DECLARATION
of 10 June 2010
amending Decree No. 136 / 2004 Coll., laying down details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended
The Ministry of Agriculture provides pursuant to Article 33 of Act No. 154 / 2000 Coll., on the breeding, breeding and registration of livestock and on the amendment of certain related laws (Breeding Act), as amended by Act No. 282 / 2003 Coll. and Act No. 130 / 2006 Coll., for implementation of Sections 22 (13) and 23c (4) of the Breeding Act:
Decree No. 136 / 2004 Coll., laying down the details of the marking of animals and their registration and registration of holdings and persons provided for by the Breeding Act, as amended by Decree No. 199 / 2007 Coll. and Decree No. 213 / 2009 Coll., are hereby amended as follows:
1. In Article 1 (1), the words "in accordance with the law of the European Communities (1) 'are replaced by the words" it implements the relevant provisions of the European Union26'; it also follows directly applicable European Union27) and '.
footnotes 26 and 27 read:

Council Regulation (EC) No 21 / 2004 of 17 December 2003 establishing a system for the identification and registration of ovine and caprine animals and amending Regulation (EC) No 1782 / 2003 and Directives 92 / 102 / EEC and 64 / 432 / EEC, as amended. Commission Regulation (EC) No 911 / 2004 of 29 April 2004 implementing Regulation (EC) No 1760 / 2000 of the European Parliament and of the Council as regards eartags, passports and farm registers, as amended. ';
footnote 1 is deleted.
2. in Article 4 (h), the words "for goats only" shall be deleted;
3. Paragraph 5 (4) is deleted.
4. in Article 9 (6), "paragraphs 4 and 5 'are replaced by" paragraphs 5 and 6';
5. In Paragraph 11 (1), the words "type A plastic ear tags' shall be inserted after the words" both parts'.
6. Paragraph 11 (7) reads as follows:
"(7) The model of the part of the plastic ear tag type A and variant B and the model of the part of the duplicate of the plastic ear tag type A and variant B are given in Annex 2. '
7. Paragraph 22, including the title and footnotes No 28 to 30, reads:
Means and terms of labelling of ovine and caprine animals
(1) Each ovine or caprine animal must be identified by two means of identification no later than 6 months after birth, but before leaving the holding where it was born in accordance with the directly applicable European Union legislation on the establishment of a system and register of ovine and caprine animals (28).
(2) Animals intended for trade within the European Union must be marked with an electronic identifier in the form of a bachor bolus transponder or an electronic ear tag in combination with a plastic eartag or a bell tag, in accordance with the European Union Regulation on the establishment of a system and register of ovine and caprine animals (28).
(3) Animals not intended for trade within the European Union must be marked in accordance with the directly applicable European Union legislation establishing a system and registration of ovine and caprine animals (29)
(a) a plastic eartag in combination with a second plastic eartag or tick mark or an electronic identifier in the form of an electronic tag on a wrench; or
(b) the means of identification referred to in paragraph 2.
(4) Lambs or kids intended for slaughter up to 12 months of age which are not intended to be moved to another Member State or for export to third countries may, by way of derogation from paragraph 1, be marked with at least one plastic eartag which has been provided for that method by the designated person in accordance with the directly applicable European Union legislation on the establishment of a system and register of ovine and caprine animals (30).
(5) Sheep and goats without earlobes or with very short earlobes which are not intended for trade within the European Union are identified on the lower coat of the uncultivated part of the tail by a tattoo which contains the identification number of the animal without the alphabetical indication of the country of origin "CZ" and without the last three digits.
(6) Sheep and goats which cannot be marked with an ear tag due to damage, inflammation or deformation of the ear bolts and which are not intended for trade within the European Union shall be marked in such a way as to avoid confusion with other animals. This means of identification shall be recorded immediately in the stable register.
(7) Plastic ear tags are suspended within one third of the root of the earache between the skin eyelashes of the bolus.

8. The following Section 23a is inserted after Section 23:
Branches used for the labelling of ovine and caprine animals and their model
(1) For the labelling of ovine and caprine animals, marks on the worm with alphanumeric characters of at least 4 mm shall be used.
(2) The mark shall contain:
(a) the identification number of the animal; and
(b) the code of the competent authority.
(3) The mark on the worm may also include the breeder's records if the legibility of the data referred to in paragraph 2 is not infringed.
(4) The height of the alphanumeric characters on the duplicate of the mark on the buckle shall be at least 4 mm.
(5) The model of the mark on the wristband and the duplicate mark on the wristband are given in Annex 4. '
9. Paragraph 24 (3) is deleted.
Paragraph 4 shall become paragraph 3.
10. in Article 24 (3), the last sentence shall be deleted;
11. in the third sentence of Article 32 (1), the words "and in the case of a register of poultry on the holding" shall be inserted after the words "holding."
12. in Article 35 (3), the words "paragraph 1" shall be deleted;
13. in Article 36 (4), the words "In the case referred to in Articles 12 (1) and 24 (3)" shall be replaced by the words "In the case of animals moved from other Member States or imported from third countries directly to a slaughterhouse."
14. In Annex 2, points 3 to 5 read:

Note:
The identification number of the animal on the plastic ear tag shall be given in the following order: "CZ 019236 921."

The identification number of the animal on the duplicate of the plastic ear tags of tures born in the Czech Republic is always given in the following order: "CZ 019236 921."

Note:

Transitional provision
In the period up to the date of entry into force of this Order, the seals shall be deemed to have been marked according to Decree No. 136 / 2004 Coll., as effective until the date of entry into force of this Order.
Efficacy
This Decree shall take effect on 1 July 2010.
