DECLARATION
of 8 June 2023
amending Decree No. 393 / 2020 Coll., on the Digital Technical Map of the Region
The Czech office of surveyor and cadastral provides pursuant to § 20 paragraph 1 (f) to (j) of Act No. 200 / 1994 Coll., on surveying and amending and supplementing certain laws related to its implementation, as amended by Act No. 380 / 2009 Coll., Act No. 47 / 2020 Coll. and Act No. 88 / 2023 Coll.:
Decree No. 393 / 2020 Coll., on the Digital Technical Map of the Region, is amended as follows:
1. In Article 3 (5), the comma after the word "line 'is replaced by" or' and the words "or area with a demarcation point 'are deleted.
2. Paragraph 3 (7) reads as follows:
"(7) For transport and technical infrastructure objects and equipment and for basic spatial situation objects and equipment, together with an indication of the accuracy characteristics, an indication of how the position and height data have been taken shall be kept. The values which may be obtained are set out in Annex 2 to this Decree. ';
3. Paragraph 7, including the title and footnote 3, reads as follows:
Provision of digital technical map data
(1) Data from the public part of the digital technical map can be viewed by means of an application available on the portal. Data from the public part of the digital technical map shall also be provided in the form of viewing services and download services. In the form of download services, data on transport and technical infrastructure from the public part of the digital technical map shall be provided after prior electronic identification and authentication of the person to whom the data are provided.
(2) Data from the non-public part of the digital technical map shall be provided on request; the editor of such data or of the person who ensures that the editor fulfils his or her editorial obligations shall be provided without request. Data from the non-public part of the digital technical map shall be provided exclusively in the form of download services.
(3) The format of download services provides digital technical map data in the file in an exchange format, broken down by region territory and by municipalities or territories in which urban areas in the capital of Prague carry out transferred activities (3). The digital technical chart data provided in the form of download services shall be provided as valid data on the first day of the relevant calendar month and as data on changes in data per day. Data on changes in data per day shall be provided in a maximum aggregate of one calendar month.
(4) The technical assumptions and operational information for the use of the application and services referred to in paragraphs 1 to 3 shall be published by the Office on the portal. In the event that the user of this application or service overloads the technological infrastructure of the information system of the digital technical map (s) or of the digital map (s) of the public administration (s), or uses such services unprofessionally, the administrator of the relevant information system shall be entitled to prevent it from doing so by technical means.

4. In Section 10, "1 July 2023 'is replaced by" 1 July 2024';
5. In Annex No 1, in all cases where the entry "geometry 'contains a row containing the words" definition point', this row, including its content in the columns "Values for which the data may be generated '," n.a. indication', "Height 'and" Object type code', shall be deleted.
6. 2. Depending on whether the location of a particular object is expressed as a point or a line or a surface, an end-point expressing the following shall be added to the object type code:

Characteristics of the accuracy of the position and height data and how the position and height data are obtained
1. Characteristics of the accuracy of the position and height data
1.1. The accuracy of the position and height data is characterised by the basic mean coordinate error mxy and the basic mean height error mH. The accuracy indication shall be given to the element or individual points of the spatial determination in the form of a precision class.

1.2. If the accuracy of the data on the position and height of the digital technical map element does not match even the accuracy class 5 or is not known, it shall be given instead of the precision class number 9.
2. Means of acquiring position and height data
2.1. Indication of how data on the location and height of transport infrastructure objects can be obtained:
(a) geodetically - terrestrial,
(b) geodetically-photographically,
(c) geodetically - by terrestrial laser scanning,
(d) approximate plot;
(e) not detected.
2.2. An indication of how the data on the position and height of the technical infrastructure object can be obtained may be given by:
(a) geodetically - terrestrial,
(b) geodetically - terrestrial before the bed,
(c) geodetically - terrestrial after the bed,
(d) geodetically-photographically,
e) geodetically - by terrestrial laser scanning,
(f) approximate plot;
(g) searched;
(h) not detected.
2.3. Indication of how data on the position and height of the building of the basic spatial situation can be obtained:
(a) geodetically - terrestrial,
(b) geodetically-photographically,
(c) geodetically - by terrestrial laser scanning,
(d) approximate plot;
(e) not detected.
Where the location of a particular object of the basic spatial situation is expressed in accordance with Annex 1 or Annex 3 as a "demarcation point ', the indication of the method of acquisition shall not be given.
2.4. Indication of how the data on the location and height of the basic spatial situation referred to in Annex 3 to Group 5 may be obtained in accordance with Section 2.2. ';
64.
