THE LAW
of 16 April 2020
amending Act No 159 / 1999 Coll., on certain conditions of business and on the pursuit of certain tourism activities, as amended
Parliament has decided on this law of the Czech Republic:
Act No. 159 / 1999 Coll., on certain conditions of business and on the pursuit of certain tourism activities, as amended by Act No. 37 / 2004 Coll., Act No. 39 / 2004 Coll., Act No. 57 / 2006 Coll., Act No. 214 / 2006 Coll., Act No. 130 / 2008 Coll., Act No. 301 / 2009 Coll., Act No. 89 / 2012 Coll., Act No. 341 / 2015 Coll., Act No. 183 / 2017 Coll., Act No. 111 / 2018 Coll., Act No. 113 / 2020 Coll., and Act No. 117 / 2020 Coll., is amended as follows:
1. After Paragraph 9d, the following Section 10 is inserted:
Online mediation
(1) In order to conclude a contract for a tourist service pursuant to Section 1a, the person who makes contact with the customer by means of distance communication shall be obliged to inform the local business office within 30 days of the receipt of his request.
(a) the number of travel service contracts concluded for the period indicated in the invitation;
(b) the total price of tourism services for the period indicated in the invitation;
(c) the address of the place where the tourism services are provided; and
(d) the designation of the service provider with which it has facilitated the conclusion of a contract relating to the provision of tourism services to the customer,
1. in the case of a natural person, his name and surname, date of birth and address of permanent residence;
2. in the case of the natural person involved, its name, surname or business name, address of registered office and person identification number,
3. in the case of a legal person, its business name, address and identification number; and
4. other contact details of the persons referred to in points 1 to 3, if known to the intermediary.
(2) The municipal trade office may, upon request, transmit to another public authority the information obtained pursuant to paragraph 1. ';
2. In Paragraph 10b, the following paragraph 9 is inserted after paragraph 8:
"(9) The intermediary referred to in Article 10 (1) shall commit an offence by not communicating the information referred to in Article 10 (1) to the trade office at the request and within the prescribed period. '
Paragraph 9 shall become paragraph 10.
3. in Article 10b (10) (b), "or 6" is replaced by "6 or 9."
4. In Paragraph 10b, the following paragraph 11 is added:
"(11) The publication of an infringement decision may also be imposed for the offence referred to in paragraph 9. ';
Technical notification
This Act was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services.
Efficacy
This Act shall take effect on the day of its publication.
