DECLARATION
of 20 June 2024
amending Decree No. 260 / 2023 Coll., on the laying down of the conditions of medical fitness of persons to operate railway and rail transport
According to Section 66 (2) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 426 / 2021 Coll., ("the Act '), the Ministry of Health provides for the implementation of Sections 45 (3), 46d (2) and 46f (3) of the Act:
Decree No. 260 / 2023 Coll., on the establishment of the medical fitness conditions of persons for the operation of railway and rail transport, is amended as follows:
1. In Article 1, the words "the European Union1 'shall be inserted after the words" the European Union1' and the words "the European Union1a Regulation shall apply directly '.
footnote 1a is replaced by the following:
"(1a) Commission Implementing Regulation (EU) 2019 / 773 of 16 May 2019 concerning the technical specification for interoperability relating to the" operation and traffic management "subsystem of the rail system in the European Union and repealing Decision 2012 / 757 / EU, as amended. ';
2. in Article 5 (1), the word "indicative" shall be inserted at the beginning of points (e) to (g).
3. in Article 6 (3), the word "indicative" shall be inserted at the beginning of point (e).
4. In Article 6 (3) (f), the words ", nasal and cervical 'shall be inserted after the words" ear'.
5. In Article 7 (5), "55 'is replaced by" completion 56' and "age 56 'is replaced by" after'.
6. In Article 7 (7), the words "with the exception of the provisions of Article 5 (1) (d) to (g) shall be inserted after the words" apply mutatis mutandis'. In the case of a licence holder older than 40 years, an electrocardiographic examination shall also be included in the periodic medical examination. 'and the word' diseases' shall be replaced by 'Diseases'.
7. In Article 7 (8), the words', with the exception of the provisions of Article 6 (3) (d) to (f), shall be inserted after the words "apply mutatis mutandis'. For a person referred to in § 2 (4) (a) over 40 years of age, an electrocardiographic examination shall also be included in the periodic medical examination. 'and the word' diseases' shall be replaced by 'Diseases'.
8. In Article 8, the words "except for the provisions of Article 3 (1) (d), taking into account the specific reason for carrying out an emergency medical examination 'shall be added at the end of the text of paragraph 1.
9. In Paragraph 8 (2) (b), the words "after incapacity 'shall be inserted at the beginning of point 2.
10. In Article 9, the words "except for the provisions of Section 5 (1) (d), taking into account the specific reason for carrying out an emergency medical examination 'shall be added at the end of the text of paragraph 1.
11. In Article 10, the words "except for the provisions of Article 6 (3) (d) and (f), taking into account the specific reason for carrying out an emergency medical examination 'shall be added at the end of the text of paragraph 1.
12. The following Section 10a is inserted after Section 10:
(1) In the event of an emergency medical examination pursuant to § 9 (2) (c), the period for carrying out a periodic medical examination determined by the period of validity of the medical examination in the previous periodical examination pursuant to § 13 shall not be stopped or interrupted.
(2) In the event of an emergency medical examination pursuant to § 9 (2) (a), (b), (d) and (e), the new period for carrying out a further periodic medical examination shall run as determined by the period of validity of the medical opinion referred to in § 13. '
13. in Paragraph 13 (1), '55' is replaced by 'completion 56' and 'age 56' is replaced by 'after'.
14. in Paragraph 13 (2) (a), "17" is replaced by "completion 18."
15. in Article 13 (2) (b), the words "between 18 and 55 years of age 3 years" shall be replaced by the words "between 18 and 41 years of age 5 years of age, 41 to 62 years of age 3 years of age and 1 year thereafter";
16. in Paragraph 13 (2) (c), '55' is replaced by '56' and at the end of the text of the letter the comma is replaced by 'or (c), or'.
17. in Article 13 (2), points (d) and (e) are deleted;
Point (f) shall become point (d).
18. in Annex 2 (A) (1), the following point (k) is inserted after point (j):
"(k) total functional loss of vision on one eye or use of only one eye,"
Points (k) and (l) shall be renumbered as points (l) and (m).
19. In Annex 2 (A) (2), point (c) is deleted.
Points (d) to (i) shall be renumbered (c) to (h).
20. In Annex 2, Part In point 2, the word "or 'shall be added at the end of point (f).
21. in Annex 2, Part In point 2, at the end of point (g), the word "or 'is replaced by a dot and point (h) is deleted.
22. in Annex 2 (B) (1), the following point (k) is inserted after point (j):
"(k) total functional loss of vision on one eye or use of only one eye,"
Points (k) and (l) shall be renumbered as points (l) and (m).
23. In Annex No 2, Part B, point 2 (d), the word "or 'is deleted.
24. In Annex No 2 (B) (2), at the end of point (e), the dot is replaced by "or 'and the following point (f) is added:
"(f) severe colour disorder."
Transitional provision
The judgment issued pursuant to Decree No. 101 / 1995 Coll., as effective before the date of entry into force of the Order, is valid for the period for which it was issued.
Efficacy
This Decree shall take effect on 1 July 2024.
