of 31 January 2018
on animal health requirements for bee and bee keeping and on measures to prevent and control certain bee diseases and amending certain related decrees
The Ministry of Agriculture provides pursuant to Article 78 of Act No. 166 / 1999 Coll., on Veterinary Care and on the amendment of certain related laws (Veterinary Act), as amended by Act No. 131 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 48 / 2006 Coll., Act No. 182 / 2008 Coll., Act No. 227 / 2009 Coll., Act No. 308 / 2011 Coll., Act No. 359 / 2012 Coll., Act No. 279 / 2013 Coll., Act No. 139 / 2014 Coll., Act No. 264 / 2014 Coll., and Act No. 302 / 2017 Coll., ("Act ') for the implementation of Section 5 (6) and (f), Section 6 (8), Section 10 (3) (f), § 64c (a) and § 70 (a):

VETERINARY REQUIREMENTS FOR CONSUMPTION AND INSPECTION AND MEASURES FOR PREPARATION AND RECURRENCE OF CERTAIN DISEASES
§ 1
Subject matter
This decree provides
(a) animal health requirements for the environment of bees and hives, for their treatment and protection against diseases;
(b) the limit on increased mortality of hives, over which breeders are required to report these deaths to the county veterinary authorities;
(c) the conditions for issuing the animal health certificate for the movement of hives and its content;
(d) measures to combat and prevent the spread of certain dangerous diseases in bees;
(e) the scope of the inspection of hives, with the disassembly of the bee work and the keeping of records of the bee monitor;
(f) in more detail, the procedure for applying the reimbursement of costs and losses incurred as a result of the implementation of the emergency veterinary measures ordered to combat one of the dangerous diseases and diseases communicable from animals to humans pursuant to Section 67 of the Act and the formalities for requesting it.
§ 2
Definition of terms
For the purposes of this decree:
(a) they had a composite sample of all of them, taken from hives at one colony site;
(b) apiculture accessories, in particular hives, storage plaques, land, apiculture equipment and instruments used in the handling of bees and their products.
§ 3
Veterinary requirements for bee and bee keeping
The breeder creates favourable conditions for bees and hives and for their health in terms of the environment in which they live, their treatment, nutrition, breeding, economic and other use by:
(a) keeping bees and bees in establishments where bees and bees only come into contact with materials which cannot harm their health or, where appropriate, adversely affect the health of their products and which can be properly cleaned and disinfected,
(b) keeping bees and hives in establishments which allow the health check to be carried out by analysis of the bee's work and by inspection of the honeycomb and allow sampling for laboratory examination;
(c) protect bees and colonies against diseases and harmful effects and take measures to protect breeding against the introduction of diseases by other bees, animals, humans, objects and materials which may bear disease agents;
(d) carry out regular checks on the health status of bees and hives and provide appropriate treatment to bees, if necessary;
(e) in the processing of wax for the manufacture of intermediate walls or for any other purpose in which the processed wax comes into contact with bees and hives, ensures its treatment at a minimum temperature of 117 ° C for 60 minutes;
(f) obtain new bees or hives only from the breeding of bees or hives located outside the outbreaks or protection zones of dangerous diseases of bees; and
(g) it prevents bees from entering unoccupied hives and bee parts and keeps the hives empty without the bee work.
§ 4
Replacement of bees and hives and veterinary certificates
(1) The Regional Veterinary Administration may, at the request of the breeder in writing, issue a health certificate for the movement of bees or hives outside the territory of the region where:
(a) a laboratory examination has been carried out no more than 12 months before the movement showing a negative result for the presence of the agent of bee fever;
(b) on the last examination of the composite sample they had:
1. no more than 3 Varroa destructor mites have been detected on average per colony after an ordered and performed preventive or therapeutic treatment; or
2. no more than 3 Varroa destructor mites have been detected on average per colony.
(2) The model health certificate for the movement of hives outside the territory of the county is set out in the Annex to this Regulation.
§ 5
Limit of increased mortality of hives
The limit of increased mortality of hives, over which breeders are required to report these deaths to the regional veterinary administration, shall be the mortality of more than 25% of hives from the number of hives registered in the central register as at 1 September of the preceding year at that colony station.
Varroasis control and control measures
§ 6
The Regional Veterinary Administration shall, in accordance with Article 13 of the Act, carry out an on-the-spot investigation to confirm or exclude the presence of varroasis where the presence of varroasis is suspected on the basis of:
(a) the presence of more than 10 Varroa destructor mites on average per colony detected by the laboratory examination of the composite sample, or
(b) the reported mortality of more than 25% of hives from the number of hives registered in the central register on 1 September of the preceding year at the hives unit concerned.
§ 7
If the Regional Veterinary Administration confirms the presence of varroasis in accordance with Article 15 of the Act, it shall define hives as an outbreak of the disease and shall order the breeders in that outbreak of protection and control measures which are:
(a) the immediate treatment of all hives in an outbreak of the disease by the type of medicinal product;
(b) removal of the bee's work from the colony and the creation of conditions for the construction of the new work;
(c) removal of the closed tube fruit, removal of the closed and open bee fruit, removal of the closed worker's fruit or treatment of the closed bee fruit;
(d) breeding of bees with good cleansing instinct; and
(e) a prohibition on the movement of bees and bees.
