ORDER
GOVERNMENTS OF THE CZECH REPUBLIC
of 23 April 2020
on the adoption of crisis measures
Following the Government Resolution 194 of 12 March 2020, the Government, in accordance with Articles 5 and 6 of Constitutional Act No. 110 / 1998 Coll., on the Security of the Czech Republic, declared emergency status for the territory of the Czech Republic because of a health threat related to the detection of coronavirus / referred to as SARS CoV-2 / in the territory of the Czech Republic and pursuant to § 5 (a) to (e) and § 6 of the Act No. 240 / 2000 Coll., on crisis management and on the amendment of certain laws (Crisis Act), as amended, for the resolution of the situation arising, the adoption of emergency measures, by virtue § 5 (c), § 6 (1) (b) and § 6 (2) (b) of the Crisis Act.
Government
I. orders with effect from 27 April 2020 from 00: 00 hours for the duration of the emergency situation
1. a ban on entry into the territory of the Czech Republic for all foreigners who do not have a temporary stay in the territory of the Czech Republic over 90 days or a permanent stay; This does not apply:
a) for family members within the meaning of § 15a (1) of Act No. 326 / 1999 Coll., on the residence of foreigners in the Czech Republic and amending certain laws, as amended, citizens of the Czech Republic or citizens of the European Union with temporary or permanent residence in the Czech Republic,
(b) for citizens of the European Union and foreigners authorised to reside in the European Union who transit through the Czech Republic for the purpose of travelling home and have a note issued to that effect by the representative office (transit and repatriation),
(c) if the entry of these aliens is in the interest of the Czech Republic,
(d) for cross-border workers, pupils and students who regularly cross the national border with the Czech Republic from a neighbouring state for the purpose of performing work or studies in the Czech Republic;
(e) for international transport workers,
(f) for critical infrastructure service personnel;
(g) for diplomats and officials of international organisations;
(h) emergency situations;
(i) for citizens of the European Union who enter the territory of the Czech Republic demonstrably for the purpose of carrying out economic activity, for a maximum period of 72 hours, and submit a certificate of completion of the test referred to in point IV / 1;
(j) for citizens of the European Union entering the territory of the Czech Republic for the purpose of carrying out an economic activity or studying at a university and submitting a certificate of completion of the test referred to in point IV / 1;
where the reason for entry is supported by an appropriate document;
2. to all persons referred to in point 1 (a) to (h) who enter the territory of the Czech Republic immediately after entry into the territory of the Czech Republic to notify this fact by telephone or other remote access, a regional health station competent according to the place of residence or declared residence; This does not apply to persons referred to in point 1
(a) (a) if it presents a certificate of completion of the test referred to in point IV / 1;
(b) (b) if their stay within the territory of the Czech Republic is not longer than 24 hours or if they submit a certificate of completion of the test referred to in point IV / 1;
(c) points (c), (e), (f) and (g) if their stay in the Czech Republic is not longer than 14 days or if they submit a certificate of completion of the test referred to in point IV / 1;
(d) (d) if it provides a certificate of completion of a test which fulfils the conditions set out in point 8; a certificate of completion of the test need not be submitted by health and social services personnel, essential components of the integrated rescue system, or by staff of a critical infrastructure body, provided that their duration in the Czech Republic is not more than 14 days; the certificate of completion of the test does not need to be submitted by farmers operating in the immediate frontier whose stay in the Czech Republic will not exceed 24 hours,
(e) (h) if their stay in the Czech Republic is not longer than 24 hours or if they submit a certificate of completion of the test referred to in point IV / 1;
3. to all citizens of the Czech Republic and foreigners with a temporary stay of more than 90 days or a permanent stay on the territory of the Czech Republic who, when entering the territory of the Czech Republic, do not submit a certificate of completion of the test referred to in point IV / 1, immediately after entering the territory of the Czech Republic, to notify this fact by telephone or other remote access, the county health station responsible for the place of residence or declared residence; This does not apply to persons who are supported by an appropriate document that:
(a) for the purpose of carrying out work or studying in a neighbouring State, they shall regularly cross the national border if they submit a certificate of completion of a test which satisfies the conditions set out in point 8; a certificate of completion of the test need not be submitted by health and social services personnel, essential components of the integrated rescue system, or by a critical infrastructure operator, or by personnel of a critical infrastructure body submitting a note to the representative office of the destination country, that the health, social services, essential components of the integrated rescue system, or that measures have been taken at the place of work to prevent the spread of the Coronavar SARS CoV-2, in particular the obligation to carry out respiratory protection devices, unless the travel period has been longer than 14 days;
(b) have travelled in an emergency situation where their travel time has not been longer than 24 hours;
(c) have travelled as international transport workers, as staff of critical infrastructure services, diplomats or officials of international organisations, unless their travel period has been longer than 14 days; the service of critical infrastructure abroad for such cases must be accompanied by a note from the representative office of the country of destination,
(d) manage as farmers in the immediate frontier if their travel time has not been longer than 24 hours;
(e) travel for the purpose of carrying out an economic activity, provided that their travel time has not been longer than 72 hours and that they are not a cross-border worker under point (a);
4. regional health centres to decide on the quarantine provided for in § 64 (a) in conjunction with § 2 (7) (a) of Act No. 258 / 2000 Coll., on the protection of public health and on the amendment of certain related laws, as amended, for a period of 14 days for persons who notify entry into the Czech Republic pursuant to points 2 and 3; the public health protection authority may, in individual cases of persons falling under the category of interest of the Czech Republic, the service of critical infrastructure, diplomats and officials of international organisations, or an emergency situation, decide on other quarantine measures in accordance with Act No. 258 / 2000 Coll. and on the duration of such measures;
