Government regulations on reserved technical lifting equipment and requirements to ensure their safety

of 22 June 2022
on reserved technical lifting equipment and safety requirements
The Government mandates pursuant to § 23 (a), (b) and (f) to (h) of Act No. 250 / 2021 Coll., on the safety of work in connection with the operation of reserved technical equipment and on the amendment of related laws, hereinafter referred to as "the Act":
§ 1
Subject matter
This Regulation implements the relevant provisions of the European Union1) and provides for:
(a) reserved technical lifting equipment (hereinafter referred to as "dedicated lifting equipment") which constitutes an increased level of threat to the life, health and safety of natural persons and their classification in classes;
(b) requirements for operational safety, location, installation, repair, inspection, operation, inspection, revision, testing and operational documentation of reserved lifting equipment; and
(c) requirements for the eligibility of legal persons, the professional competence of commercial natural persons engaged in dedicated lifting equipment and, where appropriate, the professional competence of their staff and the competence of other legal persons and of competent natural persons who carry out activities on dedicated lifting equipment, including the method of checking their professional competence for activities on such facilities.
§ 2
Definition of terms
For the purposes of this Regulation:
(a) substantial modification of the installation by such an intervention in a dedicated lifting device where substantial changes occur which eliminate the identified operational risks or replace existing non-compliant parts and change the technical parameters and characteristics or safety parameters of the installation;
(b) by putting a dedicated lifting device into service the moment when a new or dedicated lifting device which has undergone a substantial change is put into service after carrying out the prescribed verification test of the device and recognising its suitability for permanent use and safe operation; with the exception of products intended for conformity assessment under another legislative act (2),
(c) professional activities to verify the technical condition of the dedicated lifting equipment for carrying out the prescribed inspections, expert inspections, inspections, revisions, tests, expert tests, verification tests and inspection inspections to identify operational risks;
(d) professional actions to return the dedicated lifting equipment to a state ensuring safe operation of a set of activities aimed at eliminating the identified operational risks by making a substantial change to the dedicated lifting equipment;
(e) a test to verify the functionality, reliability and safety of the dedicated lifting device after repair or removal of defects detected by the revision or test;
(f) a verification test carried out to the extent specified in accordance with the laws and regulations to ensure safety and health at work, as well as, where appropriate, the manufacturer's technical conditions, before putting into service, after reconstruction or substantial modification of the dedicated lifting device;
(g) a local operating regulation governing, in particular, the working and technological procedures for the use of a dedicated lifting device and the rules on the movement of such equipment and staff in the premises and places of work of the employer;
(h) a safe working system, the employer's code processed and observed in each crane operation;
(i) the working system of the employer's regulation, processed and observed in each working platform with motor drive and lifting height exceeding 1,5 m;
(j) an extraordinary test of the reserved lifting device carried out in the specified cases to verify its functionality, reliability and safety;
(k) by tying the loads, the activity prior to and following handling the load by means of binding agents and means for hanging and gripping the loads.
§ 3
Reserved lifting appliances
(1) The reserved lifting devices are:
(a) cranes and hoists, including motor-powered hoists of a capacity exceeding 1 000 kg, and cranes and hoists, including hand-operated hoists of a capacity exceeding 5 000 kg, including permanently installed load-bearing and suspension equipment;
(b) working platforms with motor propulsion and lifting height exceeding 1,5 m, mobile lifting platforms, suspension platforms and mast climbing platforms;
(c) lifts for the transport of persons, persons and cargo or of cargo only and vertical lifting platforms which are a permanent part of buildings authorised to carry persons and goods, of a capacity exceeding 100 kg and a lifting height exceeding 2 m;
(d) construction lifts for the carriage of persons and goods; and
(e) shelf founders with vertically movable operators and their movements.
(2) The reserved lifting devices are not:
(a) lifting trucks, motor and off-road trucks;
(b) lifting appliances assembled and constructed exclusively for installation purposes, in particular mounting arms, mast and superstructures;
(c) suspension conveyors,
(d) loaders and multifunctional lifting devices;
(e) lifting heads of trucks,
(f) lifting equipment for waste vehicles;
(g) moving steps and moving walkways;
(h) mechanical ramps;
(i) sliding ladders;
(j) means for tying, suspension and gripping loads which are not a permanent part of the lifting device;
(k) folk entertainment;
(l) stage and stage technological equipment,
(m) platforms and vehicle lifting equipment;
(n) stairlift and helical lifting platforms with motor drive;
o) auxiliary single-purpose handling equipment which are part of machine technology lines;
(p) doors; and
(q) permanent and temporary cranes.
