up on the comic test, which shall become part of the pupil's teaching documentation. The results of the examination shall be announced by the President publicly on the day of the examination.
(4) In case of doubt as to the correctness of the pupil's assessment, the pupil may only be tested once in the relevant semester from the subject concerned.
(5) The number of examinations to be carried out in one day shall be determined by the school director in agreement with the adult pupil or the legal representative of the minor pupil.
(6) For serious reasons, an adult student or legal representative of a minor student may, at the latest before the beginning of the examination, make an apology to the principal of the school, or, in particular, for health reasons, in writing and subsequently, within 3 days of the expiry of the deadline for carrying out the examination. The replacement term for the examination shall be determined by the school director.
(7) If the pupil withdraws from the comical examination after its initiation, if he does not attend the comical examination without an apology or if his apology has not been accepted, or if he seriously violates the rules of the comical examination, it shall be considered as having passed the comical examination unsuccessfully.
(8) The content and scope of the examination shall be determined by the school director in accordance with the framework training programme.

11. in Paragraph 20 (1), the second sentence is replaced by the sentence "The proof of education obtained abroad must comply with the requirements laid down in other legislation11."

Professional practice
(K § 71 and 103 of the Act)
(1) Professional practice shall take place to the extent provided for in the framework training programme or accredited training programme in schools or in the places of employment of persons authorised to work in the field of education which have concluded a contract with the school (hereinafter referred to as the "contracting entity").
(2) A practical teacher, a teacher of professional subjects or other comprehensive parts of a teacher or a person entrusted with a contract body shall conduct professional practice at the school.
(3) The organisation of professional practice shall be determined by the school director according to the focus of the field of education and the conditions laid down for the course of education in the framework training programme or accredited training programme. ';
14. In § 26 (1) to (4), the words "or student 'shall be inserted after the word" pupil'.
15. In Paragraph 26, the words "or student 'shall be added at the end of paragraph 5.
16. in Paragraph 27 (2), "1 June" is replaced by "15 June."
17. in Paragraph 27 (9), the words "refer to the Ministry of the Interior" shall be replaced by the words "refer to the Ministry."
18. in Paragraph 29 (g):
"(g) the terms and conditions of cooperation of an authorised official of a State's organisational body engaged in the activities of a school and of an employee of a natural or legal person, or of an organisational body of the State in the organisation and management of professional experience at the workplace of a natural or legal person or of an organisation of a State."
19. In Paragraph 30 (1) of the Introductory Part of the provision, the words "or other comprehensive part of the provision 'are inserted after the word" subject'.
20. Paragraph 30 (4) reads:
"(4) The calculation shall be granted by the teacher for compliance with the requirements laid down in the curriculum of the subject or other integrated part of the teaching. In the study report, the award of the credits shall be recorded by the word" counted ', to which the date of award and the signature of the teacher shall be added. Non-inclusion shall not be included in the study statement.';
21. Paragraph 30 (6) reads as follows:
"(6) The examinations shall examine the knowledge, skills and attitudes of the student and his ability to apply the knowledge obtained by the study. ';
22. in Paragraph 30 (11), the words "from individual subjects" are replaced by the words "provided for in the training programme."
23. in Paragraph 31 (1), the word "in writing" shall be inserted after the word "student."
24. in Paragraph 31 (4):
"(4) The Commission is three members; the chair shall be the principal of the school or the teacher appointed by it, the other members shall be the examiner of the subject or other comprehensive part of the teaching and the associate to which the other teacher is the same or related subject, or other complete part of the teaching. ';
25. In Paragraph 31 (6), the first sentence shall be replaced by the sentence "The number of examinations to be carried out in one day shall be determined by the school director in agreement with the student."
26. in Articles 33 (2) and (4) and 34 (2), the words "or other comprehensive sections of the curriculum" shall be inserted after the words "subjects."
27. in Paragraph 35 (3), including footnotes 13a and 13b:
"(3) A student who is a member of the Police of the Czech Republic, of the Fire Rescue Corps of the Czech Republic or of the Office of Foreign Relations and Information and is granted a duty sabbatical at study 13a), or an employee included in these security corps, an employee of the Ministry, an organisational body of the State set up by the Ministry or an organisational body of the State to which the Ministry exercises its function as an organiser, and has a qualification agreement 13b) shall be exempt from payment.

