of 16 June 2023
on the state of emergency in electricity and the content of the emergency plan
The Ministry of Industry and Trade provides pursuant to § 98a paragraph 1 (e) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Performance of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 158 / 2009 Coll., Act No. 211 / 2011 Coll., Act No. 165 / 2012 Coll., Act No. 131 / 2015 Coll., Act No. 362 / 2021 Coll. and Act No. 176 / 2022 Coll.:
Subject matter
This Decree sets out the measures and procedures to be carried out in the prevention of an emergency, in the event of an emergency and in the removal of the consequences of an emergency, the means of declaring an emergency and the notification of an emergency and the procedures to limit the generation of electricity and the consumption of electricity, including a regulatory, switching and frequency plan and the content of emergency plans.
Limitation of electricity consumption and control of changes in electricity supply to the electricity system
(1) If the conditions of Paragraph 54 of the Energy Act or the directly applicable European Union1 are met) the electricity withdrawn from the electricity system may be reduced or the power supplied to the electricity system may be altered
(a) restrictions on the consumption of electricity withdrawn from the electricity system pursuant to a regulatory plan, the use of which and the content of which, including the way in which regulatory degrees are notified, announced and withdrawn, are set out in Annex 1 to this Regulation;
(b) by disconnecting their demand facilities by the transmission system operator or distribution system operator or by disconnecting parts of the electricity transmission or distribution facility to customers by disconnecting their demand facilities;
1. According to the off-set plan, the use and content of which are set out in Annex 2 to this Decree,
2. according to the frequency plan, the use, processing, issuing and updating of which are set out in Annex 3 to this Decree,
3. by the operational shutdown of parts of the transmission system or distribution system to the extent necessary to balance the power balance of the part of the electricity system concerned; or
(c) by changing the value of power supplied by the electricity producer to the electricity system in accordance with the instructions of the transmission system operator or distribution system operator.
(2) The restriction of the consumption of electricity in the territory where an emergency situation is imminent or for which an emergency situation has been declared is due to the application of the relevant stage of the regulatory plan, the cut-off plan, the operational shutdown of parts of the transmission or distribution system equipment or the automatic operation of frequency relays in accordance with the frequency plan, to the extent necessary to balance the power balance of the part of the electricity system concerned. The transmission system operator technical dispatching or distribution system operators technical dispatching shall apply these measures on the basis of an assessment of the situation; This restriction on electricity consumption does not apply to customers whose facilities are connected only to the foreign electricity system and which are subject only to the restrictions of that foreign electricity system.
(3) The restriction of electricity consumption under the regulatory plan shall not apply to the technological self-consumption of electricity for the production of electricity or the production and supply of heat.
(4) In situations where there is a risk of non-compliance with the reliability criteria in the electricity system, the TSO or the distribution system operator may issue a warning step that is part of the regulatory plan.
(1) The procedure and scope of the restriction on the consumption of electricity or the change in the power supplied in order to prevent or address an emergency situation shall be processed by the transmission system operator's technical dispatching system in cooperation with the technical dispatches of distribution system operators directly connected to the transmission system (hereinafter referred to as the regional distribution system). The process of distribution system operators not directly connected to the transmission system ("local distribution system ') is covered by Section 8.
(2) A plan to reduce the consumption of electricity by switching off selected appliances processed for the purposes of the regulatory plan is a separate part of the transmission programme of the mass remote control signal processed by regional distribution system operators.
(3) For the period from notification or publication of regulatory degrees to the appeal of regulatory degrees, except for the immediate threat to the life or health of persons, it is not possible to increase the electricity consumption of installations that have been shut down or have been in operation with limited electricity consumption.
(4) The activation plan prepared by the transmission system operator's technical dispatching system, in cooperation with the technical dispatches of the regional distribution system operators, shall set out the switching-off procedure and the power-off values for the disposal of major system or local failures in the electricity system. Article 8 applies to the local distribution system operators. The interruption of the supply of electricity shall be done by shutting down the selected parts of the transmission or distribution system.