(3) Furthermore, reserved lifting devices shall not be lifting devices referred to in paragraph 2 with replaceable attachments.
§ 4
Classification of reserved lifting appliances
(1) The reserved lifting devices of Class I are:
(a) cranes and hoists, including motor-powered hoists of a capacity exceeding 3,200 kg, and cranes and hoists, including hand-operated hoists of a capacity exceeding 5000 kg, including permanently installed load-bearing and suspension equipment;
(b) construction lifts for the carriage of persons and goods;
(c) shelf founders with vertically movable operators' posts and their movements.
(2) The reserved lifting devices of Class II are:
(a) cranes and hoists including motor-powered hoists of a capacity exceeding 1 000 kg and not exceeding 3 200 kg, including permanently installed load-bearing and suspension equipment;
(b) lifts for the transport of persons, persons and goods or just cargo and vertical lifting platforms which are a permanent part of buildings authorised to carry persons and persons and goods, exceeding 100 kg load capacity and lifting height exceeding 2 m;
(c) working platforms with motor propulsion and lifting height exceeding 1,5 m, mobile lifting platforms, suspension platforms and mast climbing platforms.
§ 5
Professional competence requirements for persons for assembly, repair, revision and testing
(1) Where the operator makes repairs to reserved lifting equipment, the operator must be entitled to repair pursuant to Sections 8 and 9 of the Act.
(2) Legal persons and natural persons involved may make substantial changes to the reserved lifting equipment or repairs made due to congestion of the dedicated lifting equipment, the collision of the dedicated lifting equipment or after an emergency which may affect the supporting parts or safety components of the dedicated lifting equipment, and repairs carried out in a supplier's way only if they are in possession of an authorisation under § 8 and 9 of the Act.
(3) Only persons holding a certificate of professional competence for the activities of reserved technical equipment pursuant to Article 11 of the Act may review and test reserved lifting equipment.
(4) The types of certificates for natural persons and authorisations for legal persons and undertakings for activities on dedicated lifting facilities are set out in Annex 1 to this Regulation.
§ 6
Requirements for safety of operation of dedicated lifting equipment during assembly and commissioning
(1) The installation of the dedicated lifting device shall be carried out according to the accompanying documentation of the dedicated lifting device.
(2) The verification test shall be carried out by a revision technician prior to the first entry into service of the dedicated lifting device, except for products for which the conditions of entry into service are determined on the basis of another legal or related Regulation (2).
(3) If a dedicated lifting device has been completed by its manufacturer, a verification test is not required.
§ 7
Requirements to ensure the safety of work and operation of the dedicated lifting device, the way in which they are verified and the removal of detected defects
(1) The time limits for carrying out professional tasks to verify the technical condition of the reserved lifting equipment are laid down for each installation in Annex 2 to this Regulation. If the accompanying documentation of the reserved lifting device provides for shorter time limits, these time limits shall prevail.
(2) Reports of checks, revisions or tests, including records of their implementation in the operations log, shall be drawn up in paper or electronic form by the person who carried them out.
(3) The reserved lifting equipment after repair may be operated only after verification that the repair did not jeopardise the safety of the work and operation of that equipment and that no further risks have been created; the verification shall be recorded by the person who has made the repair in the operating log or shall issue a test document according to the scope of the repair carried out in accordance with the laws, regulations and other provisions to ensure safety and health at work.
(4) The operator or his / her authorised person in writing shall be immediately demonstrably aware of the result of the repair, inspection, revision or testing by the person who carried out the operation.
§ 8
Checks, revisions and tests on dedicated lifting equipment
(1) Extraordinary test of the dedicated lifting device shall be carried out
(a) after a substantial change has been made to the reserved lifting device;
(b) after the transfer of a dedicated lifting device which cannot be excluded from the possibility that the transfer has changed its technical or functional characteristics;
(c) after repair of a dedicated lifting device which has been made due to overload of the dedicated lifting device, a collision of the dedicated lifting device or after an emergency which may have affected its supporting parts or safety components.
