of 23 June 2025
on the method of providing free food and equipment for professional soldiers, reserve soldiers and active reserve soldiers
According to Article 93 of Act No. 221 / 1999 Coll., on Professional Soldiers, as amended by Act No. 122 / 2012 Coll. and Act No. 99 / 2025 Coll.:
INTRODUCTORY PROVISIONS
Subject matter
This decree regulates the way in which you provide free meals and equipment for professional soldiers, advance-duty soldiers and active-reserve soldiers.
Definition of terms
For the purposes of this decree:
(a) the indicative period of use, used in the process of ensuring the replacement of military equipment, expressing the duration of use of the individual equipment component in the months during which it is guaranteed to maintain its utility characteristics;
(b) a professional soldier or an advance-duty soldier authorised under a special legislation for the performance of pilot-in-command, pilot-in-command, helicopter co-pilot, helicopter co-pilot, navigator, cabin technician, cabin operator, cabin gunman and cabin crew (1);
(c) flight training flight activity to prepare designated military personnel for combat use; Flight training is also considered
1. its interruption period not exceeding 3 months; or
2. training on flight trainers or simulators;
(d) continuous practical parachute and rescue training to conduct the training provided for the training year; continuous practical parachute and rescue training shall be considered as a period of interruption not exceeding 3 months.
METHOD OF SAFETY OF SPECIAL STABILITY
Method of providing free meals
Free meals are provided with breakfast, lunch or dinner ("main meals") and food supplements. The main dish is made up of a warm diet, and if it can't be secured, then the form
(a) cold diet; or
(b) food for separate or group preparation of the main meal.
Free meals in the performance of special activities
Specific activities for the purpose of providing free meals are:
(a) the performance of the duties of designated military air personnel, from the date of appointment to the training group until the date of withdrawal or exclusion from the training group, in the case of flight training;
(b) the performance of the duties of a professional soldier or a soldier in reserve in the service of a service assigned to the carrying out of a training or rescue operation (hereinafter referred to as "the paratrooper"), from the date of commencement of continuous practical training and rescue training to the date of termination;
(c) the provision of flight actions throughout their preparation and conduct;
(d) preparation for the performance of the duties of designated military personnel, from the date of its commencement to the date of its interruption or termination, in a study specialisation of an executive military aircraft, including an interruption not exceeding 1 month;
(e) study at a military school in the field of study with a focus on provision, or in a similar vocational course at the Ministry of Defence educational establishment (hereinafter referred to as the Ministry), on the days of practical independent or group preparation of meals,
(f) the performance of a service in a foreign operation or in an operational capacity abroad, unless it is provided by an international governmental or transnational organisation, for the duration of that service;
(g) the performance of duty for the duration of continuous military deployment.
(1) No free meals or compensation in cash under Section 10 shall be provided to a professional soldier for a period of
(a) leave, leave granted for continuous military training, leave granted for continuous military deployment, study leave, retraining, replacement leave or duty leave;
(b) inability to serve for sickness or accident, with the exception of Article 4 (f);
(c) stay in medical, spa and recreational facilities;
(d) the exercise of custody; or
(e) maternity, parental or paternity leave.
(2) A professional soldier who is a member of a designated military flight crew or a paratrooper shall also not be provided with free catering or money compensation from the date of commencement of the presentation course at a military school or during a preschool course which does not include flight training or practical parachute and rescue training.
The main food and food must comply with the energy standards and nutritional values of the diet and food supplements set out in Annex 1 to this Regulation and the average food consumption composition set out in Annexes 2 and 3 to this Regulation.
Dietary doses
(1) The dietary benefits according to the complexity of the service are:
(a) basic diet,
(b) an increased diet, or
(c) the air diet.
(2) The basic diet is provided to the professional soldier and to the soldier in reserve in a service to which no other diet is due.
(3) An occupation soldier and an advance-duty soldier in service with a military unit or a military establishment in which the basic diet is not prepared shall be provided with the diet to be prepared for that military unit or military establishment.
(4) An increased diet shall be provided to the paratrooper in accordance with § 4 (b) and to the professional soldier and to the soldier in reserve in the service performing tasks in a foreign operation or operational deployment in accordance with § 4 (f).
