DECLARATION
of 12 January 2009
amending Decree No. 296 / 2003 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended
The Ministry of Agriculture provides pursuant to § 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll. and Act No. 182 / 2008 Coll., to implement § 27b (7) (d) and § 59 (6) of the Veterinary Act:
Decree No. 296 / 2003 Coll., on animal health and protection, on movements and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended by Decree No. 610 / 2004 Coll., Decree No. 330 / 2005 Coll., Decree No. 8 / 2007 Coll. and Decree No. 134 / 2007 Coll., are amended as follows:
1. footnote 1 shall read:
"(1) Council Directive 64 / 432 / EEC of 26 June 1964 on animal health problems affecting intra-Community trade in bovine animals and swine. Council Directive 97 / 12 / EC of 17 March 1997 amending and updating Directive 64 / 432 / EEC on animal health problems affecting intra-Community trade in bovine animals and swine. Council Directive 91 / 68 / EEC of 28 January 1991 on animal health conditions governing intra-Community trade in ovine and caprine animals. Council Directive 2003 / 50 / EC of 11 June 2003 amending Directive 91 / 68 / EEC as regards the tightening of control measures for the movement of ovine and caprine animals. Council Directive 98 / 46 / EC of 24 June 1998 amending and updating Annexes A, D (Chapter I) and F to Directive 64 / 432 / EEC on animal health problems affecting intra-Community trade in bovine animals and swine. Directive 2005 / 36 / EC of the European Parliament and of the Council of 6 July 2005 on the recognition of professional qualifications Regulation (EC) No 853 / 2004 of the European Parliament and of the Council of 29 April 2004 laying down specific hygiene rules for food of animal origin, as amended. '
2. In Paragraph 1 (j):
"(j) study subjects which must be included in the Master's study programme in the field of veterinary medicine and hygiene, and study subjects from which adequate knowledge and skills must be obtained, as referred to in Section 59 (1) of the Act, diplomas, certificates and other evidence of the required education, as referred to in Section 59 (2) (a) of the Act, the form, content and organisation of the attestation studies of official veterinary surgeons, the manner and organisation of the verification of knowledge and certification,";
3. In Article 1, at the end of point (l), the dot is replaced by a comma and the following point (m) is added:
"(m) the content, scope and organisation of specialised training aimed at investigating wild game bodies, the manner and organisation of the verification of knowledge acquired, certification and the keeping of a list of trained persons.";
(4) Paragraph 22, including footnote 11, is deleted.
5. In Paragraph 27, the present text becomes paragraph 1 and the following paragraph 2 is added:
"(2) The subjects to be included in the master's programme in the field of veterinary medicine and hygiene and the subjects from which adequate knowledge and skills must be obtained are listed in Annex 5. ';
6. The following Sections 29a to 29d are inserted after Section 29, including the common title and footnote 11:
"Specialised training to investigate wild game bodies
[K § 27b (7) (d) of the Act]
Specialised training with a focus on the investigation of wild game bodies in accordance with the directly applicable European Communities Regulation in the field of specific hygiene rules for food of animal origin (11) relating to the investigation of wild game bodies by a trained person shall be organised by a university with a veterinary study programme (hereinafter referred to as "the organiser ') of 17 hours of theoretical teaching.
(1) At the end of the specialised training provided for in Article 29a, and no later than 3 weeks after the end of the specialised training, its participants shall be tested before a three-member examination committee. The Chairman and other members of the Examination Committee shall be appointed and removed by the organiser from the representatives of the veterinary authorities, the organiser and hunting associations. The organizer determines the date and place of the exam.
(2) The test referred to in paragraph 1 shall take the form of a written test. The test is compiled by random selection of individual test questions prepared by the organizer from the field of specialised training according to § 29a. The test contains a total of 60 questions. Each question is assigned a possible 3 answers, of which more answers can be correct. Each correct answer is evaluated by 1 point. The test result decided by the Test Panel on the basis of the points obtained from the written test shall be assessed at the stage: the test is taken, the test not taken. A minimum of 75% of correct responses are required to evaluate the degree. A period of 60 minutes shall be set for the completion of the test. A report shall be drawn up by the Chairman of the Test Panel on the result of the test.
(3) A written communication on the outcome of the examination shall be submitted to the participant of the specialised training after the examination has been evaluated.
(4) On the basis of a composite test, a specialist training participant shall obtain a certificate of competence for the investigation of wild game bodies (hereinafter referred to as "the certificate ') and be entitled to examine wild game bodies as a trained person. The model certificate is set out in Annex 6.
(5) A participant in a specialised training course who has not passed the examination may request the organiser to repeat it in writing not earlier than 3 months after the date on which he was notified that he had not passed the examination. The test may be repeated only once.
(6) A Participant to a specialised training course which has not submitted or requested to be repeated no later than 6 months after the date on which it was notified that it had not completed that examination shall undergo re-specialised training before the next examination.
(1) The organiser to verify the knowledge of a trained person obtained by specialised training under § 29a organises further training in the range of 8 hours of theoretical instruction in the field of specific hygiene rules for food of animal origin (11) relating to the investigation of bodies caught by wild game by a trained person, which shall be completed by the trained person within 5 years of the previous examination. The organizer determines the date and place of the exam.
(2) At the end of the training referred to in paragraph 1, but no later than 3 weeks after the end of the training, the participant shall be subjected to a theoretical test before a three-member examination committee. The Chairman and other members of the Examination Committee shall be appointed and removed by the organiser from the representatives of the veterinary authorities, the organiser and hunting associations.
(3) The test referred to in paragraph 2 shall take the form of a written test. The test shall be drawn up by random selection of individual test questions developed by the organiser from the field of specialised training referred to in paragraph 1. The test contains a total of 45 questions. Each question is assigned a possible 3 answers, of which more answers can be correct. Each correct answer is evaluated by 1 point. The test result decided by the Test Panel on the basis of the points obtained from the written test shall be assessed at the stage: the test is taken, the test not taken. A minimum of 75% of correct responses are required to evaluate the degree. The duration of the test shall be 45 minutes. A report shall be drawn up by the Chairman of the Test Panel on the result of the test.
(4) A written communication on the outcome of the examination shall be submitted to the participant of the specialised training after the examination has been evaluated.
(5) A participant in a specialised training course who has not passed the examination may request the organiser to repeat it in writing not earlier than 3 months after the date on which he was notified that he had not passed the examination. The test may be repeated only once.
(6) A participant in a specialised training course who has not submitted or requested to repeat the test at the latest six months after the date on which it was notified that he had not completed that test is not entitled to carry out the examination of the bodies of wild game caught as a trained person and to re-study the specialised training provided for in § 29a before the next test.
(1) The organiser shall keep a list of trained persons in electronic form (hereinafter referred to as the list).
(2) The list consists of data on:
(a) the name and, where applicable, the names of the person trained, the date and place of birth and the address of the person trained;
(b) the date and result of the test referred to in Article 29b;
(c) the date and result of the test referred to in Article 29c.
(3) Entry into the list shall be carried out by the organiser without undue delay after the examination has been evaluated by the Examination Panel in accordance with § 29b or 29c, but no later than 5 days after the date of evaluation by the Examination Panel.
(4) The list management system shall ensure the preservation of all data referred to in paragraph 2. When keeping the list, the organizer shall ensure regular backup of the data from which the data contained in the list can be reconstructed. Data backup shall be carried out without undue delay after the entry of the data referred to in paragraph 2 in the list.
(11) Point 4 of Chapter I of Section IV of Annex III to Regulation (EC) No 853 / 2004 of the European Parliament and of the Council. ';
7. the following Annexes 5 and 6 are inserted after Annex 4:

