Act of the Czech National Council on State Administration Bodies of the Czech Republic in the field of punking and testing of precious metals

on the authorities of the Government of the Czech Republic in the field of punk and testing of precious metals
The Czech National Council decided on this law:

ČÁST PRVNÍ

INTRODUCTORY PROVISIONS
§ 1
(1) A Punk Office is hereby established as an Administrative Office under the authority of the Ministry of Industry and Trade ("the Ministry ').
(2) The Chairman is the head of the Punk Office; its selection, appointment and appeal are governed by the Civil Service Act.
§ 2
The government authorities of the Czech Republic in the field of punking and testing of precious metals are
(a) the Ministry;
(b) Punk office.

SCOPE OF THE STATE GOVERNMENT AUTHORITIES OF THE CZECH REPUBLIC IN THE FIELD OF PUNCHING AND TESTING OF PRESSURE METALS
§ 3
Ministry
(a) organise and manage the civil service for precious metals, 2)
(b) manage the Punk Office;
(c) decide on appeals against decisions of the Punk Office;
(d) lay down, by a general law, the amount of the charges for operations carried out by the Punk Office ("punk fees") and the method of payment.
§ 4
Punk Office
(a) carry out a punk check 3) and a punk inspection, 4)
(b) allocates and cancels the production marks to producers of domestic goods, 5) and assigns and cancels liability marks to traders importing foreign goods, 5a)
(c) keeps a list of registered alloys of precious metals, 6)
(d) issue, or withdraw from, producers of precious metal alloys certificates for additional professional competence (7) and issue certificates for the entry of jewellery alloys in the list of registered alloys;
(e) decide to retain the assigned mark or the mark of responsibility;
f) verifies the purity of dental precious metals 8) and alloys during stamping of Czech coins of precious metals, 9)
(g) verify on request the purity of leaf gold or silver (10) and other items of precious metal (11)
(h) carry out on request expert activities in the field of punk, testing and analytical chemistry of precious metals and the management of precious metals;
(i) treat articles and goods of precious metal acquired by the State under special legislation12) or under international treaties;
j) expresses its views on the proposals for Czech standards in the field of testing and analytical chemistry of precious metals,
(k) impose fines under the punk law, 13)
(l) supervise the safety of precious metal products;
(m) carry out other tasks arising from specific legislation.
§ 5
(1) The President of the Punk Office may establish, as necessary, the Punk Office's premises, which are branches and exposures, for the pursuit of activities under the Punk Act.
(2) The establishment or cancellation of a branch shall require the prior consent of the Ministry.
(3) Branch
(a) carry out a punk check 3) and a punk inspection, 4)
b) verifies the purity of dental precious metals 8) and alloys during stamping of Czech coins of precious metals, 9)
(c) verify on request the purity of leaf gold or silver (10) and to the extent specified by the Chairman of the Punk Office and other items of precious metal. 11)
(4) Exposure
(a) carry out punk checks, 3)
(b) verifies, upon request, the purity of leaf gold or silver (10) and to the extent specified by the Chairman of the Punk Office and other items of precious metal. 11)
§ 6
(1) The Puncture Office shall levy administrative fees in accordance with the special rules for acts referred to in Article 4 (b), (c), (d) and (e). 14)
(2) For the performance of the punk control (3) and for the actions referred to in Article 4 (f) to (h) and (l), the punk office shall levy a punk fee, the amount of which is laid down in a generally binding legislation (§ 3 (d)).
(3) In cases where the punk office's action under § 4 (g), (h) and (l) does not provide for a punk fee by a generally binding law, the price of the punk's action shall be agreed in accordance with price regulations.
(4) Revenue from actions carried out by the Punk Office is revenue from the State budget.
§ 7
(1) The Punk Office shall, upon the fulfilment of the reporting obligation (15), designate the manufacturer or merchant (16) of the Punk Office (hereinafter referred to as "the relevant place of work"), which is closest to his place of residence or place of residence, unless they agree otherwise.
(2) The manufacturer or trader shall have the right, following prior written notification to the Office, to change the relevant workplace. Without the consent of the Punk Office, the manufacturer or trader cannot simultaneously contact multiple Punk Office workplaces.
(3) Natural and legal persons other than manufacturers and merchants (16) may contact any site of the Punk Office. The requested action shall not be refused if the workplace carries out this activity.

TRANSITIONAL AND FINAL PROVISIONS
§ 8
(1) The Punk Office uses state symbols and denotes documents related to the performance of the State administration in the field of punking and testing of precious metals in accordance with specific regulations. 17)
(2) The findings, certificates or opinions of the Punk Office bearing an official stamp or seal are public documents. 18)
§ 9
(1) The Office for Precious metals in Praze19 and its rights and obligations, including the rights and obligations of employment relations, are hereby repealed.
(2) Proceedings initiated by the State Presiding Office for precious metals in Prague before the effective date of this Act will be completed by the Punk Office according to the existing regulations.
§ 10
§ 39 (2) of Act No. 539 / 1992 Coll., on Punching and Testing of Precious Metals (Puncture Act) reads:
"(2) Traders shall be obliged to issue a document indicating the type, price, weight and purity of the precious metal products sold at the time of sale. However, if silver goods of a weight not exceeding 10 grams are sold, this document may not contain an indication of the weight. '
§ 11
This Law shall take effect on 1 January 1993.