(5) Aero-food levy is provided to designated military personnel under Section 4 (a), to an occupation soldier and to an advance-duty soldier preparing to perform the duties of designated military personnel under Section 4 (d) and to a paratrooper serving at an air base.
Food supplements
(1) Food supplements in the composition set out in Annex No 3 to this Decree are provided, depending on the complexity of the service and under the conditions laid down in this Decree,
(a) basic food addition (hereinafter referred to as "food addition A");
(b) widespread food additive (hereinafter referred to as "food additive B");
(c) the addition of food to designated military air staff on the days of flight activity (hereinafter referred to as "food addition C"); or
(d) the addition of food to designated military air personnel included in flight packages of supersonic and subsonic aircraft equipped with weapon systems and transport aircraft (hereinafter referred to as "food addition D").
(2) Food supplements are provided only when providing free meals. Food supplements shall be issued on days of entitlement to at least two main meals, namely the first.
(1) Food supplement A is provided to a professional soldier and a backed-up soldier on duty who is entitled to a basic diet
(a) a continuous service that lasts for at least 24 hours, with the exception of a continuous service of a supervisor that lasts 24 hours; or
(b) the security of flight actions referred to in Section 4 (c).
(2) The addition of food B is provided to the professional soldier and to the soldier in reserve on duty
(a) a continuous service that lasts for at least 24 hours, with the exception of a continuous service of a supervisor that lasts 24 hours; or
(b) to be assigned at night at the place of duty designated by the member of the designated military staff.
(3) The addition of food C shall be provided to a member of a designated military flight crew on the days of flight or on duty at the place of specified duty.
(4) Food addition D shall be provided to a member of a designated military flight crew included in the flight crew of supersonic and subsonic aircraft equipped with weapon systems or to a member of a designated military flight crew included in the flight crew of transport aircraft referred to in § 4 (a), but in service only for the duration of the service.
Refund in cash
(1) Refund in money for the main food is the financial value of the types and quantities of each food corresponding to the diet levy, including the food supplement and the supplement referred to in paragraph 5.
(2) If it is not possible to provide free meals in a foreign operation or in an operational deployment pursuant to § 3, the professional soldier in a foreign operation and the soldier in the service in an operational deployment outside the Czech Republic shall be compensated in cash for free meals at the level of the basic rate of foreign subsistence under another legislation.
(3) An outsider who is granted an allowance under Article 7 (5) shall be paid in cash equivalent to the financial value of the allowance under Article 7 (1) (b).
(4) An occupation soldier and a retired soldier are entitled to compensation in cash, in accordance with § 7 (1), in respect of a continuous service of a supervisory officer who lasts at least 24 hours.
(5) Where a professional soldier carries out a continuous service of at least 24 hours, or carries out a soldier on standby in the service of military employment, the compensation in respect of the individual main meals provided under paragraph 1 shall be increased by a surcharge, in the case of:
(a) breakfast 20%,
(b) lunch 40%,
(c) dinner 40%
the lowest level of diet laid down by the legislation governing the level and the procedure for granting travel allowances to an occupational soldier.
Financial, energy and nutritional value of diet and food supplements
(1) The financial value of the diet and food supplements shall be calculated by multiplying the average consumption composition of each food per kilogram per person per day in accordance with Annex 2 by their average consumer prices per kilogram. The average consumer price is the average price of a food certified by a market survey carried out by the Ministry of the Czech Republic.
(2) The financial value of food supplements and food supplements will only be changed in the case of an increase in the average annual consumer price index published by the Czech Statistical Office for the calendar year of more than 2%. In this case, the financial value of dietary benefits and food supplements will be increased by the average annual inflation rate published by the Czech Statistical Office.
(3) The financial value of the diet and food supplements shall be adjusted from the first day of the second month following the finding of the difference referred to in paragraph 2.
(4) The financial value of the subsistence allowance for an occupational soldier in a foreign operation and a soldier in the service in an operational deployment outside the Czech Republic is determined according to the development of consumer food prices verified by market research carried out by the Ministry in the foreign operation area or operational deployment.
(5) The monthly average consumption of energy and nutritional value of dietary doses, food supplements and their financial value in the days on which free meals are provided shall correspond to the values laid down in this Decree for individual food levies and food supplements, with the annual average consumption of these values not exceeding 10% above or 3% below the specified value.
