DECLARATION
of 5 January 2009
amending Decree No. 369 / 2004 Coll., on the design, implementation and evaluation of geological works, the notification of risk factors and the procedure for calculating stocks of exclusive bearings
According to Article 26 (1) of Act No. 62 / 1988 Coll., on Geological Works, as amended by Act No. 543 / 1991 Coll. and Act No. 366 / 2000 Coll., for the implementation of Sections 9 (3) and 10 (2) of Act No. 62 / 1988 Coll., on Geological Works, as amended by Act No. 543 / 1991 Coll.:
Čl. I
Decree No. 369 / 2004 Coll., on the design, implementation and evaluation of geological works, the notification of risk factors and the procedure for calculating stocks of exclusive bearings, is amended as follows:
1. In the second sentence of Article 6, the words "or to mitigate the effects of an imminent accident or natural disaster 'are replaced by the words" immediately threatening environmental harm 16a), accident 16b), serious accident 16c) or natural event'.
footnotes 16a, 16b and 16c read:
"16a) Act No. 167 / 2008 Coll., on preventing and correcting environmental damage and amending certain laws.
16b) § 40 of Act No. 254 / 2001 Coll., on Water and on the amendment of certain laws (Water Act).
16c) Act No. 59 / 2006 Coll., on the prevention of major accidents caused by selected hazardous chemicals or chemicals and amending Act No. 258 / 2000 Coll., on the Protection of Public Health and on the amendment of certain related acts, as amended, and Act No. 320 / 2002 Coll., on the amendment and repeal of certain laws in connection with the cessation of the activities of district authorities, as amended, (Act on the prevention of major accidents), as amended. '
2. In Article 16 (1), at the end of the second sentence, the words "and reports on the survey of anthropogenic rock pollution 'shall be inserted.
3. In Article 16, the following paragraph 4 is inserted after paragraph 3:
"(4) The final report on the survey of anthropogenic rock pollution shall be drawn up in accordance with Annex 11.";
Paragraphs 4 to 9 shall be renumbered paragraphs 5 to 10.
4. The following Annex 11 is inserted after Annex 10:

3. Copies of relevant permits and administrative decisions (e.g. copies of a permit for water management where the management of water in a geological survey required such authorisation)
4. a copy of the protocols on the disposal of technical works signed by the owner or the tenant of the land
5. photodocumentation
6. a copy of the summary dossier in digital form. ';

This Decree shall take effect on 1 February 2009.