Measures to control and control the pestilence and rot of the bee fruit
§ 8
If there is a suspicion of a plague or festering of a bee's fruit, the Regional Veterinary Administration in accordance with Section 13 of the Act
(a) carry out a clinical examination of all bee colonies at the post with the disassembly of the bee's work;
(b) to be taken for laboratory examination
1. samples of mantle with clinical changes found in the fetus or samples of mantle with defects detected; in the event of a suspected occurrence of bee fouling, take a sample of the bees treating the foetus at the same time,
2. they had samples or honey stocks in case of suspected presence of bee fever, if no live bees are present in the hive and no pups are detected; or
3. Samples have been taken or the mantle in the event of a suspected occurrence of deformation of the bee's fruit, unless live bees are present in the hive hive and the waterworks are detected,
(c) order the breeder:
1. clearly and unmistakably identify and document all hives at the hives by numbers, if not marked;
2. the prohibition on the movement of bees and hives, including the coats, hives and their parts, as well as any apiculture accessories which have come into contact with bees, hives or their products from the designated hives' habitat;
3. a prohibition on the use of honey which comes from hives with a suspicion of the presence of pestilence or foulness of the bee fruit, or of honey the proportion of which makes up honey from hives with a suspicion of such diseases, for the feeding of bees; and
4. to draw up and transmit to the Regional Veterinary Administration a list of apiculture accessories which have come or may have come into contact with bees or bees from a post suspected of being infected with pestilence or foulness of the apiculture including an indication of the actual number of hives at the post; the inventory shall contain the breeder's registration number, the location of the hives, the location of the apiculture accessories and the quantity in pieces or kilograms; and
(d) carry out an epidemiological inquiry in which to detect:
1. the period during which the disease may have occurred at the colony site before it was declared or suspected to occur,
2. the possible origin of the disease at the hives and identify other hives where the bees or hives are likely to be suspected; and
3. whether the movements of bees or hives and apiculture accessories which may carry the disease agent have taken place from or to the hives.
§ 9
Suspected of being infected with bee fever or rot shall be excluded if a negative result has been demonstrated by laboratory testing of samples taken in accordance with § 8 (b).
§ 10
(1) The outbreak of plague or of bee festering is confirmed if
(a) clinical signs of infection in the foetus; or
(b) coats and cloths
at the same time, the laboratory examination of the samples taken pursuant to § 8 (b) shall show a positive result.
(2) The presence of plague or bee festering is confirmed even in the case of a proven positive result of laboratory testing of samples of honey stocks, coats or had been taken in accordance with § 8 (b) from a hive which is not occupied by bees.
§ 11
(1) If the presence of plague or festering of bee fruit is confirmed, the Regional Veterinary Administration, in the framework of the implementation of conservation and control measures, in accordance with Article 15 of the Law, shall:
(a) define hives as an outbreak and establish a protection zone within a radius of at least 3 km around the outbreak, taking into account epidemiological, geographical, biological and ecological conditions;
(b) carry out a clinical inspection of the bee colonies with the disassembly of the bee's work at the bee's habitats in the demarcated protection zone where the bacteriological examination of the composite samples provided for in paragraph 2 (a) showed a positive result;
(c) order the breeder to have an outbreak
1. with a confirmed outbreak of bee fever in 15% or more hives, the immediate killing of all hives at the post, including the destruction of hives and the disposal of all apiculture accessories, unless effective disinfection, in particular in the case of metal objects, can be ensured, with the previous or subsequent burning of the flame; This does not apply to buildings and structures of beekeeping and nomadic cars; or
2. with a confirmed outbreak of bee fever in less than 15% of hives, the immediate culling of all bees with confirmed disease, including the destruction of hives and all apiculture accessories, where they cannot be effectively disinfected, and at the same time effective disinfection of other apiculture accessories which have come or may have come into contact with bees with confirmed disease; on the basis of the examination of the health status of other hives at the post and the results of the epidemiological inquiry, the Regional Veterinary Administration may order the destruction of all hives at the post,
3. immediately after the culling of the hives to ensure that the hives are closed,
4. after the culling of the hives, carry out the destruction of the hives by burning and simultaneously disposing of the specified apiculture equipment according to an inventory drawn up in accordance with § 8 (c) (4) and set the date of disposal; the destruction of hives and apiculture accessories shall be carried out in the presence of a disposal panel designated by the Regional Veterinary Administration; a record of the liquidation of the panel, including a list of all destroyed apiculture accessories,
5. a prohibition on the use of all honey coming from a colony site as defined in point (a) or a honey part of which consists of honey from a colony site as defined in point (a) for the feeding of bees;
6. use disposable protective gloves when handling hives and apiculture accessories and perform hand, clothing and footwear disinfection upon completion of the handling;
7. to disinfect non-combustible material, apiculture accessories according to an inventory drawn up in accordance with § 8 (c) (4) and beekeeping and nomadic vehicles under specified conditions,
8. carry out further necessary measures for the remaining hives at the post-killing site of all hives referred to in point 2, sweep the hives into divisions into new or disinfected hives for construction frames or hives treated in a hot paraffin bath at a minimum temperature of 160 ° C for 10 minutes, remove the bee's work from the hives and create conditions for the construction of a new work, remove the coats from the original hives and dispose of all the bee's fruit, remove and dispose of the amniotic hair or ban on the assembly of bees; and
9. the disposal or treatment of honey, wax, propolis and royal porridge originating from an outbreak of the disease, in accordance with the provisions of the directly applicable European Union Regulation laying down health rules concerning animal by-products and derived products not intended for human consumption (1).