(2) An extraordinary test shall be carried out and its range shall be determined by revision techniques of dedicated lifting devices qualified for the test equipment.
(3) After repair or removal of defects detected by revision, inspection or test which have affected the safety of operation of the reserved lifting device, the quality of the work carried out shall be verified after repair.
(4) The test shall be carried out after repair and its scope shall be determined by the revision techniques of dedicated lifting devices qualified for the test equipment.
§ 9
Revision message of reserved lifting devices
The revision report of the dedicated lifting device shall contain:
(a) the name and registered office of the legal person, the name and, where applicable, the names of the natural person who operates or will operate the revised reserved lifting establishment;
(b) determining whether it is a revision, test or an extraordinary test and indicating the regulation under which it was carried out;
(c) description and technical parameters of the revised dedicated lifting device;
(d) the name and, where applicable, the name, surname, signature and registration number of the revision or test certificate; in the case of electronic transmission of the review report, the electronic document must be endorsed by an electronic signature),
(e) the date of commencement and termination of the revision, the examination or the extraordinary examination, the date of preparation of the review report and its transmission and the period of validity of the review report;
(f) an inventory of the measuring instruments used;
(g) a list of the supporting documents used to carry out the revision, test or extraordinary examination, including their assessment in a reciprocal context;
(h) an inventory of the operations carried out, such as inspection, test, measurement, including the values or evaluation found;
(i) an inventory of the defects identified, indicating the laws and regulations to ensure safety and health at work which have been infringed;
(j) an inventory of identified hazards which may pose a risk to the life, health and safety of persons or to property or the environment;
k) Word assessment whether the technical condition of the reserved lifting device
1. meets the requirements of safe and reliable operation;
2. show other defects listed in the inventory of detected defects; until such time as they are removed, further operation is possible under the conditions laid down by the operator on the basis of recommendations from the revision technician;
3. is not satisfactory as a result of defects listed in the inventory of identified defects which create risks to the life, health and safety of natural persons when operating the installation;
(l) an evaluation of any records of the results of the inspections and tests carried out and of any defects detected during the previous revision, test or operation and maintenance of the dedicated lifting device;
(m) confirmation of transmission of the revision report by the revision technician.
§ 10
Safety requirements for reserved lifting devices
(1) Operator of dedicated lifting equipment
(a) designate the authorised person responsible for the operation of the reserved lifting equipment and acting on the basis of a written mandate from the operator and ensure that he is familiar with the requirements of the laws, regulations and other provisions to ensure safety and health at work;
(b) keep the reserved lifting equipment in such a technical condition as to ensure its safe and reliable operation in accordance with the requirements set out in Annex 3 to this Regulation; in the event of a dangerous situation directly affecting the health of the persons concerned, immediately disables the designated lifting equipment;
(c) ensure, if not available for a dedicated lifting device, its accompanying documentation with the manufacturer or supplier of the equipment; where the manufacturer or supplier has ceased to exist and does not have a legal successor, the requirements for the safe operation of the reserved lifting device shall be laid down by a local operating regulation;
(d) maintain accompanying documentation and keep records of the operation of the dedicated lifting equipment in the operating log in accordance with the requirements of the laws and regulations to ensure safety and health at work;
(e) ensure the conditions for carrying out inspections, inspections, revisions and tests on the designated lifting equipment and their proper execution within the time limits laid down by laws, regulations and other provisions to ensure safety and health at work;
(f) take corrective measures to eliminate detected defects and minimise operational risks; the identified deficiencies and defects are the basis for further operation, maintenance planning and repair of the dedicated lifting equipment;
(g) in the case of reserved lifting equipment placed on the market after the entry into force of another legislation on conformity assessment (3), update the local traffic regulation and the related documentation in the parts relating to the provision of the operation of the reserved lifting equipment where the purpose of its use or the surrounding conditions of its operation changes.
(2) A legal person and an operating natural person carrying out the installation or repair of dedicated lifting equipment shall ensure that their activities are carried out by a sufficient number of competent persons, technical equipment and equipment and shall process the procedures for carrying out professional activities in accordance with an authorisation granted under Sections 8 and 9 of the Act, so that all necessary operations are carried out to ensure the safe operation of dedicated lifting equipment resulting from the instructions for use, from the legal and other rules to ensure safety and health at work and from the local operating regulation.
