amending Decree No. 441 / 2013 Coll., to implement the law on the valuation of assets (Valuation Order)
According to Article 33 (1) of Act No. 151 / 1997 Coll., on the valuation of assets and on the amendment of certain laws, as amended by Act No. 303 / 2013 Coll.:
Čl. I
Decree No. 441 / 2013 Coll., implementing the law on the valuation of assets (Valuation Order), is amended as follows:
1. Paragraph 2 (3) reads as follows:
"(3) Land which does not meet the conditions laid down in Article 9 (2) of the Act cannot be valued on the basis of the price map of the building plot."
2. In Section 3 of the Introductory Part of the provision, the words "registered in the cadastral of real estate in the type of land built and the courtyard or the land already used for that purpose 'are replaced by the words" on the territory of the municipality'.

„§ 4
(1) The basic price of an adjusted building plot registered in the cadastral of real estate in the type of land built and courtyard, other than the land referred to in paragraph 5, or the land already used for that purpose and the land in the single functional unit shall be determined with it, unless otherwise specified, according to the formula

(2) The basic price of an unbuilt land, or part of it, to be built up by a regulatory plan, a decision on the location of the construction site, a territorial agreement, a declaration to the construction office, a building permit or a public contract, other than those referred to in paragraphs 3 to 6, is the price determined in accordance with paragraph 1, multiplied by a coefficient of 0,80.
(3) The basic price of an adjusted building plot registered in the cadastral of real estate in the type of land other area with the use of the land of the railway, motorway, road and other roads including their parts, and public space which is not part of the infrastructure, as well as the land for those purposes already used or only determined by a decision on the location of the construction or regulatory plan, shall be the price determined according to the formula.

Pi.... the value of the quality band of the ith character for adjusting the basic prices of the roads listed in Table 5 of Annex 3 to this Decree.
For public infrastructure with reinforced surface and rail,
ZC × 0,15 < ZCU < ZC × 0,75.
(4) The restriction referred to in paragraph 3 shall not apply to infrastructure which is accessible or accessible to the public on a restricted basis, or where it is jointly used with immovable property used for business, including parking and service spaces.
(5) The basic price of an unbuilt land intended to be built by a landfill by a regulatory plan, a decision on the location of the building, a territorial agreement, a notice of the building office, a building permit or a public contract or a built-up plot already in use is the price determined according to the formula

(6) The basic price of an unbuilt plot intended to be built by a regulatory plan, a decision on the location of the construction, a territorial agreement, a declaration to the construction office and a public contract of the land of the dykes, a journey and other construction components of water works valued in accordance with § 17 or a built-up plot already used, excluding ponds and small water tanks or parts of the land, shall be the price determined according to the formula.

k... the coefficient for adjusting the base price of the land shall be:
0,85.. for land already built by water,
0,60. For land not built-in but intended to be built by building a water works according to the regulatory plan, decision on the location of the construction or the territorial agreement, except ponds and small water tanks, or part thereof, which will be actually built by the construction of the water works; the land, or part thereof, which is not actually built up by water, shall be valued as a water area under Paragraph 8.
(7) The price determined according to paragraphs 1 to 5 is at least CZK 30 per m2, according to paragraph 6 is at least CZK 20 per m2 for built-in land, for unbuilt land CZK 10 per m2. "
4. Paragraph 5 (1) reads as follows:
"(1) Land valued in accordance with Sections 4 (3) and 4 (5), 8 and 9 (5) and (6) shall be valued as if they did not constitute a single functional unit. '
5. in Article 5 (3), the words "paragraphs 1, 2, 3, 5, 6 and 4 respectively" shall be replaced by the words "in their order."
6. Paragraph 5 (6) reads as follows:
"(6) Where the parcels referred to in Article 3 are valued in a single functional unit together with the land included in the building valued in accordance with Sections 13, 14, 35 and 36, where applicable with their accessories, and the sum of their measurements is greater than 1 000 m2, the basic price of the treated land shall be multiplied by a reduction coefficient calculated according to the formula
R = 200 + 0,8 × dost ri = 1nvpi h = 1nvpi,

in... the area of the ith parcel in a single functional unit with construction in m2,
n..... total number of parcels in a single functional unit,
200 and 0.8... constants. "
7. Paragraph 9 (2) reads as follows:
"(2) The basic price of an unbuilt land for which a decision has been taken to change the use of land for landfills, storage, weaning and handling areas, natural sports grounds, recreational areas or land so used shall be determined according to the formula:

8. In Article 9, the following paragraph 3 is inserted after paragraph 2:
"(3) The basic price of an unbuilt land for which a decision has been taken to change the use of land for mining and similar activities or related work on the ground shall be determined according to the formula:
ZCU = ZC × IP × k,
where
ZCU.... basic price of the adjusted plot in the defined area in CZK per m2,
ZC....... basic price of the land in CZK per m2, determined according to § 3.
Where a defined area for surface mining affects the territory of several municipalities, it shall be used to calculate the lowest of the basic prices of municipalities in the defined area; where the basic price thus determined is less than half of the municipality's highest basic price in the defined area, half of the municipality's highest basic price in the defined area shall be used for the calculation.
IP....... the location index of the municipality to be determined according to the formula

