DECLARATION
of 2 July 2007
amending Decree No. 524 / 2006 Coll., on the rules for the organisation of the gas market and the creation, assignment and use of gas supply type diagrams
According to Article 98 (7) of Act No. 458 / 2000 Coll., on the Terms and Conditions of Business and on the Enforcement of State Administration in the Energy Sector and on the Amendment of Certain Laws (Energy Act), as amended by Act No. 670 / 2004 Coll., for the implementation of § 17 (7) (e) and (h) of the Energy Act:
Decree No. 524 / 2006 Coll., on the rules for the organisation of the gas market and the creation, assignment and use of gas supply diagrams, is amended as follows:
1. Paragraph 8, including the title, reads:
Dealing with transport capacity shortages
In the event that all applicants for the reservation of transmission capacity cannot be satisfied, the transmission system operator shall allocate the free transmission capacity in proportion to the size of each requirement. Where the requirement exceeds free transmission capacity, the transmission system operator shall reduce that requirement to the amount of free transmission capacity before the distribution of free transmission capacity. ';
2. Paragraph 18, including the title, reads:
Addressing the scarcity of storage capacity
In the event that all applicants for reservation of storage capacity cannot be satisfied, the operator of the underground gas storage tank shall allocate free storage capacity in proportion to the size of each requirement. Where the requirement exceeds free storage capacity, the operator of the underground gas storage tank shall reduce that requirement to the amount of free storage capacity before the distribution of free storage capacity. ';
3. In Paragraph 35 (2), the word "fifth 'is replaced by" fourth'.
4. In Paragraph 38 (5) (b), "6 'is replaced by" 1' and "20 'is replaced by" 17'.
5. In Paragraph 38 (5) (c), "7 'is replaced by" 2' and "21 'is replaced by" 18'.
6. In Paragraph 39, the following paragraph 3 is added:
"(3) Where the price of the supply or distribution of the gas for the final customer with the measurement of type C outside the date of deduction is changed, the gas consumption shall be determined when the price of the supply or distribution of the gas is changed by the percentage distribution of the measured quantity of gas to monthly withdrawals as set out in Annex 11 to this Regulation. ';
7. The following Annex 11 is inserted after Annex 10:
"Annex No 11 to Decree No 524 / 2006 Coll.
Determination of gas consumption when changing the price of gas supply or distribution
1. For the final customer of the household category and the retail customer who collects gas in quantities exceeding 9 450 kWh / year, the gas consumption during the year shall be determined on the basis of the percentages allocated for each calendar month:

(a) in the case where a deduction or self-deduction of gas is made, where the self-reading operation of the distribution system operator allows, at a time other than the last day of the calendar month, the gas consumption shall be determined in a calendar month by adjusting the percentage to that calendar month in accordance with the table at this point according to the ratio of the number of calendar days in which the gas was delivered in the calendar month and falling within the invoicing period concerned and the total number of calendar days of that calendar month; the adjusted percentage of pui [%] for calendar month i is calculated using the formula
pui = piDi × Dd
where
i [-] is the serial number of the calendar month,
pi [%] is the percentage allocated to the calendar month i according to the table in point 1,
Di [-] is the total number of calendar days in calendar month i,
Dd [-] is the number of calendar days in which gas was delivered in the calendar month and which fall within the invoicing period,
(b) where the final customer makes a self-deduction when the price of the supply or distribution of the gas is changed and the distribution system operator allows the self-deduction to be carried out, the gas consumption shall be determined in the deduction period defined by the self-deduction or by regular deduction into the following self-deduction or periodic deduction, in which at least one change in the price of the supply or distribution of the gas (hereinafter "the period between deductions") has occurred, so that the amount of gas collected in the whole calendar month and falling into the period between deductions is calculated according to the formula

where
Q [kWh] is the quantity of gas collected over the period between the deductions falling within the invoicing period,
P [%] is the sum of the percentages assigned to all calendar months falling within the period between the deductions according to the table in this point, including the adjusted percentage referred to in point (a), where the period between deductions includes the calendar month falling within the invoicing period in which the gas was not supplied or distributed for all calendar days;
Pi [%] is the percentage attributed to the calendar month i in accordance with the table in this point or the adjusted percentage referred to in point (a) of this paragraph in the case of the calendar month covered by the invoicing period in which the gas was not supplied or distributed for all calendar days.
2. For the final customer of a household category and a retail customer who collects gas in quantities not exceeding 9 450 kWh / year, the gas consumption shall be determined by a uniform distribution of gas supply or distribution over the year. ';
This decree shall take effect on the day of its publication.
