GOVERNMENT REGULATION
of 15 July 2019
amending Government Regulation No 351 / 2013 Coll., determining the amount of interest on late payment and the costs associated with the claim, determines the remuneration of the liquidator, the liquidator and the member of the legal entity appointed by the court and regulates certain issues of the Commercial Journal, the public registers of legal and natural persons and the records of trust funds and the records of data on beneficial owners, as amended by Government Regulation No 434 / 2017 Coll.
The Government mandates for the implementation of Act No. 89 / 2012 Coll., Civil Code, as amended by Act No. 460 / 2016 Coll., Act No. 303 / 2017 Coll., Act No. 111 / 2018 Coll. and Act No. 171 / 2018 Coll., and Act No. 304 / 2013 Coll., Act No. 368 / 2016 Coll., Act No. 460 / 2016 Coll., Act No. 303 / 2017 Coll. and Act No. 287 / 2018 Coll.:
Čl. I
Government Regulation No 351 / 2013 Coll., determining the amount of interest on late payment and the costs associated with the claim, determines the remuneration of the liquidator, the liquidator and the member of the legal entity appointed by the court and regulates certain issues of the Commercial Journal, the public registers of legal and natural persons, and the records of trust funds and the data relating to beneficial owners, as amended by Government Regulation No 434 / 2017 Coll., is amended as follows:
1. In Paragraph 13, the following paragraphs 2 and 3 are inserted after paragraph 1:
"(2) The obligation to publish twice the notice of entry into liquidation of a legal person registered in a public register other than a commercial register, together with an invitation to creditors to register their claims, is also fulfilled if it is published in a manner that allows remote access under the Law on public registers of legal and natural persons for a period of 3 months and 2 weeks of registration
(a) entry into liquidation;
(b) data identifying the liquidator; and
(c) an invitation to creditors to submit their claims within a period of at least 3 months and 2 weeks from the day following the date of publication of the registration.
(3) The obligation to publish for the first time the notification of the entry of a legal person entered into the Commercial Register into liquidation, together with an invitation to creditors to register their claims, is also fulfilled if it is published in a manner that allows remote access under the Law on public registers of legal and natural persons to register
(a) entry into liquidation;
(b) data identifying the liquidator; and
(c) an invitation to the creditors to submit their claims within a specified period. "
Paragraph 2 shall become paragraph 4.
2. In Section 15, "2 'is replaced by" 4';
3. In Paragraph 18a, the words "paragraphs 1 and 4 'are inserted after the words" Paragraph 13'.
Čl. II
Transitional provision
Legal persons who entered into liquidation before the date of entry into force of this Regulation shall be treated in accordance with existing legislation.
Čl. III
Efficacy
This Regulation shall take effect on 1 August 2019.