(5) The frequency plan prepared by the transmission system operator's technical dispatching system and the technical dispatches of regional distribution system operators and electricity producers is a procedure for preventing and addressing an emergency associated with an unbalanced power balance in the electricity system and a simultaneous change in system frequency. The frequency plan sets out measures for the creation of island plants, the interruption of the supply of electricity to customers and the disconnection of electricity generation from the electricity system by the operation of frequency relays installed in power plants, transmission system, distribution system or customer demand points.
(1) The amount of power off, the selection of locations and the installation of frequency relays shall be determined by the transmission system operator and the regional distribution system operators in accordance with the directly applicable European Union Regulation (2). Article 8 applies to the local distribution system operators.
(2) By 30 September each year, regional distribution system operators shall transmit to the TSO updated power values for each regulatory and switching plan and frequency plan. Local distribution system operators shall transmit these data by 15 September each year to the distribution system operator to which their distribution system is connected. On the basis of these data, the transmission system operator's technical dispatching system, in cooperation with the technical dispatches of distribution system operators, is required to update its regulatory, switching and frequency plans.
Classification of customers in regulatory degrees
(1) In order to limit the consumption of electricity in the event of an emergency and in the event of an emergency, customers are to be classified in the regulatory stages according to the regulatory plan set out in Annex 1 to this Regulation.
(2) The classification of customers in regulatory stages 1 and 2 is carried out by the distribution system operator.
(3) The classification of customers in regulatory steps 3 to 7 is carried out by:
(a) a transmission system operator or distribution system operator pursuant to a transmission system service contract or a distribution system service contract; or
(b) an electricity trader or electricity producer under a contract for combined electricity supply services; the electricity trader or electricity producer shall transmit data to the operator of the relevant system to the extent and structure in accordance with another legislation3).
(4) The transmission or distribution system operator shall transmit information on the inclusion of the customer demand point in the relevant regulatory stage 3 to 7 and on the value of its security minima as set out in Annex 1 to this Regulation to the market operator information system in accordance with the procedure laid down in the regulation governing the electricity market rules and the market operator shall make this information available to the supplier and the clearing entity registered at the customer demand point.
Procedures and measures to prevent an emergency
(1) Restrictions on electricity consumption and change in electricity supply in the event of an emergency are implemented
(a) automatically in accordance with the frequency plan; or
(b) by the technical dispatcher of the relevant system operator,
1. according to regulatory steps 1 to 4,
2. according to the switch-off plan,
3. the operational shutdown of parts of the transmission or distribution system equipment to the extent necessary to balance the power balance of the part of the electricity system concerned;
4. the use of spare production capacities, including the use of spare production capacities by the transmission system operator, in accordance with the directly applicable European Union law establishing a network code for defence and restoration of the electricity system (4); or
5. Limiting the supplied performance.
(2) The transmission system operator shall notify the operators of the regional distribution systems concerned without undue delay of any restrictions on the consumption or change in the supply of electricity in order to prevent an emergency.
(3) The regional distribution system operator shall notify without undue delay the restrictions applied by it on the consumption or change in the supply of electricity in order to prevent an emergency by the transmission system operator and the local distribution system operators concerned with a technical dispatching system.
(4) The local distribution system operator shall notify without undue delay the restrictions applied by it on the consumption or change in the supply of electricity in order to avoid an emergency to the regional distribution system operator to which its distribution system is connected.
(5) The transmission system operator or distribution system operator shall notify:
(a) preventing an emergency in a way that allows remote access;
(b) preventing emergency situations for settlement entities through electronic communication;
(c) the application of the measures referred to in paragraph 1 (b) to settlement entities by electronic communication, preferably in advance of at least one business interval.
(6) Restrictions on electricity consumption and change in electricity supply as referred to in paragraph 1 (b) (1) may apply
(a) for a maximum of six consecutive hours,
(b) not more than once within one calendar day; and
(c) no more than five times in a given calendar month.
(7) The settlement entity shall transmit contact information within the scope of the e-mail address and telephone number for the purposes of paragraph 5 to the market operator who shall transmit that information to the transmission system operator and distribution system operators.
Emergency procedures and measures
(1) Any restrictions on the consumption of electricity or the change in the supply of electricity in an emergency shall be imposed by the transmission system operator's technical dispatching or the distribution system operator's technical dispatching by issuing operational instructions.
