of 27 June 2023
on therapeutic programmes for drivers
The Ministry of Transport provides, pursuant to Article 137 (2) of Act No. 361 / 2000 Coll., on road traffic and on amendments to certain laws (Road Traffic Act), as amended by Act No. 478 / 2001 Coll., Act No. 53 / 2004 Coll., Act No. 411 / 2005 Coll., Act No. 226 / 2006 Coll., Act No. 274 / 2008 Coll., Act No. 133 / 2011 Coll., Act No. 297 / 2011 Coll., Act No. 230 / 2014 Coll., Act No. 220 / 2014 Coll., Act No. 249 / 2014 Coll., Act No. 150 / 2021 Coll., Act No. 199 / 2017 Coll., Act No. 193 / 2018 Coll.
Subject matter
This decree regulates
(a) details of the content, implementation and number of participants in the therapeutic programme;
(b) the amount of remuneration the payment of which is a condition of participation in a therapeutic programme;
(c) the amount of the flat-rate amount of compensation for the costs to the lecturer and the details of its provision;
(d) details of the content and conduct of the qualification course for teachers and examinations;
(e) the scope and content of continuous teacher education;
(f) requirements for accredited psychotherapeutic training; and
(g) a model certificate of completion of the therapeutic programme.
Details of the therapeutic programme content
The content of the therapeutic programme is
(a) analysis of the infringement committed by participants in the therapeutic programme, the circumstances in which the infringement was committed and its effects;
(b) an analysis of the serious road traffic infringement, including the infringement for which the driving authorisation is most often lost;
(c) approximation of the effects of alcohol and other addictive substances on the driving ability of participants in therapeutic programmes;
(d) training for the management of emotionally tense driving situations;
(e) raising awareness of the needs and attitudes of other road users in road traffic;
(f) analysis and prevention of risk actions by road users;
(g) the repetition of road users' obligations and the consequences of non-compliance;
(h) the interpretation of road traffic rules and other road safety issues; and
(i) the adoption of possible personal strategies to improve the safety of road users of the therapeutic programme.
Implementation of the therapeutic programme
(1) Within the framework of the therapeutic programme, the instructor focuses on:
(a) in the first part of the therapeutic programme to set the rules of the group of participants in the therapeutic programme,
(b) in the second part of the therapeutic programme for the recap of the infringement committed by the participants in the therapeutic programme and the circumstances in which the infringement was committed and the general analysis of the serious infringement in transport;
(c) in the third part of the therapeutic programme to analyse general attitudes towards the consumption of alcohol and other addictive substances, the effects of their use on motor vehicle driving, road traffic rules and driving safety;
(d) in the fourth part of the therapeutic programme for the analysis of cross-cutting topics selected by the instructor according to the needs of participants in the therapeutic programme; and
(e) in the fifth part of the therapeutic programme, for risk behavioural prevention instruments, for road users' obligations and for the creation of a personal strategy, which includes the setting of an individual objective, key steps towards meeting the objective, defining supporting and risk factors and summarising the sources of motivation of individual participants in the therapeutic programme.
(2) In running a therapeutic program, the instructor uses group therapy and education techniques using discussion and feedback. The teacher shall decide on the use of specific techniques and procedures, taking into account the specific needs of participants in the therapeutic programme.
(3) The next part of the therapeutic programme may take place at least 1 week and no later than 3 weeks after the previous part.
(4) After each part of the therapeutic programme, the tutor confirms the participation or non-participation of the participant in the information web-portal.
Number of participants in the therapeutic programme
A therapeutic programme shall be held for at least 3 and not more than 12 participants.
Amount of remuneration for participation in the therapeutic programme
The amount of payment for participation in the therapeutic programme is CZK 11 000 without value added tax.
Flat-rate amount of compensation for teachers and details of their provision
(1) The standard amount of compensation for the costs of 1 participant in the therapeutic programme is CZK 7 750 without value added tax.
