DECLARATION
of 14 June 2025
amending Decree No. 409 / 2016 Coll., on activities of particular importance in terms of nuclear safety and radiation protection, the specific competence and preparation of the person providing radiation protection for the Registrant
The State Authority on Nuclear Safety sets out, pursuant to Section 236 of Act No. 263 / 2016 Coll., Atomic Act, as amended by Act No. 83 / 2025 Coll., for the implementation of Sections 24 (7), 31 (6), 32 (10), 33 (8) and 70 (2) (a) of this Act:
Decree No. 409 / 2016 Coll., on activities of particular importance for nuclear safety and radiation protection, the specific competence and preparation of the person providing radiation protection for the Registrant, is amended as follows:
1. In Section 2 (1) of the Introductory Part of the provision, the words "with a heat output greater than 50 MW (hereinafter referred to as" nuclear power equipment ')' are deleted.
2. In Article 3, at the end of point (b), the word "or 'is replaced by" and to' and the following points 1 and 2 are added:
'1. sources of ionising radiation used for medical exposure and veterinary radiotherapy;
2. another source of ionising radiation, or ';
3. In Article 5 (1), at the end of point (a), the words "the pursuit of the activity referred to in Article 2 (1) (b) for a period of 2 years' are deleted and the following points 1 and 2 are added:
"1. the performance of the activities referred to in Article 2 (1) (b) for a period of 2 years on a nuclear-energy facility of an adequate type; or
2. the performance of an activity in the field with a relative subject for 2 years, supplemented by training on a full-scale simulator of a nuclear power plant for which an authorisation is sought, of 50 training days, '.
4. In Article 5 (1), at the end of point (b), the words "the pursuit of the activity referred to in Article 2 (1) (c) for a period of 1 year and in accordance with Article 2 (1) (d) for a period of 1 year and 'are deleted and points 1 and 2 are added:
"1. the pursuit of the activities referred to in Article 2 (1) (c) for a period of 1 year and in accordance with Article 2 (1) (d) for a period of 1 year on a nuclear-energy facility of an adequate type; or
2. the performance of an activity in the field with a related subject for a period of 2 years, supplemented by training on a full-scale simulator of a nuclear power plant for which authorisation is sought, of 50 training days a ';
5. In Article 5 (1) (c), the words "on an adequate type of nuclear power plant 'shall be inserted after the words" flight'.
6. in Article 5 (2), the words "on a research nuclear installation of an appropriate type" shall be added at the end of the text of point (a) and at the end of the text of point (b).
7. in Article 7 (d):
"(d) higher education obtained in a study programme in the field of radiological physics or fitness for the performance of an unmedical medical profession of radiological physics for the management of the evaluation of the properties of an X-ray device used for medical exposure purposes, other than dental X-ray equipment,"
8. in Article 7 (e):
"(e) the competence to pursue the non-medical medical profession of clinical radiological physics to control the evaluation of the properties of the source of ionising radiation used in human or veterinary radiotherapy for therapeutic purposes,"
9. in Article 7, the following point (f) is inserted after point (e):
"(f) secondary education without a graduate examination for carrying out an assessment of the properties of the source of ionising radiation in accordance with § 3 (b) (2),"
Points (f) to (h) shall be renumbered as points (g) to (i).

Type and duration of professional experience for activities of special importance for radiation protection
[Paragraph 31 (6) (c) of the Atomic Act]
(1) For the authorisation to carry out activities of particular importance for radiation protection, with the exception of the management of the performance of services of radiological protection importance pursuant to § 9 (2) (h) (2), (5), (6) and (7) of the Atomic Act, professional experience in such activities of 1 year duration is required,
(a) for the holder of the authorisation:
1. this activity is carried out in particular relevant to radiation protection; or
2. a similar activity is carried out which is particularly important in terms of radiation protection, where it is not possible to ensure that the activity referred to in point 1 is carried out by another authorisation holder; and
(b) under the supervision of the holder of an authorisation to carry out such or similar activities, particularly relevant to radiation protection.
(2) In addition, for the granting of an authorisation to operate under Section 3 (b) (1), professional practice is required to exercise continuous supervision of compliance with radiation protection, control or evaluation of the properties of the source of ionising radiation for 1 month.
(3) Where the applicant applies for authorisation to carry out activities of special importance for radiation protection repeatedly and the previous test has been assessed in full by the "non-compliance" degree in accordance with paragraph 1, the practice achieved before the completion of the previous test shall not be counted. ';
11. at the end of the text of paragraph 1, the words "completed by successful completion of the final test" shall be added.