STUDIES SUBJECT MATTERS IN THE MAGISTER STUDY PROGRAMME IN THE FIELD OF VETERINARY DOCUMENT AND HYGIENES AND STUDIES FROM WHICH THE OBJECTIVES MUST BE AMENDED NOTIFICATION AND IMPORTS
STUDY PROGRAMME FOR VETERINARY DOCTORS
The study programme leading to the acquisition of a diploma, diploma or other evidence of the required education in veterinary medicine and hygiene shall contain at least the following subjects:
I. Basic items

(c) Animal biology
(d) plant biology
(e) Biomath
II. Special items
Group 1: Basic Sciences
(a) anatomy including histology and embryology
(b) physiology
(c) biochemistry
(d) genetics

Group 2: Clinical Sciences
(a) obstetrics
(b) pathology including pathological anatomy
(c) Parasitology

(e) clinical lectures on various domestic animals, poultry and other animal species
(f) preventive medicine
(g) Radiology
(h) reproduction and reproduction disturbances
(i) hygiene rules
(j) veterinary legislation and judicial medicine

Group 3: Animal production

Practical teaching may take the form of external block practical teaching, if such teaching is day-to-day, is carried out under the supervision of a university with a veterinary study programme and does not last for more than 6 months in total throughout the study.
The allocation of theoretical and practical teaching between groups of subjects shall be balanced and coordinated so that the required knowledge and experience can be obtained in a manner that allows the veterinarian to carry out all their tasks appropriately.
AREAS WHICH ARE NOTIFIED FOR THE PURPOSES OF DIPLOM, CERTIFICATE OR OTHER DOCUMENT OF EDUCATION REQUIREMENTS IN VETERINARY DOCUMENT AND HYGIENE
Adequate knowledge
(a) the fields of science on which the activities of the veterinarian are based;
(b) the anatomy and physiology of healthy animals, their rearing and reproduction and hygiene in general, as well as their feeding, including the technology of production and preservation of feed corresponding to their needs;
(c) animal behaviour and protection,
(d) the causes, nature, course, consequences, diagnosis and treatment of animal diseases, both individually and collectively, including specific knowledge of diseases communicable from animals to humans;
(e) preventive medicine;
(f) hygiene and technology of the production, processing and putting into circulation of foodstuffs of animal origin;
(g) legislation concerning the areas referred to in (a) to (f);
(h) clinical and other practical experience gained under appropriate supervision.