5. all persons entering the Czech Republic since 27 April 2020 00: 00,
(a) in the event of any symptoms of an infectious disease (in particular fever, cough, shortness of breath, indigestion, loss of smell, general weakness or other symptoms), immediately notify this fact, by telephone or other remote approach, to its registered health service provider in the field of general medicine, or, if they do not have a registering provider, to any provider in the field of general medicine;
(b) to suffer from the cross-border inspection of symptoms of infectious disease and, if signs of infectious disease are detected, to provide the necessary synergy to health professionals in carrying out a biological sample to detect the presence of COVID-19 disease;
6. To ensure that persons entering for the purpose of economic activities within the Czech Republic comply with the rules for critical employees in accordance with point IV of Resolution No. 332 of the Government of the Czech Republic of 30 March 2020 on the adoption of a crisis measure declared under No. 140 / 2020 Coll.;
7. To ensure that all persons receiving foreigners under the derogation under point I. / 1 (f) ensure that workers entering the Czech Republic for the purpose of service comply with the rules for critical employees under the Decree of the Government of the Czech Republic of 30 March 2020 No 332 on the adoption of a crisis measure, published under No 140 / 2020 Coll.;
8. cross-border workers, pupils and students who, at the time of border inspection, submit a certificate of completion of the test to the Czech Republic at the first crossing of the national border to submit a certificate of completion of the test referred to in point IV / 1, and thereafter of any further crossing of the national border to the Czech Republic, which occurs 14 days after the submission of the certificate of completion of the test referred to in point IV / 1, shall submit a certificate of completion of the test which is not more than 4 days old, that the test referred to in point IV / 1 has been carried out;
9. all persons referred to in point I.1. (j) undergo the subsequent test referred to in point IV / 1. between 10 and 14 days after entry;
10. that all persons referred to in point I. / 1 (j) whose entry is deemed necessary may enter without submitting a certificate of completion of the test referred to in point IV / 1; the need is confirmed by the minister of the sector concerned; these persons are required to take the test referred to in point IV / 1. within 24 hours of entry into the Czech Republic;
11. to ensure that all entities receiving aliens for the purpose of economic activity under the derogation in point I. / 1 (j):
(a) accommodation throughout their stay in the Czech Republic,
(b) medical care or a registered medical service provider throughout their stay in the Czech Republic, including reimbursement of medical care, unless otherwise provided;
(c) their transport from the national border to the place of accommodation and transport between the place of accommodation and the place of work, where public public transport cannot be used to travel to and from the place of employment;
(d) return to the country of origin in the event of unemployment in the Czech Republic;
II. Ordering with effect from 27 April 2020 from 00: 00 hours for the duration of the emergency
(a) citizens of the Czech Republic, foreigners with a temporary stay of more than 90 days or permanent residence and their family members referred to in point I. / 1. (a) who are repatriated on the territory of the Czech Republic, give prior notice of the date and method of repatriation by remote access established by the Ministry of Foreign Affairs and, after crossing the national borders of the Czech Republic, to travel to the place of residence not to use public public transport and taxis;
(b) to inform the persons referred to in point I. / 1. (j) in advance of the date and manner of entry into the Czech Republic by remote access provided for by the Ministry of Foreign Affairs and after crossing the national borders of the Czech Republic to travel to the place of accommodation do not use public public transport and taxis;
III. prohibits, with effect from 27 April 2020, from 00: 00, for the duration of the emergency situation, all persons entering the territory of the Czech Republic who have not been ordered to quarantine under point I. / 4 and persons referred to in point I. / 1 (i) and (j) for the duration of their stay in the territory of the Czech Republic, or for a maximum period of 14 days from the date of entry into the territory of the Czech Republic, with the exception of:
(a) travel to and from employment and travel to and from business or other similar activities,
(b) journeys strictly necessary to provide basic living needs, to provide care for children, to provide care for animals, to use the necessary financial and postal services, to supplement fuel;
(c) travel to health and social services establishments;
(d) travel to deal with urgent official matters;
(e) travel back to their place of residence;
(f) funerals;
IV.
1. that a certificate of completion of the test means a document issued by a doctor or public health authority confirming that a RT- PCR test has been carried out for the presence of SARS CoV-2 with a negative result not older than 4 days; the test is provided by the person at his own cost;
2. that the emergency referred to in point I.1. (h) shall mean:
(a) cross-border crossing of members of the integrated rescue system, including mountain service and other components of the integrated rescue system;
(b) transport of blood, bone marrow and other biological material by sampling teams, transport and transit by ambulance or hearse;
(c) undergoing medical procedures or medical examinations,
(d) the performance of an obligation imposed by a court, the journey by way of a subpoena by a State authority, the enforcement of a court order or other official conduct or use of the necessary financial and postal services;
e) collection or transport of family members from or abroad, including at airports;
(f) the necessary care for close family members who are unable to take care of themselves, the exercise of rights, the care of or contact with a minor child and the provision of the necessary care for animals;
(g) participation in funerals or weddings,
(h) other humanitarian situations;
3. the suspension of the period of expiry of which the employee card or derived residence permit expires, for the duration of the emergency condition; the period of interruption shall start to run;
V. requires the Minister for Health to ensure compliance with point I. / 4;
VI. repealed with effect from 27 April 2020