12. Paragraph 10 (2) reads as follows:
"(2) The personality characteristics which are a prerequisite for the performance of a nuclear safety activity are:
(a) emotional stability and resistance to stress;
(b) higher levels of self-control and discipline;
(c) cooperative approach and willingness to team cooperation;
d) an interest in learning and an active approach to learning;
(e) a tendency towards social, prudent and responsible behaviour; and
(f) absence of psychopathologic symptoms, lack of tendencies to aggressive, risky or impulsive behaviour. ';
13. in Article 11 (3) (b), the word "structured" is replaced by "semi-structured behavioural."
14. in Article 11 (3) (f), the word "projective" shall be deleted and the words "performance projective diagnostics" shall be added at the end of the letter.
15. in Article 15 (1) of the introductory part of the provision, the words "under Article 3 (a), (b) (2) and (c)" shall be inserted after the word "protection."
16. in Article 15 (1), at the end of point (a), the comma shall be replaced by "a";
17. in Article 15 (1) (b), the word "a" is replaced by a dot and point (c) is deleted;
18. In Article 15, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) Test to verify specific competence for activities of special importance for radiation protection under § 3 (b). (b) point 1 shall be carried out to the following extent:
(a) the written part of the test; and
(b) the practical part of the test.
(3) If the applicant applying for verification of the specific competence referred to in Article 3 (1) (a) (ii) of Regulation (EC) No 765 / 2008, the applicant shall: (b) point (1) of a single procedure requires such specific competence for more than one modality of the source of ionising radiation, the written and practical part of the test is carried out for each required modality of the source of ionising radiation separately. ';
Paragraph 2 shall become paragraph 4.
19. In Article 17, the following paragraph 3 is added:
"(3) The duration of the authorisation to carry out activities of particular nuclear safety importance for the re-authorisation to carry out the same activity shall be half as set out in paragraph 2, provided that the overall assessment of the test to verify the specific competence for activities of particular nuclear safety importance in the previous stage 3 authorisation. The duration of the authorisation to carry out activities of particular nuclear safety importance for the renewal of the authorisation to carry out the same activity shall be less than 1 year as provided for in paragraph 2, provided that the overall assessment of the test to verify the specific competence of nuclear safety activities was of particular importance in the previous granting of the level 2 authorisation. ';
20. Paragraph 18 (3) reads:
"(3) Further training for activities of special importance in the field of radiation protection must be carried out by completion
(a) a training course of 6 hours of teaching time completed by successful completion of the final test; or
(b) training in accordance with Section 9. ';
21. In Paragraph 20, the words "completed with a successful completion of the final test 'shall be added at the end of the text of paragraph 1.
22. In Paragraph 20, the following paragraph 3 is inserted after paragraph 2:
"(3) A natural person holding a document of specific competence as referred to in Article 3 (a) and regularly undergoing further training as referred to in Article 18 shall be deemed to satisfy the requirements for the preparation of a person providing radiation protection for a registrant."
Paragraph 3 shall become paragraph 4.
23. in Paragraph 21 (2), the word "a" shall be replaced by a comma at the end of (c).
24. In Article 21, at the end of paragraph 2, the dot is replaced by "a 'and the following point (e) is added:
"(e) a model final test which contains 20 test questions with rules for assessing the success of training and further training for activities of particular importance in terms of radiation protection and for the preparation of persons providing radiation protection for the registrar."
25. In Article 21, the following paragraph 3 is added:
"(3) The list of instructors and their professional qualifications, including education, practice and other data certifying their competence to provide training, further training or training of the person providing radiation protection for the registrar in the field, shall be included in the documents documenting the competence of the applicant's staff. ';
26. In Annex No 2, the following sentence is inserted under the heading: "The holder of an authorisation who conducts training and further training shall adjust the scope of the topics listed in that Annex and their inclusion in a specific course according to current knowledge and course orientation in order to meet the objective of training and further training. '.
27. In Annex 4, point V., at the end of paragraph 2, the sentence "The Test Panel may determine a longer practical part of the test than that set out in paragraph 3 if it is necessary to further examine the applicant's capabilities or test results on a full scale simulator or oral part of the test. ';

"Annex No 6
Content of the test to verify specific competence for activities of special importance for radiation protection and procedures for evaluation of parts of the test
I. Content of the written part of the examination referred to in Article 15 (1) (a)
1. The written part of the test consists of sets of questions with 3 solutions offered. Question sets make up
1.1. A basic set with 20 questions of basic knowledge and regulation of radiation protection,
1.2. Specific sets
1.2.1. for the activities referred to in Sections 3 (a) and 3 (b) (2), one set of 20 questions for each of the thematic areas related to activities of particular importance in terms of radiation protection, for which the applicant has requested in the application, but not more than three specific sets,
1.2.2. for the activities referred to in Section 3 (c), one set of 20 questions for each type of activity of particular importance in terms of radiation protection which the applicant requests in the application.
