DECLARATION
of 30 July 2019
amending certain regulations in the field of education
The Ministry of Education, Youth and Sports provides, pursuant to Sections 19 (b) and (h) and 161c (2) (c) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 82 / 2015 Coll. and Act No. 101 / 2017 Coll.:
Amendment to Decree No 14 / 2005 Coll.
Decree No. 14 / 2005 Coll., on pre-school education, as amended by Decree No. 43 / 2006 Coll., Decree No. 214 / 2012 Coll., Decree No. 197 / 2016 Coll., Decree No. 280 / 2016 Coll. and Decree No. 151 / 2018 Coll., are amended as follows:
1. In Paragraph 1d, the following paragraph 8 is inserted after paragraph 7:
"(8) For each class set up under Section 16 (9) of the Education Act or the school class established under Section 16 (9) of the Education Act, the PHmax established for the workplace is increased by 5 hours."
Paragraph 8 shall become paragraph 9.
2. In Paragraph 1d, the following paragraph 10 is added:
"(10) The maximum weekly number of hours of direct pedagogical activity provided next to a teacher by an assistant educator financed from the state budget shall be 36 hours per class set up under Section 16 (9) of the Education Act or the school class set up under Section 16 (9) of the Education Act, if there is an average duration of 8 hours or more. If the average period of operation is shorter than indicated in the first sentence, the maximum weekly number of hours of direct pedagogical activity shall be reduced proportionally. Paragraph 4 shall apply mutatis mutandis. ';
3. Paragraph 2 (4) is deleted.
Paragraphs 5 to 9 shall be renumbered paragraphs 4 to 8.
4. in paragraphs 7 and 8 of 2, "6 and 7" shall be replaced by "5 and 6";
5. In Annex 2, "150 'is replaced by" 155'.
Amendment to Decree No 48 / 2005 Coll.
The following Section 7c is inserted after Section 7b of Decree No. 48 / 2005 Coll., on basic education and certain formalities for compulsory education, as amended by Decree No. 140 / 2018 Coll., including the title:
Maximum number of hours of teaching with a teacher's assistant in the grade of primary school, special financed by the state budget
The maximum weekly number of hours of teaching provided by the teaching assistant, financed from the state budget in the grade of the primary school special, is 20 hours for the number of children in class 4 or more. "
Amendment to Decree No 74 / 2005 Coll.
In Section 10 of Decree No. 74 / 2005 Coll., on Home Education, as amended by Decree No. 109 / 2011 Coll., Decree No. 197 / 2016 Coll. and Decree No. 163 / 2018 Coll., paragraph 12 is added:
"(12) The maximum weekly number of hours of direct pedagogical activity provided by an assistant educator co-financed by the State Budget shall be 15 hours per department referred to in paragraph 7; paragraph 11 shall apply mutatis mutandis. ';
Amendment to Decree No 27 / 2016 Coll.
Annex No 1 to Decree No. 27 / 2016 Coll., on the education of pupils with special educational needs and gifted pupils, as amended by Decree No. 270 / 2017 Coll., Decree No. 416 / 2017 Coll. and Decree No. 244 / 2018 Coll., is amended as follows:
1. In Section 1, point 1.7 is replaced by the following:
"1.7. In the school, class, department or study group set up under Section 16 (9) of the Act, support measures may not be provided to ensure pedagogical intervention, teaching of subjects specifically for pedagogical care, the use of a special textbook, special teaching aids or compensation aids, except in the case where this textbook or aid is intended for a pupil with a different type of disadvantage than that for which the school, class, department or study group is established. No support measure V. 3.2" Number of pupils in class. "
2. in Section 1, the following point 1.8 is inserted after point 1.7:
"1.8. In a school or a classroom set up pursuant to § 16 (9) of the Act in the field of education, primary school, special school, one-year and practical school of two years, in a nursery school established under § 16 (9) of the Act or in a classroom established under § 16 (9) of the Act in a nursery school, in a school establishment for the exercise of constitutional education or protection education, in the grade of the primary school and in the department of the school cooperative consisting only of the participants referred to in § 16 (9) of the Act, no further support measures may be granted for the use of an assistant educator. '
Points 1.8. and 1.9. shall be renumbered 1.9. and 1.10.
EFFECTIVE
This Regulation shall enter into force on 1 September 2019, with the exception of the provisions of Article IV which take effect on 1 January 2020 and the provisions of Article IV thereof. This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