The financial value of food supplements and food supplements to the professional soldier and to the retired soldier can be increased by 20% at
(a) the provision of rescue work; or
(b) ensuring the removal of the consequences of natural disasters or other serious situations affecting life, health, the environment or significant assets.
METHOD OF SAFETY OF INSTRUMENTS
Method of securing equipment
(1) The equipment shall be provided to the professional soldier and to the soldier in reserve in the service service by the issue of the components of the military uniforms listed for each group of soldiers in Annexes 4 to 7 to this Regulation and by the provision of free services or cash substitutes. Free service means laundry, dry cleaning, treatment, repair and maintenance of military equipment ("military uniform care ').
(2) Parts of military uniforms shall be issued to the professional soldier with a service ratio of less than 2 years and to the soldier in reserve in service, which shall be returned at the date of termination of the service. The obligation to return parts of military uniforms according to the first sentence shall not apply to a soldier in reserve who is placed in an active backup. Parts of military uniforms for which the service authority determines that their return is not effective or economical shall not be returned.
(3) A soldier in reserve in a service who has been placed under an active reserve under the Law of Defense within 2 years of the termination of his duty as an professional soldier shall use the military uniform set out in Annex 5 to this Order which was issued to him before the termination of that service; A soldier in reserve in the rank of General shall use the military uniform set out in Annex 7 to this Decree. The indicative period of use of the components issued shall not be modified by inclusion in the active advance.
(4) A soldier in reserve in a service who is admitted to the service of an occupational soldier uses the military uniforms issued to him. The indicative period of use of the equipment components issued shall not be changed by admission to the service of the professional soldier.
(5) Where an occupation soldier or an advance-duty soldier performs the duties referred to in Article 14 (1) in full or in part in a dress other than that of a military uniform (hereinafter referred to as "civil clothing '), the military uniform shall not be provided for that period or shall be provided according to the duties performed.
(6) The equipment components secured in accordance with paragraph 1 shall be rotated depending on the indicative periods of use of each component of the military uniform. Replacement of damaged or worn parts of military uniform necessary for the performance of the task may be effected before the end of the indicative period of use, at the request of an occupational soldier or an advance-in-service soldier, if the request has been approved by the service authority.
(7) The care of military uniforms referred to in paragraph 1 shall be provided as necessary and possible at the place of service in the form of:
(a) security of services;
(b) the supply of consumables; or
(c) security of assets for the care of military equipment.
Refunds in money for the use of civil clothing
(1) An occupation soldier and an advance-duty soldier who is a member of Military Intelligence, Military Police, Special Forces, Intelligence Security or is in Ops 2), who has been assigned by the Service Authority to carry out tasks excluding the use of military uniforms, shall be paid in cash.
(2) Amount of refunds in cash for
(a) the initial acquisition of components of civil clothing corresponds to the sum of the values of all replaced components of military uniforms which would otherwise be issued to the soldier;
(b) the replacement of components of civil clothing shall be equivalent to a multiplication of the aliquot values of the replaced military uniforms and the calendar days in which the soldier has been assigned to a service post requiring the wearing of civil clothing pursuant to paragraph 1; This compensation may be increased by up to twice to military intelligence members.
(3) Refunds in the money referred to in paragraph 2 for components of individual military uniforms may be granted to the professional soldier and to the reserve soldier in service referred to in paragraph 1 either at one or more stages.
(4) The refund in cash is paid according to:
(a) paragraph 2 (a), in the calendar month following the calendar month in which the professional soldier or the service-backed soldier was entitled to receive such compensation;
(b) paragraph 2 (b) shall be retrospectively in the month of February in respect of the previous calendar year, in terms of components of military uniforms for the previous calendar year, with a service salary for the month of January.
(5) In the case of a decision by the service authority to include an occupational soldier or a soldier in the service in a post obliged to wear civil clothing in the course of the service referred to in paragraph 1, the cash compensation for the initial acquisition of civil clothing components referred to in paragraph 2 (a) shall be repayable if 5 or more years have elapsed since the last service in that service.
Compensation in cash for unprocured parts of military uniforms
Compensation in cash for initial acquisition or replacement of non-ordered components of military uniforms shall be paid to the professional soldier and to the reserve soldier in service
(a) for the initial acquisition of such components in the calendar month following the calendar month in which the professional soldier or advance-paid soldier became entitled to this refund;
(b) for the replacement of those components in the month of February, each calendar day with a claim for such an entitlement for the previous calendar year, at the values established for the previous calendar year. Reimbursement shall be paid to the professional soldier together with the service salary for the month of January.
