DECLARATION
of 17 September 2014
amending Decree No. 415 / 2006 Coll., laying down the technical conditions and procedure for the acquisition and further processing of biometric data contained in the travel document data medium, as amended
The Ministry of Interior provides, pursuant to Article 61a (3) of Act No. 325 / 1999 Coll., on Asylum, as amended by Act No. 136 / 2006 Coll., and after consulting the Ministry of Foreign Affairs, pursuant to § 182 (1) (d) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and on the amendment of certain laws, as amended by Act No. 136 / 2006 Coll. and Act No. 379 / 2007 Coll., and under § 20 (9) of Act No. 329 / 1999 Coll., on Travel Documents, as amended by Act No. 136 / 2006 Coll.
Decree No. 415 / 2006 Coll., laying down the technical conditions and procedure for the acquisition and further processing of biometric data contained in the travel document data medium, as amended by Decree No. 75 / 2009 Coll. and Decree No. 83 / 2011 Coll., is amended as follows:
1. In Paragraph 3a (1), the sentence after the third sentence is inserted: "In the event that none of the fingerprints of the right hand reaches the required quality, a fingerprint shall be selected which shall have the best score for the fingerprint of a lower quality."
2. footnote 8 shall read:
"(8) Article 2 (c) and Article 5 (2) of Council Regulation (EC) No 2252 / 2004, as amended by Regulation (EC) No 444 / 2009 of the European Parliament and of the Council.";
3. In Article 3a (1), the word "fourth 'is replaced by" fifth';
4. In Article 3a (2) and (3), the words "of the required quality 'are deleted.
5. In Section 3a, the words "including fingerprint quality 'shall be added at the end of the text of paragraph 4.
Efficacy
This Decree shall enter into force on 1 January 2015.