(2) As a general rule, an emergency is declared and withdrawn in advance in the manner laid down in Section 54 of the Energy Act. In the event of a rapid breakdown of the electricity system, an emergency may be declared retrospectively.
(3) Restrictions on electricity consumption and change in the supply of electricity in an emergency are carried out
(a) automatically according to the frequency plan;
(b) according to the switch-off plan,
(c) according to the regulatory plan;
(d) the operational shutdown of parts of the transmission or distribution system equipment to the extent necessary to balance the power balance of the part of the electricity system concerned;
(e) the use of spare production capacities; or
(f) restrictions on the performance supplied.
(4) The transmission system operator shall, without undue delay, notify the regional distribution system operators of the declared or rectified emergency.
(5) The regional distribution system operator shall notify without undue delay of the declared or rectified emergency to the transmission system operator and the affected local distribution system operators with technical dispatching.
(6) The local distribution system operator shall, without undue delay, notify the regional distribution system operator to which its distribution system is connected the declared or rectified emergency.
(7) When dealing with an emergency, the TSO, the distribution system operator and the electricity producer shall proceed in accordance with their emergency plan, the details of which are set out in Annex 4 to this Regulation.
Procedure of local distribution system operators
Local distribution system operators in emergency prevention and emergency situations where:
(a) have a technical dispatching system and notify the regional distribution system operator in whose territory the licence is located, shall act as regional distribution system operators;
(b) they do not have a technical dispatcher or the regional distribution system operator does not notify that they have a dispatcher, shall be deemed to be customers.
Repeal
Decree No. 80 / 2010 Coll., on the state of emergency in electricity and on the content of the emergency plan, is repealed.
Efficacy
This Decree shall take effect on 1 July 2023, with the exception of the provisions of Sections 5 (4), 6 (5) (b) and (c) and 6 (7), which shall take effect on 1 January 2024.

Use and content of the regulatory plan, including the way in which regulatory degrees are notified, announced and withdrawn
I. Classification of customers in regulatory degrees
(1) Customers are included in the regulatory stages by:
(a) the way in which appliances are operated by means of collective remote control;
(b) the nominal voltage values of the part of the electricity system to which the demand facility of a particular customer is connected;
(c) the value of the reserved power specified in the connection contract.
(2) Classification of customers in regulatory degrees:
(a) at regulatory step 1, all customers under control of the selected appliances are classified by means of mass remote control, or by means of another technical system for controlling the size of consumption;
(b) at regulatory step 2, customers receiving electricity from distribution system facilities with a voltage greater than 1 kV and a value of reserved power of less than 100 kW and customers receiving electricity from distribution system facilities with a voltage up to 1 kV with a circuit breaker value below 200 A;
(c) in regulatory steps 3 and 5, customers receiving electricity from transmission system equipment or distribution system equipment with a voltage greater than 1 kV and a value of reserved power input of 1 MW or more are included;
(d) in regulatory steps 4 and 6, customers receiving electricity from distribution system facilities with a voltage greater than 1 kV and a value of the reserved power input of 100 kW and less than 1 MW are included and customers receiving electricity from distribution system facilities with a voltage up to 1 kV with a circuit breaker value before and above the 200 A electric meter;
(e) all customers are included in regulatory step 7.
II. Control stages
(1) The baseline shall not limit electricity consumption and shall express the normal operational status of the power system with a balanced power balance, the necessary power reserve, the required volume and the structure of the support services for transmission system operators and the secured transmission of electricity, while respecting security and reliability criteria.
(2) The warning level shall not limit the consumption of electricity; and
(a) indicates failure to meet the reliability criteria in the electricity system for balance sheet, transmission or other reasons;
(b) draw attention to possible restrictions on transmission or distribution capacity or the provision of transmission or distribution system services;
(c) draws attention to the need for increased attention when monitoring the means of informing on the energy situation and the means used to declare regulatory degrees.
(3) Regulation No 1 constitutes a restriction on the consumption of electricity withdrawn from the electricity system by switching off and blocking the switching on of selected appliances controlled by mass remote control and, where appropriate, by another technical power management system.
