on specific rules for education and decision-making at universities in 2020 and on the assessment of study time for the purposes of other laws
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

GENERAL PROVISIONS
§ 1
Scope of the law
(1) This Act lays down specific rules for the field of higher education for the calendar year 2020 relating to higher education and the activities of higher education institutions and certain related issues in relation to the emergency situation declared on 12 March 2020.
(2) Act No 111 / 1998 Coll., on higher education institutions and amending and supplementing other laws (the Act on higher education), as amended, (hereinafter referred to as the Act on higher education), shall apply unless otherwise provided for by that Act.
(3) This law applies to public higher education institutions and to private and public higher education institutions.

§ 2
Consideration of study disruption
(1) The period of study in the study programme covering the period from 1 March 2020 to 31 August 2020 (hereinafter referred to as "disturbed study period") shall not count towards:
(a) periods of study under Section 58 (3) of the Higher Education Act for the purpose of determining the study fee;
(b) maximum periods of study for the purpose of carrying out study duties, where such periods are provided for in the internal rules of the higher education institution;
(c) maximum periods of study for the purpose of awarding scholarships to a university, where such periods are provided for by the university's internal rules.
(2) The period for which a scholarship is granted under Paragraph 91 (3) of the Higher Education Act is extended by the period of study which has been disturbed, but not until the completion of the studies.
(3) If, at the time of the disturbed study, a person has a study interrupted in accordance with Section 54 of the Higher Education Act, that period shall not be counted until the total period of interruption if requested.
§ 3
Admission to study
(1) A university may set a new date for verifying compliance with the conditions for admission to study under Section 49 (5) of the Higher Education Act (hereinafter referred to as "verification"). The newly established date of verification of the university shall be published at least 15 days before the date of its performance.
(2) The university may also use distance forms of verification for verification. If the verification is carried out in a representative form and if the presence of students in the course of teaching and examinations at a university based on a decision by a public authority (hereinafter referred to as "the presence of students in the course of teaching and examinations at a university ') is not renewed at least 15 days before the published date of the verification, the university shall publish a new term, which shall be set at the earliest 15 days after the renewal of the possibility of students being present at the teaching and testing.
(3) If it is not possible to carry out verifications under the original conditions, the university may redefine them and publish them no later than 15 days before the date of verification.
§ 4
Admission to study and enrolment
(1) If the tenderer who has fulfilled the other conditions of admission to study in the study programme cannot produce proof of compliance
(a) the achievement of a secondary education with a graduate examination, if it is to be accepted in a Bachelor's or Master's degree programme;
(b) the proper completion of the study in any type of study programme if it is for admission to study in the Master's study programme; or
(c) the proper completion of the study in the Master's study programme, if it is for admission to study in the Doctor's study programme;
it can be accepted for study and entered on condition.
(2) If a student on condition does not submit the document referred to in paragraph 1 no later than 45 days after the beginning of the academic year 2020 / 2021, he shall cease to be admitted to study and enrolment in the study and shall be deemed not to have been enrolled.
§ 5
State tests
(1) At a time when the personal presence of students in university education and examinations or the presence of members of an academic community in a university is restricted under a measure adopted under another law, the university for carrying out the state examination prescribed at the end of the study and defending the dissertation may take advantage of the distance arrangements provided that the condition of at least the distance participation of the examination board in the state examination is met. The state examination prescribed at the end of the study and the defence of the dissertation conducted in a distance manner may not be public provided that the university receives a sound or sound and visual recording and keeps it for 5 years. A university record shall only be provided to a public authority in the exercise of its powers, at its request.
(2) The deadline for the national final examination will be published by the university on its website no later than 15 days before the date of its performance. The student must be clearly familiar with the term.
(3) If a university proposes to the student the possibility of carrying out the state examination prescribed at the end of the study or defending the dissertation in a distance form, it shall also inform him of the method of performance and of the technical or material requirements. If it cannot be carried out in a distance form, the university will allow the student to perform the state final exam in the presence of the students in teaching and examinations at the university.
(4) Paragraphs 1 to 3 shall apply even if the personal presence of a student or the presence of members of an academic community at a university is not possible due to other measures of a public authority related to the presence of a coronavirus known as SARS CoV-2, including to another State.
§ 6
The course of studies and the timetable of the academic year
(1) The examinations and other study duties and conditions to be met by the student during the course of the study programme may be limited, completed and verified by the student's personal presence in the course of teaching and examinations at the university or by the members of the academic community at the university on the basis of a measure adopted under another law.
(2) A university may, at a time when it is not possible for students to have a personal presence in teaching and examinations at a university, use distance learning tools in teaching.
(3) The academic year may be extended or shortened by the Rector's decision because of restrictions based on emergency conditions or restrictions on the personal presence of students in teaching and examinations at university.

§ 7
(1) Collective self-governing bodies of a university or faculty which are expected to vote may, at a time when the personal presence of students in teaching and examinations at a university or the presence of members of an academic community at a university is restricted by a measure adopted under another law, conduct negotiations and voting outside meetings by means of distance communication. Where a given authority so decides, public votes may also be taken on matters which, under the Law on Higher Education or the Internal Rules, require a secret vote. The closer voting conditions shall be determined by the person who heads the competent authority of the university or faculty.
(2) In the event that the term of office of the institution or the members of a university or faculty body is to expire between the date of the declaration of emergency and the day of the 100th day following the end of the emergency, that period shall be extended until the 20th day following the end of the emergency. The first sentence shall not apply in the event of the appointment of a successor to the former Rector of the College or the Dean of the Faculty no later than the end of the term of office of his predecessor.

PERIOD OF THE STUDY FOR THE PURPOSES OF OTHER LAWS
§ 8
(1) The period of time for which the State is to pay public health insurance premiums for a person over 26 years of age first studying in a doctoral study programme carried out by a university in the Czech Republic in a presentative form of study is extended by the period of impaired studies, but no longer than the period of due completion of the study.
(2) For the purposes of the Act on State Social Support, the Act on Pension Insurance and the Act on Public Health Insurance, as well as for the purposes of the laws which refer to any of these laws, a conditionally registered student is treated as a student under Section 61 of the Act on Higher Education. The first sentence shall apply within 45 days of the beginning of the academic year 2020 / 2021 to a student who does not, within the time limit referred to in Article 4 (2), produce a document referred to in Article 4 (1).