28. The following Sections 35a to 35c are inserted after Section 35, including the headings and footnotes 13c and 13d:
Individual test
(Paragraph 113a (2) of the Law)
(1) A single examination, which corresponds in its content and form to the profile part of the final examination or discharge, may be carried out on test subjects or complete study sections determined by the school director.
(2) The applicant shall register for the individual test within the time limits set by the school director. The written application for each test shall include the original or an officially certified copy of the evidence of the education obtained.
(3) The individual examination will take place within the deadlines set by the school director.
(4) The individual examination shall be carried out in the same way as the profile part test or discharge test. The evaluation of the individual examination, which corresponds in its content and form to the profile part of the graduation examination, shall be carried out in accordance with § 17 and the evaluation of the examination which corresponds to the discharge test shall be carried out in accordance with § 34.
(5) The principal of the school in which the applicant has carried out the individual examination shall issue the individual test certificate to the applicant no later than 7 days after the date of evaluation of the applicant in that test, if the applicant has passed the individual examination successfully.
Payment per test
(K § 113a (2))
(1) For the performance of the individual exam, which corresponds to the graduation or discharge test in its content and form, the fee shall be up to CZK 1,500.
(2) An applicant who is a member of the Police of the Czech Republic, of the Fire Department of the Czech Republic or of the Office of Foreign Relations and Information and is granted leave to study or leave to obtain another professional requirement (13c), or is an employee included in these security corps, the Ministry's staff, the organisational body of the State established by the Ministry of State to which the Ministry exercises its duties as a founder, and the performance of the examination is in the interests of the employer, is exempt from payment.
Organisation of the notation test
(K § 108a (5))
(1) The nostrification test shall verify that the knowledge and skills of a foreign school graduate who has applied for recognition of the validity of a foreign document on the achievement of secondary or higher vocational training in the field of police or fire protection activities (hereinafter referred to as the "Foreign Certificate ') in the Czech Republic (hereinafter referred to as" the applicant') correspond to the objectives and content of the training according to the relevant training programme.
(2) The training examination at a school whose training programme assesses the foreign certificate (hereinafter referred to as the "school responsible") shall be ordered by the Ministry to the applicant.
(a) finding a partial difference in the content and scope of education in a foreign school; or
(b) if the applicant has not complied with the requirements laid down in other legislation13d.
(3) The content, scope and duration of the notation test are determined by the Ministry by internal regulation.
(4) The Commission for the Novification Test is at least three members. The President and the other members shall be appointed by the Head of the responsible department on a proposal from the Director or Directors of the relevant schools.
(5) The committee shall decide by voting on the evaluation of the overall result of the notation test. In the event of a tie, the chairman shall vote.
(6) A report shall be made on the novification test.
(7) The successful composition of the notation test, if ordered, is a condition for the recognition of the validity of the foreign certificate and the issue of proof thereof.

29. in Paragraph 36 (1):
"(1) The student shall pay the tuition in two instalments no later than 15 October for the winter period and no later than 15 February for the summer period of the school year concerned. ';
30. In Paragraph 39 (1), the words "snack, 'and" snack' are deleted.
31. in Paragraph 40, the words "Ministry of the Interior" are replaced by the words "Ministry."
32. in Paragraph 42 (1), the third sentence is deleted;
33.In Paragraph 45 (2):
"(2) The annual activity report of the school shall be drawn up over the period preceding the school year, except for basic data on school management. The school director shall send the annual report to the Ministry by 30 October and publish it in a publicly accessible place at the school and in a way that allows remote access. ';
34. in Article 48a (2), the words "Ministry of the Interior" shall be replaced by the words "Ministry."
35. the following Section 48b is inserted after § 48a, which includes the title:
Inspection activity
(Paragraph 175 (6) of the Law)
(1) Authorisations to carry out inspection activities against police schools and educational establishments set up by the Ministry and their contracting entities are shown by the Ministry staff by means of an inspection certificate, a model of which is given in Annex 3 to this Decree.
(2) Authorisations to carry out inspection activities against schools and fire protection facilities established by the Ministry and their contracting entities are demonstrated by members of the General Directorate of the Fire Rescue Corps of the Czech Republic and by the Ministry staff by an inspection worker, a model of which is set out in Annex 4 to this Regulation. "

In the upper part of the pass there is the inscription "MINISTERSTVO NATIONAL 'in the blue-framed white area with blue-framed letters and under it the text" Inspection Officer's Card' in black. In the left part of the licence there is a printed form of the holder with dimensions 26 x 35 mm. There are three white surfaces in the right side. The upper surface shall contain a black printed name and surname of the inspector, including academic titles. The medium area shall contain a black printed six-digit registration number and the lower area shall be the date of issue of the licence. In the lower right part of the licence is the signature of the Minister of Interior and the red imprint of the round stamp. A fully metallic hologram is located between the left and middle parts of the licence. The card is laminated with transparent foil.
The back of the licence shall contain the following text:
"The holder of this licence, in accordance with § 172 (5) of the Act of Education (Act No. 561 / 2004 Coll.), exercises the powers of the Czech School Inspection Ministry in accordance with § 173 to 175 of the Act of Education towards police schools and their contractual entities."

The upper area shall contain a black-printed name and surname of the inspector, including academic titles and, where applicable, an evaluation mark, in the case of a member of the Security Corps. The medium area shall contain a black printed six-digit registration number and the lower area shall be the date of issue of the licence. The signature of the Director-General of the Fire Department and the red imprint of the round stamp are on the bottom right of the licence. A fully metallic hologram is located between the left and middle parts of the licence. The card is laminated with transparent foil.

Efficacy
This Decree shall take effect on 1 March 2010.