(2) Regional veterinary administration in the protection zone to breeders
(a) they shall order the collection of samples of bees treating the foetus or the collection of samples from all hives at the hives and shall fix the date of their submission to the laboratory referred to in Article 52 (3) of the Act for bacteriological examination on the agent of the pestilence or rotting of the bee's fruit, unless such examination has already been carried out within the last 12 months; each individual sample consists of the mixing of bees or having, from a maximum of 10 hives at the beehives site; and
(b) prohibit the movement of bees and bees from the protection zone; the movement of bees and bees within the protection zone is only possible with the agreement of the Regional Veterinary Administration, issued at the request of the breeder, supported by the negative result of the laboratory examination of the composite sample, had on the producer of the pestilence or rot of the bee foetus not more than 12 months old.
(3) If, within a period of 1 year from the date of killing of the hives in an outbreak of bee fever referred to in paragraph 1 (b), they occur. (c) point (2) for the re-confirmation of the presence of bee fever or rot, the Regional Veterinary Administration shall order the slaughter of hives and the destruction of apiculture accessories referred to in paragraph 1 (b). (c) point 1.
(4) The Regional Veterinary Administration which has ordered protection and control measures in the protection zone will cease these measures.
(a) not earlier than 6 months after the date of disposal of the killed hives and the destruction of apiculture accessories in an outbreak where the protection and control measures provided for in paragraph 2 have been complied with in the protection zone and all samples taken pursuant to paragraph 2 (a) show a negative result; or
(b) not earlier than 12 months after the date of destruction of hives and apiculture accessories in an outbreak, unless the protection and control measures referred to in paragraph 2 have been complied with in the protection zone.
§ 12
Scope of the inspection of hives with the disassembly of the bee work and the keeping of records of the bee monitor
(1) A beekeeper shall examine all the hives at the beekeepers' station and, where appropriate, the bee works, which do not sit at the time of the inspection, because they have died in the previous 12 months.
(2) When disassembly of the bee's work, the viewer opens the hive and gradually takes out all the coats with the fruit and individually visually assesses all parts of the bee's work where the fruit is found. The bee monitor shall assess the structure of the closed fetus, the gap in the fetus, the shape and colour of the individual cells and the content of the cells after they are unveiled.
(3) In case of suspected infection of the bee's fruit, the bee-seer
(a) take a sample for laboratory examination and arrange for its dispatch for laboratory examination; and
(b) ensure a clear and unmistakable designation of the hive from which the colony from which the sample is taken for laboratory examination originates.
(4) The beekeeper shall make a written record of the inspection carried out at the post. The record shall contain:
(a) the name, surname and number of the certificate of inspection of the bees;
(b) the date and time of the inspection;
(c) the registration number of the bee-keeper, the registration number of the hives and the number of hives at the hives,
(d) the result of the inspection, indicating the result of the visual assessment of all parts of the bee's work, the number of samples taken and their identification; and
(e) the signature of the beekeeper.
§ 13
Application for reimbursement of costs and losses
(1) The application for reimbursement of costs and losses incurred in relation to a dangerous disease (hereinafter referred to as "the application") contains, in addition to the formalities laid down in the Administrative Regulation (2)
(a) the applicant's account number;
(b) the applicant's registration number; and
(c) the applicant's tax identification number, if any.
(2) The applicant shall accompany the application
(a) confirmation by the Regional Veterinary Administration that costs and losses have been incurred or, where appropriate, that hives have been killed in circumstances which give rise to entitlement to reimbursement of costs and losses and that the costs have been incurred effectively; and
(b) evidence of the amount of costs effectively incurred and the amount of losses incurred.

§ 15
Decree No 342 / 2012 Coll., on animal health and protection, on the movement and transport of animals and on the authorisation and competence to carry out certain professional veterinary activities, as amended by Decree No 429 / 2013 Coll., Decree No 313 / 2014 Coll. and Decree No 164 / 2016 Coll., is amended as follows:
1. In Article 4 (6), the last sentence is deleted.
2. In Paragraph 14 (2), the words "or, if it is a bee breeder, the bee breeder's registration number 'are deleted.
3. Annex 2 shall be deleted;

1) Regulation (EC) No 1069 / 2009 of the European Parliament and of the Council of 21 October 2009 laying down health rules concerning animal by-products and derived products not intended for human consumption and repealing Regulation (EC) No 1774 / 2002 (Animal by-products Regulation), as amended.
2) § 37 (2) and § 45 (1) of Act No. 500 / 2004 Coll., Administrative Code, as amended.