§ 11
Requirements for the eligibility of persons to repair dedicated lifting equipment
(1) A person competent for the repair of reserved lifting equipment is an adult, self-employed and disabled natural person fulfilling the professional experience and training referred to in Annex 4 to this Regulation who has received training from an employer who has worked under the supervision of a designated person competent for the repair of dedicated lifting equipment. The length of training is determined by the employer's internal regulation.
(2) The verification of professional fitness for repair shall be carried out by a legal person or an undertaking natural person holding a repair authorisation and having received training. It shall issue a certificate of proficiency.
§ 12
Requirements for the eligibility of authorised personnel, operators of designated lifting equipment and persons for loading
(1) The person responsible must be properly trained. The scope and frequency of training shall be determined in writing by the operator of the dedicated lifting equipment.
(2) A person qualified to operate dedicated lifting equipment or to tie loads, with the exception of a lift for the transport of persons or persons and cargo, shall be a natural person meeting the requirements of the legal and other regulations to ensure safety and health at work, who has received practical training under the supervision of a qualified operator. The qualified person is the operator of the equipment or the weighing device.
(3) An adult candidate who is fit to operate a dedicated lifting device or to tie loads may be admitted to a test of professional competence to operate a dedicated lifting device or to tie loads that have undergone training and practical training to the extent specified by the operator's local operating regulation according to the type and type of dedicated lifting device and meets other requirements under the legal and other regulations to ensure safety and health at work.
(4) The proficiency test for the operation of the reserved lifting equipment referred to in Article 3 (1) (a) of this Regulation and the load binder shall be carried out before a test committee consisting of a chairman and at least two other members. The Chairman of the Commission shall be a review technician certified for the type and scope of the dedicated lifting equipment.
(5) The test shall be recorded. In the case of a positive test result, the tenderer shall be given a certificate of fitness to operate the reserved lifting device or to tie the loads; the test report is an integral part of this document.
(6) Verification of the operator's knowledge of the reserved lifting device or of the loading of loads shall be carried out by re-training at the latest every 2 years in accordance with paragraphs 3 and 4. The results of the knowledge verification shall be recorded in accordance with paragraph 5.
§ 13
Transitional provision
Evidence of the eligibility of authorised persons and of the use of reserved lifting equipment or of the tying of loads issued before the date of entry into force of this Regulation shall be deemed to be valid until the expiry date, but for a maximum period of 2 years from the date of entry into force of this Regulation.
§ 14
Efficacy
This Regulation shall enter into force on 1 July 2022.

Time limits for checking the competence of dedicated lifting devices for safe operation
1. Terms
1.1 Terms for dedicated lifting devices
(a) the inspection of the dedicated lifting device shall be a visual inspection and inspection of the function of the dedicated lifting device carried out on each part of the dedicated lifting device in order to detect any defects or deviations from the normal state; it shall be carried out by the operator at the beginning of each working shift and recorded prior to the use of the dedicated lifting device;
(b) the functional test of a dedicated lifting device is an examination of the operation of electrical equipment mechanisms and signalling and signalling equipment with a load not exceeding the nominal load capacity;
(c) the inspection of a dedicated lifting device shall be a technical condition verification in accordance with the accompanying documentation in accordance with administrative and other rules to ensure safety and health at work at regular intervals in the meantime of the revisions and tests carried out by a person qualified under the local operating regulation;
(d) the test of the dedicated lifting device is the detection of the overall technical condition of the lifting device in terms of safety and operational competence by inspection, functional test and subsequent overload test carried out by revision techniques of the reserved lifting device qualified for the designated lifting device in question.
