DECLARATION
of 16 June 2025
on the model and particulars of the certificate of possession of the driving licence and of the certificate of the technical licence of a vehicle of the armed forces
According to § 55 (b) of Act No. 300 / 2013 Coll., on Military Police and on the amendment of certain laws (Act on Military Police), as amended by Act No. 173 / 2025 Coll.:
Subject matter
This decree regulates
(a) the particulars of the certificate of possession of the driving licence or of the declaration of possession of the driving licence (hereinafter referred to as the "certificate of detention of the driving licence"),
(b) a model for the certificate of detention;
(c) the particulars of the certificate of detention of the certificate of technical licence of a vehicle of the armed forces (hereinafter referred to as the certificate); and
(d) a model certificate of detention.
Forms of certificate of detention
(1) The certificate of retention of a driving licence shall contain:
(a) a designation of the military police department of which the military officer who has detained the driving licence is a national;
(b) the name, surname and address of the holder of the detained driving licence;
(c) the date of birth of the holder of the detained driving licence;
(d) the number and date of issue of the seized driving licence and the designation of the office which issued the detained driving licence;
(e) the reason for the detention of a driving licence, including a brief description of the action on the basis of which the driving licence was detained, indicating the place and time of the offence,
(f) information on the consequence of the retention of a driving licence;
(g) the date of issue of the certificate of possession of the licence and the signature of the military officer holding the licence;
(h) the statement of the holder of the detained driving licence if he wishes to comment on the retention of the driving licence; and
(i) the signature of the holder of the detained driving licence or, where applicable, by a military officer, made a note that the holder of the detained driving licence refused to sign.
(2) The model of the certificate of retention of a driving licence is set out in Annex 1 to this Regulation.
Forms of certificate of detention
(1) The certificate shall contain:
(a) the designation of the military police department of which the military officer holding the certificate is a national;
(b) the type or type of vehicle;
(c) a military registration number;
(d) the number of the certificate withheld;
(e) the reason for the detention of the certificate, including a brief description of the defect on the vehicle on the basis of which the certificate was detained; and
(f) the date of issue of the certificate of detention and the signature of the military officer holding the certificate.
(2) The model certificate of detention is set out in Annex 2 to this Regulation.
Efficacy
This Decree shall take effect on 1 July 2025.
