Government Regulation
of 27 January 1948
amending and supplementing the Railway Regulations.
The Government of the Czechoslovak Republic orders pursuant to § 85, paragraph 1 of the Act of 20 May 1937, No. 86 Coll., on Railways (Railway Act):
The Railway Transport Regulations, which are annexed to the Government Decree of 21 December 1945, No 1 Coll. of 1946, which establishes the Railway Transport Regulations, are amended as follows:
1.
'(a) the name of the station of destination and, where appropriate, the transport route;';
2. in the second sentence of Article 40 (8), the words "express letter" shall be replaced by "second copy of the express note."
3.
"(a) the ownership mark, row and number of the vehicle, the own weight of the vehicle, the loading weight or the area of the vehicle and the indication whether the vehicle is open or covered - if the consignment is loaded;"
4. Article 48 (3) (l) is deleted.
5. Article 50 (4) reads as follows:
"Article 4. For all other consignments, the railway undertaking shall, for the purpose of the transport contract, establish the weight if this weight is not recorded on the consignment note or if the consignor has proposed the weight to be found on the consignment note and sufficient weight to do so, or if operating conditions permit it, at the dispatch station or at least at the choice of the railway undertaking either on the journey or at the station of destination. For this finding, the railway can calculate the tariff fee. '
6. Article 52 (1), second to last sentences, reads as follows:
"Load exceeding load capacity - congestion - shall not be permitted unless the railway, for a transitional period in the interest of operation but without prejudice to its safety, is otherwise provided for by the approval of the supervisory authority. '
7. In Article 56, Article 5a is inserted after Article 5:
"§ 5a. In the case of vehicles in covered wagons, the consignor shall be obliged to attach tickets with details of the consignment to the inner wall of the wagons at both doors, in particular the address of the consignee of the consignment, content and weight. '
8. In Article 59, Article 2, after the words "the consignor is entitled to propose ', the words" in the consignment note' are deleted.
20. Article 80 (4) reads as follows:
"Article 4. The animals are to be loaded to the consignor unless the fare is otherwise fixed or the special agreement between the consignor and the railway has been negotiated and included in the consignment note. Large animals (horses and cattle) must be bound by the consignor in the vehicle. '
21. Article 80 (11) reads as follows:
"Article 11. In the case of animals without containers, the sender must remove the floor of the vehicle. The floor of an open vehicle or a vehicle which has only lattice walls and a vehicle whose doors are opened at a width greater than that provided for in Article 82 (1) shall not be covered by easily flammable substances. In particular, weeds, grass litter and straw shall be considered as easily flammable substances. If the undersized animals not accompanied by the route are transhipped, the railway will provide the underhand in the vehicle for further transport. The railway has the right to collect tariff charges for subjecting it, unless it has caused the translation itself."
22. The last sentence of Article 82 (1) shall read as follows:
"For the sender's proposal, the railway shall carry large slaughter animals in open high-wall carriages between 1 April and 31 October."
23. Article 82 (3) reads as follows:
"§ 3. Pigs, calves, sheep, goats and poultry without containers, but pigs and calves only during the period 1 April to 31 October, shall be transported in covered vehicles with several floors, with standard walls and with watercourses, which shall be supplied by the consignor as appropriate. The walls shall be so high as to be made of boards closely adjacent to each other, or fitted with flaps adjacent to each other so tight that the animals are protected against draught from the bottom and to prevent feces and litter. If there are no wagons with standard walls, the pigs' cattle, calves, sheep and goats must be transported in covered vehicles with ventilation holes, with bars in the door and with watercourses supplied by the consignor. Pigs and calves must be transported in the same manner between 1 November and 31 March. '
24. Article 82 (6) reads as follows:
"Section 6. The container on the underside of the vehicle may be used unless the fare is otherwise fixed, only for the transport of animals which died during the transport of the rail. '
25. Article 83 (3), second sentence, reads as follows:
"If transport lasts more than 36 hours, the animals must be fed and watered at the latest every 36 hours."
26. in Article 83, Article 3, the following sentence is inserted after the second sentence:
"However, in hot weather, the animals transported must be watered at least once every 24 hours."
27. in Annex B (Article 47 (1)), the formula for loading lists is replaced by the formula attached to this Regulation.
This Regulation shall enter into force on 1 January 1948; they shall be carried out by the Minister for Transport.