1.2 Terms for lifts
(a) the service is a summary of the prescribed professional tasks performed by the service person to ensure the continuous operation of the lift in service during its technical service life; the necessary procedures of the service person are based on instructions for use or technical standards;
(b) the service person is a legal or natural person with a corresponding authorisation, having an adequate number of competent staff, material technical equipment, procedures for the performance of the service and for ensuring the safe operation of lifts in service;
(c) a competent staff member is an employee of a service person with the professional competence of a service staff member, a professional service staff member or a test technician who is responsible for carrying out prescribed professional tasks in the field of lift service in operation on the basis of procedures developed by the service person;
(d) the test technician is a competent staff member of a service person qualified as a revision technician who is responsible for carrying out the tests and who is certified in accordance with Annex 4 to this Regulation with the distinguishing mark Z;
(e) a professional examination is an examination of the lift and a functional test of the safety features, components and other equipment of the lift in order to assess the overall condition of the lift, carried out by the expert service staff of the service person;
(f) the inspection visit is an assessment of the technical condition of the lift by the inspection authority in order to evaluate the safety level of the lift in terms of the operational risks encountered, to determine the design measures to remove them and to approach the safety level of the lift;
(g) the expert test is an elevator test performed at regular intervals to verify the function and capability for further operation, including the examination of the electrical equipment of the lift and the detection of hazards or hazards carried out by the service person's test technician;
(h) the operational risk is the technical solution or design of an elevator which causes dangerous situations directly affecting the health of the persons transported, the service and inspection staff or damage to property and the environment;
(i) the level of the safe lift is the state of the technical design of the lift, where the operational risks of the high and medium level referred to in the relevant technical standard and the non-conformity affecting the safety of operations are not present;
(j) substantial changes to the lift are changes to the reserved lift lifting equipment carried out in order to achieve the level of a safe lift or to increase the performance of the lift or, where appropriate, its technical level, changes to technical parameters, safety components, changes to or exchanges of parts of lifts, modifications to the building parts of the lift or lift spaces;
(k) the lift book is a document containing the basic technical data of the lift, intended for the recording of the test after the completion of the assembly, conformity assessment, the examination after substantial changes, the records of the technical tests, inspection inspections and the removal of the identified operational risks of the lift by the owner or the operator of the lift;
(l) the book of expert examinations is a document intended for records of the implementation, results and conclusions of expert examinations carried out by the service person.
2. Of cranes and hoists, including motor-powered hoists of a capacity exceeding 1 000 kg and cranes and hoists including hand-operated hoists of a capacity exceeding 5 000 kg, including permanently installed load-bearing and suspension equipment ("cranes and hoists")
2.1 For cranes and hoists referred to in Section 3 (1) (a), revisions and tests shall be carried out within the time limits set out in Table 1 and in points 2.2 and 2.4. On the basis of the accompanying documentation of cranes and hoists, the specified time limits may be shortened.

2.2 For tower, mobile, loading and cable cranes, the revision period shall be 1 year and 2 years. For such cranes over 14 years of age only the test shall be carried out once a year.
2.3 Time limits for revisions and tests must take into account the environment in which the designated lifting device works (taking into account the protocol on the determination of external influences).
2.4 In the case of stacking cranes where the operator's stations move vertically together with the load, revisions shall be made once a year, testing once every 2 years.
2.5 The inspection shall be carried out at the beginning of each working shift prior to the use of a dedicated lifting device.
2.6 During the period of the revisions and tests, an inspection shall be carried out at intervals of 3 months.
2.7 The crane which was dismantled before being moved to the new workplace can only be restarted after the test has been carried out.
3. Working platforms with motor drive and lifting height exceeding 1,5 m (hereinafter referred to as "working platforms")
3.1. Every day or at the beginning of each shift prior to the use of the work platform, the operator shall carry out a visual inspection and functional examination of the work platform under the conditions of the manufacturer and of the legal and other regulations to ensure safety and health at work.
3.2 A routine inspection of the work platform shall be carried out at intervals not exceeding 3 months and shall include all the items specified by the manufacturer for the routine inspection and the provisions of the legislation and regulations to ensure safety and health at work.
3.3 The test shall be performed once a year.
4. Building lifts for the transport of persons and goods
4.1 Every day or at the beginning of each shift prior to the use of the building lift, the operator shall carry out a visual inspection and functional examination under the conditions of the manufacturer and of the regulations and regulations to ensure safety and health at work.
4.2 The check shall be carried out within a period of time depending on the manufacturer's requirements, operating conditions and intensity of use, but shall not exceed 3 months.
4.3 The lift test shall be carried out at least once a year within the range specified by the instructions for use or by the local operating regulation.
4.4 A building lift which was dismantled before being moved to a new workplace can only be restarted after the test has been carried out.