Pi.... value of the quality band of the ith position index index given in Table 4 of Annex 3 to this Decree according to column f,
i....... the serial number of the position index character,
n... number of position index characters.
In the case where a defined area for surface mining affects the territory of several municipalities, the position index shall be determined in relation to the municipality in whose cadastral territory the land is located.
k..... the coefficient for adjusting the base price of the land determined by the decision to change the use of the land for the use of the land for mining and similar activities or related works on the ground, in particular for the setting-up of quarries, sandquarries, drains and drains, shall be:
in municipalities with a population of over 250 000, 0,40,
in municipalities with a population of between 5 000 and 250 000 0,50,
in other municipalities 0,60.
The basic price thus adjusted shall be at least CZK 30 per m2. "
Paragraphs 3 to 6 shall be renumbered paragraphs 4 to 7.
9. in Article 9 (4), the words "paragraph 1 'shall be inserted after the words" determined pursuant to Article 4';
10. in Article 9 (6), "and 4" shall be replaced by "4 and 5";
11. in Article 9 (7), "5" is replaced by "6."
12. In Paragraph 18, at the end of the text of paragraph 2, the words "designated pursuant to Paragraph 10 'shall be added.
13. In Paragraph 21 (1), the word "discover 'is replaced by" determine' and the number "6 'is replaced by" 4'.
14. In Paragraph 21 (3), the words "in CZK" shall be inserted after the words "CB...... the price of the apartment or non-residential space."
15. in Paragraph 21 (3), the words "in m2, determined in accordance with Annex 1 to this Decree," shall be inserted after the words "PP...... floor area of the apartment or non-residential space."
16. In Section 21, at the end of paragraph 3, the words "in CZK per m2 'are added.
17. In Paragraph 24, the word "determination 'is replaced by" designation' and the word "volume 'is replaced by" price'.
18. In Article 24, the words "UNESCO monument 'are replaced by the words" World Heritage List Monument' and in Article 31 (6), the words "UNESCO Monuments' are replaced by the words" World Heritage List Monuments'.
19. in the last sentence of Paragraph 25 (1), the word "price" shall be inserted after the words "above."
20. In Paragraph 25 (2), the first sentence is replaced by the sentence "The unit, or part thereof, which arises or changes its size at the expense of the common parts of the house under the construction contract, shall be regarded as being developed in terms of valuation."
21. In Paragraph 33, the words "where the cash value of the transaction for the rent can be determined separately from the commission provided for in the contract 'are added at the end of the text.
22. in Article 35 (1), "3, 6 and 7" is replaced by "2 and 5."
23. in Paragraph 36 (1), "3 and 4" is replaced by "2 and 3."
24. in Paragraph 38 (1), after the words "PP... floor area in m2," the words "designated in accordance with Annex 1 to this Decree," shall be inserted;
25. In Part Seven, the following Section 48a is inserted:
„§ 48a
Classification for the determination of the position index
(1) For the calculation of the position index, the values of the qualitative bands of the individual characters from column e to table 3 or table 4 of Annex 3, intended for land, shall be used.
(a) according to the type and purpose of the use of the main building situated on it or with which it is in a single functional unit, irrespective of whether the construction is part of the plot or a separate item, or part of the building law,
(b) belonging to the unit according to the type and purpose of use of the construction in which the unit is located;
(c) with several main structures not used together, according to the purpose of their use in the order of columns e, or f, g, i, h of table 3; if their purpose is to be used only in Table 4, then in the order of columns e, g, f, h, i; if some main buildings are part of the plot and at the same time some separate item or part of the right of construction, classification shall be carried out only according to the purpose of the use of the main structures which are part of it;
(d) or land in a single functional unit with several buildings which are used together according to the purpose of using the main structure, if it can be determined; if one purpose of use cannot be determined, the purpose of use shall be determined by analogy with (c) for all parcels in a single functional unit.
(2) The main construction is for valuation purposes a construction which is not intended to be used permanently with another construction within its economic purpose and determines the purpose of the land use.
(3) In the case of land not built up, which is intended to be built up by a territorial decision, a regulatory plan replacing a territorial decision, a public contract replacing a territorial decision or a territorial agreement, shall be followed in accordance with paragraph 1 according to the intended purpose of the use of the construction.
(4) For unbuilt land or land only with buildings which do not have the character of the main construction and cannot be measured in accordance with paragraph 3, the intended purpose of the use for which the land is designated in the zoning plan or the regulatory plan shall be based on the determination of the index, whether the construction is part of the plot or a separate item or part of the construction law. If the purpose of use cannot be clearly identified, the values of the qualitative bands of the individual characters from column e or f in Table 3 of Annex 3 shall be used.
(5) For construction which is
(a) the value of the position index determined for the parcel of which it is part shall always be used;
(b) by a separate item, or is part of the right of construction, and is the main construction, the values of the qualitative bands of the individual characters from column e to tables 3 or 4 of Annex 3 shall be used according to its type and purpose of use;
(c) a separate item, or part of a building right, and is used together with the main construction, the value of the position index determined for the main construction shall be used; if it is jointly used with several main buildings, classification shall be used according to the structure for which its use predominates.
(6) For construction where the purpose of use cannot be clearly determined, the values of the qualitative bands of the individual characters from column e up to Table 3 or Table 4, Annex 3 according to the prevailing purpose of use in the order of columns e, or f, g, i, h of Table 3 shall be used; if the parts of the construction used are only used for the purposes set out in Table 4, they shall be classified in the order of columns e, g, f, h, i. ';
26. in Annex No 1, point 4 (2) (a), the word "glazed" shall be inserted after the word "a."
27. In Annex 1, point 4 (3) (b), the word "multiplied 'shall be inserted after the word" logbooks'.
28. Annex 2 shall read as follows:
