DECLARATION
of 8 April 2004
amending Decree No 89 / 2002 Coll., on the protection against the introduction of harmful organisms on importation, transit and export of plants, plant products and other objects and against their spread within the Czech Republic and on systematic plant health control, as amended
The Ministry of Agriculture, after consulting the Ministry of Transport, the Ministry of Finance and the Ministry of Industry and Trade, provides pursuant to Article 45 (1) of Act No. 147 / 1996 Coll., on Phytosanitary Care and Amendments to Certain Related Acts, as amended by Act No. 409 / 2000 Coll. and Act No. 314 / 2001 Coll., (hereinafter "the Act '):
Decree No. 89 / 2002 Coll., on the protection against the introduction of harmful organisms on the import, transit and export of plants, plant products and other objects and against their spread within the Czech Republic and on systematic plant health control, as amended by Decree No. 355 / 2003 Coll., is hereby amended as follows:
1. The introductory phrase, including footnote 1, reads: "The Ministry of Agriculture, after consulting the Ministry of Transport, the Ministry of Finance and the Ministry of Industry and Trade, provides, pursuant to Article 45 (1) of Act No. 147 / 1996 Coll., on Phytosanitary Care and Amendments to Certain Related Acts, as amended by Act No. 409 / 2000 Coll., Act No. 314 / 2001 Coll., (hereinafter" the Act ") and in accordance with the law of the European Community1)
1) Commission Directive 92 / 70 / EEC of 30 July 1992 laying down detailed rules for surveys carried out for the purpose of the recognition of protected zones in the Community. Commission Directive 92 / 90 / EEC of 3 November 1992 laying down the obligations to which producers and importers of plants, plant products or other objects are subject and laying down the details of their registration. Commission Directive 92 / 105 / EEC of 3 December 1992 establishing certain uniformity of plant passports used for the movement of certain plants, plant products or other objects within the Community and detailed procedures for the issue of such plant passports and the conditions and detailed procedures for their replacement. Commission Directive 93 / 50 / EEC of 24 June 1993 determining certain plants not listed in Part A of Annex V to Council Directive 77 / 93 / EEC whose producers or warehouses or dispatch centres in the production areas of those plants must be entered in an official register. Commission Directive 93 / 51 / EEC of 24 June 1993 laying down rules for the movement of certain plants, plant products and other objects through a protected zone and for the movement of such plants, plant products and other objects within the protected zone of origin. Commission Directive 94 / 3 / EC of 21 January 1994 establishing a procedure for the notification of the detention of a consignment or harmful organism originating in third countries and presenting an imminent plant health risk. Commission Directive 95 / 44 / EC of 26 July 1995 laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I to V to Council Directive 77 / 93 / EEC may be imported into or moved in the Community or certain protected zones of the Community for experimental or scientific purposes and work in the breeding of varieties. Commission Directive 97 / 46 / EC of 25 July 1997 amending Directive 95 / 44 / EC laying down the conditions under which certain harmful organisms, plants, plant products and other objects listed in Annexes I to V to Council Directive 77 / 93 / EEC may be imported into or moved within the Community for experimental or scientific purposes and for the breeding of varieties. Commission Directive 98 / 22 / EC of 15 October 1998 laying down minimum conditions for carrying out plant health checks on plants, plant products or other objects originating in third countries at inspection points other than those of destination in the Community. Council Directive 2000 / 29 / EC of 8 May 2000 on protective measures against the introduction into and the spread within the Community of organisms harmful to plants or plant products. Commission Directive 2002 / 36 / EC of 29 April 2002 amending certain Annexes to Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Council Directive 2002 / 89 / EC of 28 November 2002 amending Directive 2000 / 29 / EC on protective measures against the introduction into and the spread within the Community of organisms harmful to plants or plant products. Commission Directive 2003 / 22 / EC of 24 March 2003 amending certain Annexes to Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Commission Directive 2003 / 47 / EC of 6 June 2003 amending Annexes II, IV and V to Council Directive 2000 / 29 / EC on protective measures against the introduction into the Community of organisms harmful to plants or plant products and against their spread within the Community. Winsl. et al '.

2. Annex 3 shall read as follows:

Consignments originating in non-Member States of the European Union whose importers must be registered in an official register pursuant to Article 8 (3) of the Act and which their importers and carriers are required to submit for plant health control pursuant to Article 8 (2) of the Act and which must be accompanied by a phytosanitary certificate on entry into the Czech Republic
1. Plants, intended for cultivation, with the exception of seed, but including seeds of Cruciferae1), Graminae and Trifolium L., originating in Argentina, Australia, Bolivia, Chile, New Zealand and Uruguay, of the genus Triticum L., Secale spp. and Triticosecale Wittmak, originating in Afghanistan, India, Iraq, Mexico, Nepal, Pakistan, South Africa and USA, Capsicum L., Helianthus annuus L., Lycopersicon lycopersicum (L.) - cut flowers of Aster L., Eryngium L., Hypericum L., Lisianthus L., Rosa L. and Trachelium L., originating in non-European countries,

3) Mushroom plants (Prunus L.) in the wider concept include cherries and cherries (Cerasus Duhamel), peaches (Persica Mill.), apricots (Armeniaca Scop.), almonds (Amygdalus L.) and plums (Prunus L.) including plums, slugs, myrobalan and thorns.

Pallets and box pallets (CN- code ex 4415 20) need not be accompanied by a phytosanitary certificate if they meet the standards laid down for UICs and are appropriately marked.
Pallets and box pallets (CN code ex 4415 20) are also exempted from plant health control if they comply with the standards for "UIC pallets' and are marked as such
7. Earth and other growing media
7.1. Composed wholly or partly of soil or solid organic matter, such as parts of plants, humus including peat or bark, excluding pure peat
7.2. Soil and growing medium attached to or associated with plants, consisting wholly or partly of the material referred to in (a) or consisting partly of any solid inorganic matter, intended to maintain the vitality of plants originating in:
- Turkey,
- Belarus, Georgia, Moldova, Russia, Ukraine,
- non-European countries except Algeria, Egypt, Israel, Libya, Morocco and Tunisia.
