GOVERNMENT REGULATION
of 26 June 2024
amending Government Regulation No 589 / 2006 Coll., providing for a derogation from the working time and rest periods of workers in transport, as amended, and Government Regulation No 182 / 2007 Coll., on the derogation from the working time and rest periods of members of the fire brigade
The Government orders pursuant to § 100 of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 362 / 2007 Coll.:
Amendment of the Government Regulation providing for a derogation from working time and rest periods for transport workers
Government Regulation No. 589 / 2006 Coll., providing for a derogation from the working and rest periods of workers in transport, as amended by Government Regulation No. 353 / 2008 Coll., Government Regulation No. 337 / 2016 Coll. and Government Regulation No. 342 / 2021 Coll., is amended as follows:
1. In Article 3 (b), the words "rest between shifts and 'are replaced by the words" daily rest and continuous rest'.
2. In § 7, 11, 14, 15b, 17, 21 and 23 the title reads: "Continuous daily rest."
3. In § 7, § 11 (1), § 11 (2), first sentence, § 14 (1), § 15b (1) of the introductory part of the provision, § 17 (1), § 21 (1) and § 23 (1) and (3), the word "daily" shall be inserted after the word "continuous."
4. In the first sentence of Paragraph 7, paragraphs 11 (2) and 14 (2), the words "between two shifts' are deleted.
5. In the second sentence of Article 7 and Article 23 (3), the words "between shifts' are deleted.
6. In the first sentence of Paragraph 9a, the words "90% of the hourly rate of the lowest wage guaranteed set for the fifth working group 28) 'are replaced by the words" 1.25 times the hourly minimum wage 28)'.
Footnote 28 reads as follows:
"28) § 111 (4) of the Labour Code. '
7. in § 11 (1), § 14 (1), § 15b (1) of the introductory part of the provision, § 17 (1), § 21 (1) and § 23 (1), the words "schedule working hours" shall be replaced by the words "provide."
8. in Articles 11 (1), 21 (1) and 23 (1), the words "so as to be deleted between the end of one shift and the beginning of the next shift."
9. In the second sentence of Article 11 (2) and the second sentence of Article 14 (2), the word "daily 'shall be inserted after the word" Continuous'.
10. in Articles 14 (1) and 17 (1), the words "in such a way that a staff member" shall be replaced by "staff member" and the words "between the end of one shift and the beginning of the following shift" shall be deleted;
11. in Article 15b (1) of the introductory part of the provision, the word "staff" shall be replaced by "staff" and the words "in such a way that an employee of international rail transport has between the end of one shift and the beginning of the following shift" shall be deleted;
12. In the first sentence of Paragraph 19, the words "rest between two shifts' are replaced by the words" daily rest '.
13. in Article 21 (1), the words "the staff member" shall be replaced by "the staff member."
14. in Paragraph 23 (1), the word "member" is replaced by the word "member."
Amendment of the Government Decree on the derogating adjustment of working time and rest periods of members of the fire brigade
In Section 3 of Decree-Law No 182 / 2007 Coll., on the derogation from the organisation of working time and rest periods of members of the fire brigade of an undertaking, the words "rest between the end of one shift and the beginning of the following shift 'are replaced by the words" daily rest'.
EFFECTIVE
This Regulation shall take effect on 1 July 2024.
