GOVERNMENT REGULATION
of 15 December 2004
defining the Bird Region of Bologna
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
§ 1
Subject matter
(1) The bird region of Bologna ("the bird region") is defined.
(2) The protection of the bird's area consists of the populations of the field rattlesnake (Crex crex), the smallest shell (Glaucidium passerinum), the forest crane (Bonasa bonasia), the trifinger date (Picoides tridactylus) and the forest larch (Lullula arborea) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
§ 2
Definition of bird area
(1) The bird region is situated in the territory of the South Bohemia Region, in the cadastral territories of Arnoštov near Český Krumlov, Boletry, Horní Snow, Jablonec near Český Krumlov, Koryto, Køenov near Kajov, Křistanov, Manávka near Český Krumlov, Ondřejov near Český Krumlov, Polná near Český Krumlov, Spálenec, Stromil, Třebovice near Český Krumlov, Uhíkov near Český Krumlov, Volary and Zeztina.
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map documents of the scale 1: 50 000, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Office of the National Park of Šumava, the Regional Office of the South Bohemia Region, the Military Forest Office, the municipal authorities of the enlarged municipalities in whose administrative district the bird area is located, and the Central Office of the Military Escape of the Boletice.
§ 3
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of the municipalities be located outside the bird area at the same time as the municipality (3)
(a) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(b) maintain drainage systems;
(c) to change the type of land and the means of usingit (4).
(2) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 (a), where this is a procedure in accordance with the waterworks rules (5);
(b) for the activities referred to in paragraph 1 (b), in the case of the maintenance of a reinforced forest outbound road, allowing for year-round operation, or of a reinforced and unpaved outbound road, allowing seasonal operation;
(c) the activities referred to in paragraph 1 carried out in accordance with the priority use of the military exit area for State defence purposes (6);
(d) the activities referred to in paragraph 1 (c), where such activities are subject to a decision under special legislation (7) and have been given an opinion by the competent nature conservation authority;
(e) in the implementation of road operations8);
(f) the activities referred to in paragraph 1 in the case of activities carried out under special legislation9) in the territory of the specified conquest area and exclusive bearings.
§ 4
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border of the Birds' Region of Bologna
The border of the bird region begins at the point where it touches the border of the Kroumlov, Kroumlov, Kr. Arnoštov and Krumlov. Nice about 450 m southeast of the cubicle (994). From there, the border of the bird region leads northwest to the border of Český Krumlov and Krumlov. Nice and after about 250 m passes to the border of K. Ú. Horní Snow and K. Arnoštov u Český Krumlov. Following this border leads north, crosses the Black stream and in the length of about 1200 passes through the forest complex. On the north edge of the forest about 350 m southwest of the cubicle On the rock (1011) leaves the boundary of the cadastres and leads along the edge of the forest north and west. On the northwest edge of the forest it passes to the unpaved path *) leading directly to the west and leads around 450 m to the crossing with another unpaved path oriented in the north-south direction, located immediately south of the cubicle 1020. From there, it crosses the northeastern-oriented road and leads north through the Lower Snow to Saint Magdalene. From there it leads on a reinforced road along the edge of the forest straight north to the crossing with the railway track Volary-Prachatice. It passes on to the railway body, on which it leads towards the direction of Prachatice to the crossing of the railway line with the road * *) No I / 165 south of the village Zbytina. It goes to this road and leads along it southeast via the town of Krastianov to the place where the borders of K. Ú. Krastianov and K. Ondřejov near Český Krumlov are diverted from the road. He's crossing this border and leading east. From this point to the starting point, the border of the bird's region is formed by the external borders of Český Krumlov, K. Ú. Třebovice near Český Krumlov, K. Ú. Boletice, K. Ú. Polná near Český Krumlov, K. Ú. Panážák near Český Krumlov and K. Úřikov near Český Krumlov.
Explanatory notes:
*) If the text of the Annex indicates that the border leads along the road, it is expressed that it leads along the edge of the road, namely the border heading into the bird's area.
* *) If the text of the Annex indicates that the border leads on the road, it is expressed that it leads on the edge of the road auxiliary plot, and that it leads on the edge of the bird's area.