Compensation in cash for unsecured care of issued military uniforms and civil clothing
(1) A flat-rate compensation shall be granted to the professional soldier and to the retired soldier in the event of non-security of care for issued military uniforms pursuant to paragraphs 1 and 7 of Paragraph 13; in the case of non-security of care for components of civil clothing used in the performance of the service referred to in Section 14, the same shall apply. A flat-rate compensation for unsecured care of issued military uniforms or civil clothing shall be provided in such a way as to avoid overlapping.
(2) The standard refund is 6 CZK per day. The amount of the flat-rate compensation is the same for the unsecured care of military uniforms and civil clothing.
(3) A flat-rate refund shall be paid retrospectively in the month of February for the previous calendar year for calendar days with entitlement to this requirement. A professional soldier shall be paid together with his service salary for the month of January.
Cash amount of costs of military uniforms issued
The monthly monetary amount of the cost of securing individual military uniforms pursuant to Paragraph 13 (1) for determining the amount of money compensation for the issued military uniforms, which a soldier is obliged to replace to the Ministry under Section 91 (2) of the Law on Occupational Soldiers, are set out in Annex 8 to this Decree.
TRANSITIONAL AND REPEAL PROVISIONS
Transitional provisions
(1) The equipment required provided to the soldier under Decree No. 266 / 1999 Coll., on the method of providing free food, equipment and transport facilities and on the provision of accommodation for professional soldiers, advance-service soldiers and active-reserve soldiers, as effective before the date of entry into force of this Order, or Decree No. 287 / 2016 Coll., on the scope and method of providing the necessary and equipment for the advance-service soldiers, as effective before the date of entry into force of this Decree, shall be deemed to have been secured under this Order, provided that no indicative period of use has yet elapsed for the individual components of military uniforms issued.
(2) The indicative period of use of the component of military equipment issued pursuant to Decree No. 266 / 1999 Coll., as effective before the date of entry into force of this Order or Order No. 287 / 2016 Coll., as effective before the date of entry into force of this Order, is unchanged and is calculated from the date of issue of the component.
(3) Reimbursement in cash for the temporary formalities to which entitlement under Decree No. 266 / 1999 Coll., as effective before the date of entry into force of this Order, or under Decree No. 287 / 2016 Coll., as effective before the date of entry into force of this Order, is granted at the level of the existing legislation even if it is paid after the entry into force of this Order.
(4) In the case of the provision of free catering at events prepared, approved and initiated before the date of entry into force of this Order, which also last after the entry into force of this Order, the financial, energy and nutritional values of food supplements and food supplements, as determined in accordance with Decree No. 266 / 1999 Coll., as effective before the date of entry into force of this Order, or Decree No. 287 / 2016 Coll., as effective before the date of entry into force of the Decree.
(5) The components of the military uniforms provided for in this Order, which were not secured to the soldier in the active reserve pursuant to Decree No. 266 / 1999 Coll., as effective before the date of entry into force of this Order, or Order No. 287 / 2016 Coll., as effective before the date of entry into force of the Decree, will be issued to the soldier in the active reserve no later than 31 December 2026.
Repeal
They shall be deleted:
1. Decree of the Ministry of Defence No. 266 / 1999 Coll., on the method of providing free catering, equipment and transportation facilities and on the provision of accommodation for professional soldiers, reserve soldiers in service and active reserve soldiers.
2. Decree No. 456 / 2002 Coll., amending Decree No. 266 / 1999 Coll., on the method of providing free food, equipment and transport facilities and on the provision of accommodation for professional soldiers.
3. Decree No. 69 / 2008 Coll., amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free catering, equipment and transport facilities and on the accommodation of professional soldiers, as amended by Decree No. 456 / 2002 Coll.
4. Decree No. 334 / 2008 Coll., amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free food, equipment and transport facilities and on the security of accommodation for professional soldiers, as amended.
5. Decree No. 290 / 2010 Coll., amending Decree No. 266 / 1999 of the Ministry of Defence Coll., on the method of providing free meals, equipment and transport equipment and on the accommodation of professional soldiers, as amended.