(4) Regulation No 2 constitutes a restriction on the electricity consumption withdrawn from the electricity system by using the technical means of the system operator within 1 hour after the regulatory stage is declared, unless a longer period is fixed.
(5) Regulation No 3 constitutes a restriction on electricity consumption from the electricity system by the values referred to in point III (3) within 30 minutes of the regulatory declaration.
(6) Regulation No 4 constitutes a restriction on the consumption of electricity withdrawn from the electricity system, by the values referred to in point III (3), within 1 hour after the regulatory declaration, unless a longer period is fixed.
(7) Clause 5 constitutes a restriction on electricity consumption withdrawn from the electricity system by the values referred to in point III (3) within 1 hour after the regulatory stage has been declared.
(8) Regulation No 6 constitutes a restriction on the electricity consumption withdrawn from the electricity system by the values referred to in point III (3), within 2 hours after the regulatory publication, unless a longer period is fixed.
(9) Regulation No 7 constitutes a restriction on the consumption of electricity from the electricity system for all customers to the value of the safety minima within 1 hour of the regulatory declaration. For a sampling facility where electricity consumption cannot be reduced to a minimum of safety within 1 hour, time shift in hours shall be determined as necessary to limit electricity consumption to a minimum of safety.
(10) For the purposes of the regulatory plan, the consumption of electricity from the electricity system shall mean the average value of the power withdrawn from the electricity system in the hour preceding the regulatory stage.
(11) Regulation Nos 1 to 6 may be declared simultaneously.
(12) Regulations Nos 2 to 7 do not apply to customers whose predominant activity is in health, telecommunications and postal services, in the management of water works and the supply of drinking water, in the defence of the state, in mining in deep mines, in civil aviation, in the operation of public railway transport, in public transport, in the premises and facilities of the Office of the Government of the Czech Republic, Czech National Bank, Ministry of Interior, Ministry of Justice and Police of the Czech Republic. In addition, regulatory steps 2 to 7 shall not apply to other components of the Integrated Rescue System and to customers providing heat supply, to electricity producers and to cases where nuclear safety could be compromised, as well as to operators of economic mobilization and suppliers of essential supplies listed in the crisis plan of the economic mobilization system at a time of crisis situations (5).
III. The limits on electricity consumption
(1) The selection and shut-off of the appliance groups at regulatory stage 1 is carried out by the technical dispatcher of the distribution system operator.
(2) The restriction on the consumption of electricity for each individual customer, classified at step 2, is implemented by the distribution system operator.
(3) The value of the restriction on electricity consumption at each individual regulatory stage 3 to 6 is determined as:
(a) 15% of the value of the power taken from the electricity system in accordance with point II. (10); or
(b) 15% of the reserve capacity in the relevant calendar month; This reserve capacity means the sum of the annual reserve capacity band and the monthly reserve capacity band in a given calendar month.
(4) In order to limit the consumption of electricity by the customer under regulatory steps 3 and 4 of 15%, regulatory steps 5 and 6 shall be followed, which shall limit the consumption of electricity by an additional 15%, up to a maximum of 30% of the restriction on the consumption of electricity while respecting the safety minima.
(5) The limits on the consumption of electricity for stage 7 are set with regard to compliance with the safety minima for customers.
(6) The limits on the consumption of electricity for regulatory stages 3 to 7 and the values of the safety minima with a possible reduction of up to 1 hour or, where appropriate, the time shift at which the value of the safety minima will be achieved shall form part of the contract for the provision of the transmission or distribution system service or the contract for the combined electricity supply services.
IV. Determination of safety minima
(1) Safety minima are the lowest value of electricity consumption that is necessary after production to ensure the safety of the sampling equipment technology, environmental impact and operator workers.
(2) The safety minimum is set at all customers with a value of the reserved power input of 100 kW or more and customers receiving electricity from distribution system facilities with a voltage up to 1 kV with a value of the circuit breaker before the electric meter 200 A or more.
(3) The safety minimum is determined on the basis of an inventory of individual appliances and an analysis of their safety and technological minimum consumption without production. The inventory of individual appliances and the analysis of their safety and technological minimum consumption shall be prepared by individual customers.