2. The questions of the written part of the test are mainly aimed at checking knowledge
2.1 on activities of particular importance for radiation protection,
2.2 on the organisation of radiation protection,
2.3. From the foundations of atomic and nuclear physics,
2.4. Based on the effects of ionising radiation; and
2.5. Radiobiological background for radiation protection principles.
3. Choosing the right solution is rated 1 point.
5. Individual sets of written part of the test are evaluated
5.1. "passed" at 80% or more of the total amount of available points,
5.2. "failed" at less than 80% of the total amount of points available.
6. Written test is evaluated
6.1. "did not comply" as a whole when assessed "did not comply" with the basic set of questions,
6.2. "Accepted" for an activity related to a specific set of questions, which was assessed by "passed" if the "passed" level was "evaluated by the basic set,
6.3. "Fail" for an activity related to a specific set of questions that has been assessed by "fail."
II. Content of the oral part of the test
1. A set of test questions for the oral part of the test consists of:
1.1. Of the 1 question concerning the use of sources of ionising radiation or of the activity referred to in Section 3 which the applicant intends to carry out,
1.2 of the 2 legislative questions for the activity in question; and
1.3. In the case of the activity referred to in § 3 (b) and (c), out of 1 question from the interpretation of measured values in relation to the effects of ionising radiation on humans.
2. The members of the Examination Board shall be entitled to ask supplementary questions to the applicant.
3. If the activity is performed in accordance with § 3 (a), the oral part of the test shall be assessed by "passed 'if 2 of the test questions for the oral part of the test are answered correctly.
4. If the operation is carried out in accordance with § 3 (b) or (c), the oral part of the test shall be assessed as "passed 'if 3 of the test questions for the oral part of the test are answered correctly.
III. Content of the written part of the examination referred to in Article 15 (2) (a)
1. The written part of the test for one modality of the source of ionising radiation consists of one set of questions in the form of a test with three solutions offered. Number of questions in the set
1.1.5 questions in the case of an application for an assessment of the properties of the source of ionising radiation,
1.2. 8 questions in the case of a request for the management and performance of an assessment of the properties of the source of ionising radiation.
2. The questions of the written part of the test are mainly aimed at checking
2.1. Knowledge of the physical and technical aspects of the required activity;
2.2 knowledge of patient dosimetry,
2.3. Ability to calculate the essential parameters of the assessment of the properties of ionising radiation sources;
2.4. Knowledge of measurement theory.
3. Choosing the right solution is rated 1 point.
4. The written part of the test for the modality of the source of ionising radiation is evaluated
4.1. "Accepted" at 80% or more of the total amount of available points,
4.2. "failed" at less than 80% of the total amount of available points.
IV. Content of the practical part of the test
1. The content of the practical test is one task for each required modality of the source of ionising radiation.
2. The task shall include the practical implementation of the thematic part of the evaluation of the properties of the source of ionising radiation.
3. In the framework of the task, the applicants shall be asked related physical, technical and dosimetric questions and radiation protection issues organised in the following headings:
3.1. Parameters and settings of the tested source of ionising radiation, its accessories, test aids and gauges, used aids and gauges, the importance of the tests carried out, their tolerances, possible defects on the tested source of ionising radiation or its accessories detected during the tests and evaluation of test results;
3.2. the physical nature of ionising radiation and its interaction with matter and tissues,
3.3. the physical and technical nature of the detection of ionising radiation,
3.4. measurable and derived dosimetric quantities used,
3.5. in the case of radiotherapy, the determination of the dose and the quality of ionising radiation suitable for the required therapeutic effect, the principles of delivery of the prescribed dose to the target volume, its accuracy and verification, and the means of protection against undesirable effects of ionising radiation in therapeutic irradiation,
3.6. Determination of the radiation burden on the patient and other natural persons,
3.7. in the case of imaging using ionising radiation, the physical and technical nature of image creation and reconstruction and methods of quantitative image quality assessment and its relationship with patients,
3.8. the possibility of reducing the patient's dose for medical exposure and other natural persons while maintaining the purpose of exposure;
3.9. measuring instruments and other instruments used in testing the source of ionising radiation, the principles of their operation and construction;
3.10. Measurement theory and its inaccuracy, analysis of inaccuracies, evaluation of test results, formalism of uncertainties in measurement; and
3.11. practical knowledge of testing the source of ionising radiation, in particular practical testing.
4. If, as part of the task assigned to it, the applicant correctly answers the vast majority of the related questions asked and does the required practical tasks correctly, the task shall be considered to be a fulfilled and the practical part of the test for the modality of the source of ionising radiation shall be assessed as "passed." '
29. Annex 7 (II) (3) reads as follows:
"3. good practice in colimatisation in intraoral imaging and in indication of dental computational tomography;"
30. In Annex 7, point III (1), "a 'is replaced by" or'.
31. In Annex 7, point III (2), the words "and bone 'are replaced by the words" or bone'.
Efficacy
This Decree shall take effect on 1 July 2025.
