DECLARATION
of 18 September 2018
amending Decree No 341 / 2014 Coll., on the approval of technical competence and on technical conditions for the operation of road vehicles, as amended by Decree No 235 / 2017 Coll.
The Ministry of Transport provides pursuant to § 91 (1) of Act No. 56 / 2001 Coll., on the conditions of the operation of vehicles on the road and amending Act No. 168 / 1999 Coll., on the insurance of liability for damage caused by the operation of the vehicle and on the amendment of certain related laws (Act on the insurance of liability from the operation of the vehicle), as amended by Act No. 307 / 1999 Coll., as amended by Act No. 239 / 2013 Coll., Act No. 63 / 2017 Coll. and Act No. 193 / 2018 Coll.:
Regulation No 341 / 2014 Coll., on the approval of technical competence and on technical conditions for the operation of road vehicles, as amended by Decree No 235 / 2017 Coll., is amended as follows:
1. Paragraph 29 (5) reads:
"(5) In the case of a rebuilding of the vehicle, including subsequent rebuilding, at least one original substantial part of the vehicle's mechanism or structure shall remain. ';
(2) Paragraph 30 shall be deleted, including the title.
3. Parts nine and ten shall be deleted, including the headings and footnotes 2.
4. Annex 1 shall read as follows:

6. Point 7 of Annex 3 reads as follows:
'7. For vehicles with a tachograph record, the tachograph shall be verified at least once every 2 years by an authorised metrology centre registered by the Ministry and sealed, including its propulsion. ';
7. In Annex 10, points 7 and 8 are added:
'7. Within the scope of the individual approval of the technical competence of a trailer of category O, a maximum design speed of not more than 80 km.h.1 may be determined. The higher maximum design speed of the vehicle may be determined only on the basis of a report issued by the technical service which includes the assessment of the vehicle's driving characteristics and stability verification, but not more than 130 km.h-1 for vehicles of category O1, 100 km.h-1 for vehicles of category O2 or 90 km.h-1 for vehicles of category O3 or O4.
8. Trailers cannot be approved for the carriage of persons. '
8. In Annex 12, Part B, including footnote 5, reads:
"(B) Mandatory fitting of vehicles
Replacement wheel and accessories needed to replace it
1. The spare wheel and accessories necessary for its replacement shall be understood as:
(a) a spare wheel, i.e. a tyre rim which is sufficiently fixed in the holder, ensuring that the force when the wheel is taken from the holder or inserted into the holder does not exceed 490 N; in the case where more than one wheel size is used on the vehicle, the spare wheel shall be applicable for all such dimensions or the vehicle shall be equipped with spare wheels for all dimensions;
(b) the wheel nuts or bolts of the vehicle; and
(c) a lift lift of a load capacity equal to or greater than the maximum technically permissible axle load of the vehicle or combination, or equivalent to the mass of the lift part of the vehicle from the maximum technically permissible mass of the vehicle when lifting this part in a manner specified by the manufacturer for the use of the lift.
2. The spare wheel and accessories necessary for its replacement shall be fitted with a vehicle of category M, N, O or R, except:
(a) vehicles fitted with all wheels with tyres of a special design allowing for an emergency run after a defect with an indication of the defect in either tyre;
(b) vehicles equipped with means for undismantled repair of the damaged tyre to allow emergency milking;
(c) vehicles with an appropriate contractual relationship to ensure repair of the damaged tyre continuously throughout the Czech Republic;
(d) an urban bus, an intervention fire truck, a municipal vehicle operating in a restricted area within the operational scope of its operator's service services, a trailer of category O1 or R1, a fire trailer or a category R trailer operating in a restricted area within the operational scope of its operator's service services; or
(e) vehicles in a combination, provided that the replacement wheel of the same size and design and the accessories necessary to replace it are fitted with another vehicle in that combination.

2. An L-category motor vehicle shall be equipped with a motor pharmacy, except for moped or motorcycle.
3. A motor vehicle shall be equipped with an auto-pharmacy, except for a category L vehicle, a pedestrian tractor with a trailer or a motor trolley,
(a) a vehicle for mass transport of persons with a occupancy capacity of more than 80 passengers in size III or two car pharmacies in size II; in the case of urban public transport of persons, a single vehicle first aid kit in size II is sufficient;
(b) a public passenger transport vehicle with a occupancy capacity of between 9 and 80 passengers, including in size II; and
(c) another motor vehicle with at least four wheels in size I.
4. A fire-fighting motor vehicle or an ambulance shall be equipped with the appropriate type of medical kit provided for by other legislation.
5. The contents of the medicine cabinet are stored in a separate case. The contents of the medicine cabinet must be intact, visually in order to show no signs of contamination or other deterioration. The dispenser is stored in the vehicle in such a space that direct sunlight cannot hit it. The storage space for the first-aid kit must be dry and clean and easily accessible. In a mass passenger transport vehicle, the first-aid kit shall be placed in a marked and accessible place in the passenger compartment.
Warning triangle
A warning triangle approved under ECE Regulation No 27 shall be fitted with a motor vehicle with the exception of a category L or Z vehicle, a pedestrian tractor with a trailer and a vehicle of a total width of less than 1 m.
Fire extinguisher
1. Fire extinguisher means a fire extinguisher with an adequate extinguishing capability according to the relevant technical Regulation (5). The extinguisher shall have an assessment of the conformity of the product authorised by the person (7).
2. The fire extinguisher shall be equipped with a vehicle of category M2, M3 or an ambulance,
(a) a vehicle of category M2 or M3 having a maximum of 22 seats for the carriage of persons, other than the driver's seat, by one or more fire extinguishers with a minimum extinguishing capacity of 21 A or 113 B;
(b) another vehicle of category M2 or M3 with one or more fire extinguishers with a minimum extinguishing capacity of 43 A or 183 B or a fire extinguisher in accordance with ECE Regulation No 107 or an automatic fire extinguishing system combined with at least one fire extinguisher 21 A or 113 B located close to the driver's place; and
(c) an ambulance vehicle with a fire extinguisher capable of 34 B.
3. The fire extinguisher shall be mounted in a position for position in a vertical or horizontal direction in order to reliably withstand the acceleration of at least 6 g in the direction of the frontal impact of the vehicle and shall be placed in a clearly visible and easily accessible position, one being installed in the immediate vicinity of the driver of the vehicle.

9. In Annex No 12, in point 3 of Part D, the word "reports' is replaced by" administrations'.
10. In Annex No 12, in Part E, points 1 (b) and (c), the words "Paragraph 37 to 39 'are replaced by the words" in another legislation'.
11. In Annex No 12, in Part E, point 7, the words "one pair of additional special warning lamps with an intermittent blue-coloured light flow facing the sides in front of the vehicle 'are inserted after the words" rearward'.
12. In Annex No 12, in Part E, the following point 12 is added:
'12. The requirements for special warning devices emitting blue colour light shall also apply to special warning devices emitting blue and red colour light. Special warning devices emitting light of blue and red shall have a ratio between red and blue of 1: 1, this requirement also applies to additional special warning lamps emitting the intermittent light flow. A combination of special warning devices emitting blue light with additional special warning lamps emitting cut-off blue and red light, while maintaining the ratio of blue and red to these lamps in a 1: 1 ratio, is also permitted. '
Efficacy
This Decision shall enter into force on 1 October 2018.