(4) The security minimum for customers included in regulatory step 2 is set out in the operating rules of the distribution system.
V. Method of notification, announcement and recall of regulatory degrees
(1) The level of basic, warning and information on the use of regulatory step 1 shall be notified and withdrawn by the transmission system operator or distribution system operator through technical dispatches and in the mass media in regular time or emergency periods.
(2) Regulation Nos 2 to 7 are declared and withdrawn by the transmission system operator or distribution system operator by means of technical dispatches and in mass media in regular periods or exceptional periods.
(3) In addition, for customers receiving electricity from distribution system facilities with a voltage greater than 1 kV and a value of the reserved power input of 1 MW and higher, the announcement and withdrawal of regulatory steps 3, 5 and 7 are carried out by the transmission system operator's technical dispatching via the technical dispatches of distribution system operators, or by the technical dispatches of distribution system operators directly according to the principles of the dispatching procedure, by telephone, SMS, electronically, by fax, or by any other comparable and mutually agreed means.

Use and content of the cut-off plan
I. Application of the Off Plan
(1) The switching off of the customer's equipment according to the switch-off plan and its re-activation shall be performed by a technical dispatching system operator in accordance with the control principles.
(2) The switch-off shall take place after publication of the cut-off steps No 21 to 30.
(3) The percentage of off-mode power in relation to the annual maximum load of the distribution system over the last 12 months shall be determined in each switching stage.
II. Switching degrees
(1) In the event of the announcement of cut-off step 21, the selected outlets in the transmission system or distribution system facilities shall be switched off to such an extent that the consumption limit does not exceed 2,5% of the annual load limit of the relevant distribution system. Each higher switch-off step to switch-off step 25 inclusive shall include the value of the off-mode power of the customers at the previous switch-off step plus 2,5% of the annual load maxima of the relevant distribution system (12,5% in total).
(2) In the event of the announcement of cut-off step 26, the selected outlets in the transmission system or distribution system facilities shall be switched off to such an extent that the restriction on electricity consumption does not exceed 17.5% of the annual load limit of the relevant distribution system. Each higher switch-off step to switch-off step 30 inclusive shall include the value of the off-mode power of the customers at the previous switch-off step plus 5% of the annual load maxima of the relevant distribution system (total 37,5%).
(3) The power charges of each switching stage shall be mutually agreed between the transmission system operator's technical dispatching system and the technical dispatching system operators.
(4) The area covered by the cut-off shall be indicated when announcing the switch-off rates and the duration of the restriction on electricity consumption shall be specified. In cases where it is not possible at the same time to determine the duration of the restriction when the device is issued, that period shall be determined retrospectively but no later than 2 hours after the client's device is issued.
(5) The switch-off steps No 21 to 30 cannot be declared simultaneously.

Use, processing, issuing and updating of the frequency plan
I. Application of the frequency plan
(1) The purpose of the use of the frequency plan is to reduce the generation of major system failures by timely, automatic interventions in the operation of the electricity system, to return and maintain the frequency of the power system after the failure occurs in values where the technical equipment of the electricity and customer manufacturers is not compromised and to create conditions for the rapid return of the frequency of the electricity system to the range of 49,8 to 50,2 Hz.
(2) In cases where, following the exhaustion of the measures on the part of electricity generators and the reduction of consumption on the part of customers for maintaining the frequency of the electricity system, its value deviates further, the frequency plan aims to maintain critical blocks of power generation in operation for own consumption, thereby creating conditions to accelerate the recovery of voltage and normal operation of the electricity system.
II. Use of the frequency plan when reducing frequency
(1) In the frequency drop band below 49,8 Hz up to 49,0 Hz, measures are taken on the power generation side connected to the affected part of the electricity system. The frequency control shall be provided according to the instructions of the technical dispatching of the relevant system operator or by an automatic change in the performance of the operated power generation blocks, by phasing in and loading of the prepared power generation blocks and by discharging the pump-power pump block.
