of 28 April 2021
amending Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the driving of motor vehicles and amending certain laws, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 247 / 2000 Coll., on the acquisition and improvement of professional competence for the management of motor vehicles and on amendments to certain laws, as amended by Act No. 478 / 2001 Coll., Act No. 175 / 2002 Coll., Act No. 320 / 2002 Coll., Act No. 411 / 2005 Coll., Act No. 374 / 2007 Coll., Act No. 124 / 2008 Coll., Act No. 384 / 2008 Coll., Act No. 183 / 2011 Coll., Act No. 223 / 2009 Coll., Act No. 337 / 2020 Coll., Act No. 301 / 2009 Coll., Act No. 230 / 2014 Coll., Act No. 320 / 2015 Coll., Act No. 341 / 2011 Coll.
1. in Article 19 (a), the text "§ 39 (5)" is replaced by "§ 39 (6)."
2. in Paragraph 27 (2) (b):
'(b) the training in driving the vehicle has not lasted more than 4 hours a day for one applicant; in the case of an applicant's training to obtain a driving licence for category AM, A1, A2, A, B1 or B, training in the first and second stages of the training referred to in Annex 3 shall not last more than 2 teaching hours per day.';
3. In Article 27 (2) (c), the words "a person participating in basic training for obtaining a professional certificate 'shall be inserted after the words" undergoing training'.
4. At the end of the text of § 29a, the words "the training teacher may accompany only 1 applicant for a driving licence and the accompanying vehicle may not be driven by another applicant for a driving licence 'shall be added.
5. In Article 32 (2), "or 3 'is added after" Paragraph 39 (2)'.
6. In Paragraph 38, at the end of the text of paragraph 3, the words "that is not the case if the test is from road traffic regulations and medical training 'are added.
7. Paragraph 39 (2) reads as follows:
"(2) The result of each test shall be assessed by the degree" benefit 'or "benefit'. If the applicant for a driving licence has failed a test, he may repeat the test more than twice. Each repeated test may be carried out at least 5 working days from the date of the failed test. If the applicant fails even in the second repeat test, the applicant shall submit to the next test
(a) new teaching under Paragraph 20 (2), if it is an examination under paragraph 1 (a);
(b) new teaching according to § 20 (2) (b) if it is an examination under paragraph 1 (b);
(c) the new training referred to in Article 20 (3) (a), if it is a test referred to in paragraph 1 (c). ';
8. In Paragraph 39, the following paragraph 3 is inserted after paragraph 2:
"(3) Upon completion of the teaching or training referred to in paragraph 2, the applicant for a driving licence may repeat the test in which he has failed no more than three times. If they fail to pass these repeated tests, they must complete their training and training before the next test. A further test shall be carried out in accordance with paragraph 1. ';
Paragraphs 3 to 7 shall be renumbered paragraphs 4 to 8.
9. In Paragraph 39 (6), "6 'is replaced by" 12' and after the word "tests', the words" following full learning and training 'are inserted.
10. In Paragraph 39 (8), "6 'is replaced by" 7';
11. In Paragraph 42, the following paragraph 2 is inserted after paragraph 1:
"(2) If the applicant for a driving licence for category AM, A1, A2 or A fails to demonstrate basic knowledge in the first part of the test, he shall be assessed as" not successful 'and shall not continue in the second part of the test. Where the applicant for a driving licence for category AM, A1, A2 does not demonstrate, or A basic knowledge in the second part of the test, being evaluated by degree failed "and the repeated test shall be performed only within the second part of the test.'
Paragraphs 2 to 5 shall be renumbered paragraphs 3 to 6.
12. in Paragraph 42 (5), "paragraph 3" is replaced by "paragraph 4."
13. Paragraph 45, including the title, reads:
Test of competence to drive motor vehicles
The provisions on the examination of the competence of applicants for driving licences shall apply mutatis mutandis to the proficiency checks for motor vehicles under the Specific Law 2a. The cost of the test shall be borne by the applicant. '
14. in § 62, the text "§ 42 (5)" is replaced by the text "§ 42 (6)."
Transitional provisions
1. Tests on the competence to drive motor vehicles and on the competence to drive motor vehicles started before the date of entry into force of this Act shall be completed in accordance with existing legislation.
2. For the repetition of the proficiency test for the driving of motor vehicles and the proficiency check for the driving of motor vehicles in which the applicant has been assessed by the "failed 'degree before the date of entry into force of this Act, Act No. 247 / 2000 Coll., as effective until the date of entry into force of this Act, shall apply.
Efficacy
This Act shall take effect on 1 July 2021.