(2) A summary of the lump sum amounts for all participants in the therapeutic programme will be paid by the Methodic Centre to the instructor if the tutor has carried out all parts of the therapeutic programme. If only a part of the therapeutic programme has been implemented by the instructor, the Methodic Centre shall provide him with a part of the sum of the lump sums corresponding to the part of the therapeutic programme undertaken.
(3) The Methodic Centre will pay the instructor a lump sum after the last part of the therapeutic programme.
Details of the content of the qualification course for teachers
The content of the qualification course for teachers is
(a) information on the concept of the therapeutic programme and its theoretical basis;
(b) familiarisation with the structure of the therapeutic programme methodology published by the Methodology Centre and with the functioning of the information web portal;
(c) study of the methodology of the therapeutic programme published by the Methodology Centre and road traffic legislation;
(d) studying road traffic rules and driving safety, taking into account the most important causes of road accidents, disruptive effects in driving a motor vehicle, the use of alcohol and other addictive substances and their impact on driving and other manifestations of the risk behaviour of road users; and
(e) the preparation of its own management plan for therapeutic programmes, the selection of techniques and activities within individual parts of the therapeutic programme.
Implementation of the teacher qualification course
(1) The teacher qualification course consists of a theoretical and practical part.
(2) In the theoretical part, its participants focus on topics in the areas provided for in § 7.
(3) In the practical part, its participants will take a demonstration of the individual parts of the therapeutic programme and focus on training to conduct therapeutic programmes.
(4) The Methodic Centre will provide technical materials to study the qualification course.
Test within the teacher qualification course
(1) The teacher qualification course is completed by an examination involving the theoretical part and the practical part.
(2) The theoretical part of the test verifies knowledge in the areas referred to in Section 7.
(3) The practical part of the test verifies the ability to solve model problems in the management of therapeutic programmes. Part of the verification of practical knowledge is the surrender of an independently prepared concept of an individual management plan for therapeutic programmes including a timetable and inventory of planned techniques and activities.
(4) As part of the assessment of the practical part, the examiners shall in particular assess:
(a) the suitability of the chosen therapeutic procedure;
(b) presentation and communication skills of the tested;
(c) the suitability of the response to the investigator's initiatives; and
(d) the factual accuracy of the argument of the tested party.
Performance of the test
(1) The theoretical part of the test is a written test containing 45 questions. The time limit for its preparation is 60 minutes. In order to pass the test successfully, the tested shall answer at least 70% of the questions correctly. When tested in this part of the test is assessed by the "failed 'degree, it does not consist of a practical part of the test.
(2) The practical part of the test is composed of each tested individually before a panel composed of 3 examiners. The time limit for the practical part is 90 minutes.
(3) The theoretical part and the practical part of the test are carried out on one day.
(4) The result of each part of the test shall be assessed by the degree "benefit 'or" benefit'.
(5) The test shall be initiated by the theoretical part of the test. When tested in this part of the test is assessed by the "failed 'degree, it does not consist of a practical part of the test. In the case where the test has been evaluated as" not beneficial' for the practical part of the test, only this part shall be repeated.
(6) After completion of the qualification course for teachers, they will receive the test certificate.
Scope and content of continuous teacher education
(1) The scope of continuous teacher education is 8 hours per year. Teaching takes place within one day.
(2) The Methodology Centre focuses on the current needs of the lecturer and, in particular, on continuous training.
(a) the lectors are familiar with the innovations in the therapeutic programme methodology published by the Methodology Centre and the updated management procedures for the therapeutic programmes; and
(b) analyse the specific problems experienced by teachers in the conduct of therapeutic programmes.
Requirements for accredited psychotherapeutic training
Accredited psychotherapeutic training is a psychotherapy training programme approved by the Institute of Postgraduate Education in Health, of a range of at least 370 hours.
Model certificate
The model of certificate of completion of the therapeutic programme is set out in the annex to this decree.
Efficacy
This Decree shall take effect on 1 July 2023, with the exception of the provisions of Sections 2 to 6, Sections 11 and 13, which shall take effect on 1 April 2024.