(2) In the frequency drop band below 49,0 Hz, island operations may be created by parts of the electricity system. The frequency of the disconnection of island operation shall be determined by the transmission system operator technical dispatching or the distribution system operator technical dispatching. The frequency of disconnection of island traffic in the regional distribution system shall be mutually agreed between the regional distribution system operator technical dispatching and the transmission system operator technical dispatching. The frequency of the disconnection of island traffic in the local distribution system shall be mutually agreed between the local distribution system operator's technical dispatching system, the regional distribution system operator's technical dispatching system to which the local distribution system is connected and the transmission system operator's technical dispatching system.
(3) In the frequency drop band below 49,0 Hz, measures are taken in the area of electrical system load. The pre-determined volume of cross-counting demand is automatically disconnected in the frequency steps using the frequency relay. The number of degrees, their setting and the volume of interset demand are determined by the transmission system operator on the basis of system calculations of fault modes and in accordance with agreements with neighbouring electricity systems with which the electricity system of the Czech Republic is synchronous.
(4) For the resolution of system failures, automatic frequency disconnection shall be used with tiered action in the 49,0 Hz to 48,0 Hz frequency band. In order to address local range failures, the distribution system operator may further implement local automatic frequency power disconnection below 48,0 Hz for the automatic power disconnection system.
(5) In the frequency drop band to 48,0 Hz and below, the selected critical blocks of power generation are automatically disconnected from the power system and converted to operation for own consumption. The disconnection of power generation blocks takes place at frequency levels such that the technical limits of power generation blocks are not exceeded and the transition to self-consumption operations is reliable.
III. Use of the frequency plan at increased frequency
(1) Measures are taken in the frequency increase band above 50,2 Hz by electricity producers. The frequency control shall be provided in accordance with the TSO's technical dispatching or distribution system technical dispatching instructions or by automatically changing the power output of the power generating units operated and by disconnecting the power generating blocks from the affected part of the power generating system and transferring them to the operation for own consumption or by connecting the pump power station blocks to the pump mode either automatically or in accordance with the instructions of the relevant system operator's technical dispatching.
(2) In the frequency increase band above 50,2 Hz, island operations may be created by parts of the electricity system. The frequency of the disconnection of island operation shall be determined by the transmission system operator technical dispatching or the distribution system operator technical dispatching. The frequency of disconnection of island traffic in the regional distribution system shall be mutually agreed between the regional distribution system operator technical dispatching and the transmission system operator technical dispatching. The frequency of the disconnection of island traffic in the local distribution system shall be mutually agreed between the local distribution system operator's technical dispatching system, the regional distribution system operator's technical dispatching system to which the local distribution system is connected and the transmission system operator's technical dispatching system.
IV. Processing, issuing and updating of the frequency plan
(1) The frequency plan is drawn up and issued in cooperation with the transmission system operator's technical dispatching and technical dispatches of distribution system operators and electricity producers with respect to the rules of international interconnection.
(2) If there are changes in the electricity system of the Czech Republic in connection with foreign systems that affect the frequency plan, the transmission system operator shall update the plan in cooperation with distribution system operators and electricity producers. In the absence of such changes, the transmission system operator shall, on 30 September at all times, check the current frequency plan and its possible update.
(3) In order to address local scale failures by means of local automatic frequency reliance, the technical dispatches of distribution system operators adopt specific solutions that coordinate with the technical dispatching of the transmission system operator and issue in the form of a dispatching instruction.

Content elements of the emergency plan
I. Requirements for the emergency plan
(1) The emergency plan shall contain information on the licence holder, the establishments to which it relates, the date of processing, the date of approval, the date of entry into force, the period of validity, the data on the processor's person, the data on the authorising officer and their signatures.
(2) The emergency plan contains a list of documents constituting it, indicating the location of their storage. The individual documents shall be marked, numbered and the persons mentioned therein shall be entered in the name, surname and function.
(3) The information contained in the emergency plan is concise, understandable and clearly arranged. All solutions listed in the emergency plan shall respect the local situation, customs and organisational structure.
II. Transmission system operator emergency plan and distribution system operator emergency plan
The TSO's emergency plan and the distribution system operator's emergency plan shall contain:
1. Directive of emergency activities and of preventing and eliminating the consequences of an emergency,

III. Power producer emergency plan
The electricity producer's emergency plan shall include:
