Decree on the organisation of the training of new scientists

on the organisation of the training of new scientists
The needs for further development of science and research require that, between 1961 and 1965, the states of qualified researchers on a national average are more than doubled. In order to ensure that this task can be carried out, it is necessary to improve the existing organisation of the education of researchers in the aspirant sector and beyond the aspirant sector and to make the most of all available opportunities for education. To this end, the President of the Czechoslovak Academy of Sciences and the Minister of Education and Culture, pursuant to § 5 (2) (c) of Act No. 52 / 1952 Coll., on the Czechoslovak Academy of Sciences, as amended by Act No. 53 / 1957 Coll. and under § 22 (2) of the Act No. 58 / 1950 Coll., on universities, as amended by Act No. 46 / 1956 Coll., in agreement with the Minister of Finance, the Central Council of Trade Unions, the Chairman of the State Social Security Office, the State Commission for Scientific Positions and Heads of the other participating Central Authorities and Authorities and the Bureau of the Czechoslovak Academy of Agricultural Sciences:
Purpose and forms of training of new scientists
§ 1
The purpose of raising new scientists organised under this decree is to prepare for scientific research centres and universities a sufficient number of qualified staff with the rank of candidate of science, convinced supporters of Marxist-Lenin's world view, actively involved in the efforts of our working people to develop our society in a universal manner and to move towards communism.
§ 2
The preconditions for the education of new scientists are already established in schools where pupils and students are sought for theoretical activity and where their interest in scientific work is also encouraged. Scientific research centres co-operate with universities in the care of talented higher-education students, involve them in scientific research work and place university graduates at their posts recommended by the Faculty of Research.
§ 3
(1) The education of new scientists is organised in the following basic forms:
(a) scientific aspirant sound, external or one-year-old;
(b) the scientific preparation of selected staff of scientific research institutes at training centres and selected aspirants at universities directly during work on planned research tasks.
(2) Education in both of these forms ends with dissertation. *)
(3) Education is organised in fields in which scientific degrees can be obtained. * *)
§ 4
(1) External aspirants, selected staff of scientific research centres and selected university assistants (§ 3 (1) (b)) may be admitted to a half-year to two-year study visits to scientific research centres for the purpose of special training in scientific work or production and operation for practice (§ 19).

Training centres and trainers
§ 5
(1) The upbringing of new researchers takes place at the training centres of academics, universities and departments under the guidance of trainers. The Czechoslovak Academy of Sciences is designated by the training institutes and trainers in the academies of science and departments on the basis of a proposal from the participating central authorities and bodies. The Ministry of Education and Culture determines the training centres and trainers at universities.
(2) The management of the upbringing of new scientists is part of the training duties of the instructor at the training centre. * * *) One trainer should not normally be assigned to training more than five workers.
Selection and recruitment of tenderers
§ 6
(1) The workplaces for which new scientists are to be raised (hereinafter referred to as "maternity workplaces") seek appropriate staff and, if they cannot train them themselves, provide them with training at training centres.
(2) For the education of new researchers, researchers, university assistants and practitioners with higher education and, where appropriate, university graduates are selected directly after graduation. Candidates who comply with the requirements for staff of scientific research institutes and universities and who have demonstrated the preconditions for scientific activity may be accepted. In the clinical fields of medicine, a certificate of first degree specialisation is also required.
(3) Workers without higher education can only be accepted exceptionally if they can be proved by at least eight years of successful practice in the chosen field and scientific activities.
§ 7
(1) Training centres receive applicants for the training of new researchers on the basis of bankruptcy or on the basis of a proposal from the maternity centres.
(2) The staff applying for admission shall take the entrance exam at the training centre.
§ 8
(1) For study visits to scientific research centres, workers may be recruited on the basis of a proposal from the maternity centre or on the basis of bankruptcy.
(2) The training centre shall verify the qualifications of the staff applying for a study stay by an interview.
(3) For a study stay in production and operation, workers may only be recruited on the basis of a proposal from the maternity centre.
Education management and planning
§ 9
(1) The education of new scientific staff is organised by central authorities and bodies which manage scientific research centres and universities. To this end, they shall monitor the positions of scientists in their departments, draw up plans for the education of new researchers and ensure that these plans are implemented.
(2) The Czechoslovak Academy of Sciences, in cooperation with the Ministry of Education and Culture, coordinates the activities of the central authorities and authorities in ensuring the upbringing of new scientists.
(3) The Czechoslovak Academy of Sciences, in cooperation with the Ministry of Education and Culture, checks the course and results of education and takes measures to ensure assistance to departments in education.
§ 10
(1) The plan to raise new scientists is part of the national five-year plan for the development of the national economy.
(2) The annual plans for the education of new researchers in the field of academia of sciences and departments are approved by the Presidium of the Czechoslovak Academy of Sciences and, as regards higher education, by the Minister of Education and Culture.
(3) Methodological guidelines for the drawing up of plans for the education of new scientists are published by the Czechoslovak Academy of Sciences in an agreement with the State Planning Commission and the Ministry of Education and Culture.
Legal status of staff recruited for education
§ 11
(1) A sound scientific aspirant is not employed for the duration of the scientific aspirant; However, its rights and obligations towards the training centre shall be assessed mutatis mutandis in accordance with the principles applicable to staff members, unless otherwise provided for in this Decree.
(2) Sickness insurance and pension insurance for ordinary scientific aspirants are governed by the rules in force. *)
(3) A proper scientific aspirant shall be entitled, in each calendar year, to a period of leave corresponding to the leave for recovery determined in accordance with § 2 (1) -4 of Act No. 81 / 1959 Coll., on paid leave for recovery to which he would otherwise be entitled as an employee of the training centre.
§ 12
External aspirants study at work. In order to carry out experimental or other studies, candidate examinations and to defend candidate dissertation according to their study plan, they shall be entitled to paid leave of absence. The length of leave shall be agreed with the external aspirant's employer within a maximum of 30 working days in the school year. This is without prejudice to the legal right of an external aspirant to a recuperation holiday.
§ 13
In a one-year aspiration, the employer shall provide the one-year aspirant with paid leave of absence for the time required to successfully complete the study tasks.
§ 14
The scientific preparation of selected staff of research institutes and university assistants directly during work on planned research tasks shall be carried out as part of their duties.
§ 15
Applicants for admission to the upbringing of new researchers invited to the admission examination shall be entitled to paid leave of absence for a maximum period of three days.
§ 16
The activity of a worker admitted to a study stay shall be considered as the work of an employer. The employment relationship shall not be interrupted; the employer shall only release the worker for an appropriate period of time from the work at the workplace.
§ 17
If scientific research institutes conclude employment contracts with university graduates recommended by the faculties for research, they do so for a pre-arranged period, usually for two years.
Scholarships
§ 18
(1) The central authorities and authorities provide a scholarship to sound scientific aspirants who are trained for their needs. The amount of the scholarship shall be determined by the Government; * *) the condition of the grant shall be that the aspirant is obliged to work for three years at the workplace on which he will be located after a specified period of aspiration.
(2) In the absence of work for sickness, injury and in the case of aspirants also for pregnancy or motherhood it is not for a proper scientific aspirant scholarship from the first day of absence at work.
(3) During the period of leave of employment (Section 11 (3)), a scholarship belongs to a sound scientific aspirant.
§ 19
(1) Workers who have been admitted to study for a period of six months to two years are entitled instead of a salary a scholarship equal to the average gross monthly salary paid by the worker in the previous three months, but not more than 2500, - Kčs monthly.
(2) The scholarship referred to in paragraph 1 shall be paid to a staff member seconded to his / her place of study by means of the means allocated to him / her by the central office or authority.
(3) The staff admitted to study on the basis of bankruptcy are awarded a scholarship to a training centre through their employer.
Financial security
§ 20
(1) Funding for scholarships for sound scientific aspirants, as well as for the security of staff admitted to study stay, is planned in their budgets *) with the approval of the Ministry of Finance and after the opinion of the Czechoslovak Academy of Sciences; the funding for scholarships for sound scientific aspirants trained for the needs of the Ministry of Education and Culture shall be provided in its budget by the Ministry of Education and Culture.
(2) Other personal expenses (travel expenses, remuneration, if any, for external trainers, etc.) are paid for staff seconded to education or to study stay by their maternity centres; the staff recruited following bankruptcy shall be reimbursed by the training centre. * *)
§ 21
The method of reimbursement of material costs which may arise in connection with experimental work in the training of new researchers shall be agreed on a case-by-case basis by the training centre with the maternity centre.
Final provisions
§ 22
Details of the education of new scientific staff are governed by the Study Regulations published by the Czechoslovak Academy of Sciences together with the Ministry of Education and Culture.
§ 23
The mandate of the President of the Czechoslovak Academy of Sciences and Minister of Education and Culture under this decree is exercised by the Minister of National Defence, in agreement with the President of the Czechoslovak Academy of Sciences and the Minister of Education and Culture, on the section of military universities and relevant military research centres.
§ 24
The Order of the Minister of Education and Culture and the President of the Czechoslovak Academy of Sciences No 73 / 1958 of the Ú. l., which sets out the organizational and study rules for scientific aspirants, is hereby repealed; The scientific aspirant begun before 1 January 1961 will be completed according to the existing regulations.
§ 25
This Decree shall take effect on 1 January 1961.

* *) The scholarship of ordinary scientific aspirants is (a) for aspirants with previous experience in the field of less than two years 1100, - for single and childless and 1200, - for those with children, (b) for aspirants with previous experience longer than two years 1400, - for single and childless and 1600, - for those with children. Prior experience in the field shall be understood as the practice held after the completion of university studies. Exemptions are permitted at the universities of the MŠK, in the institutes of the Bureau of the relevant Academy of Sciences or the competent central office. The amount of 500, - Cčs (paragraph 2 (a) of MF Decree No. 369 / 1952 Ú. l.) is exempt from the payroll tax.
