laying down requirements for protection against explosions of flammable gases and vapours
The Czech Labour Safety Authority pursuant to § 5 (1) (d) of Act No. 174 / 1968 Coll., on State Professional Safety Supervision, and the Czech Mining Authority pursuant to § 57 (1) (d) of Act No. 41 / 1957 Coll., on the Use of Mineral Wealth (Upper Law), and pursuant to § 10 (a) of the Czech National Council Act No. 24 / 1972 Coll., on the organisation and extension of supervision of the State Mining Administration, provides in an agreement with the Czech Trade Union Council and the relevant central bodies:
Preliminary provisions
(1) The Decree lays down the obligations of organisations subject to the supervision of national professional labour safety and surveillance authorities of the State Mining Administration (1) when operating equipment with the risk of explosion of flammable gases and vapours.
(2) The decree does not apply to 2)
(a) combustion plants for the distribution and consumption of gases;
(b) combustion plants for the consumption of liquid fuels;
(c) gas and liquid containers;
(d) gas pressure stations;
(e) deep-sea mining and exploration mines and their associated underground mining works;
(f) underground gas and liquid containers in natural rock structures.
Interpretation of terms
For the purposes of this decree, it shall be considered as:
(a) an explosion hazard device (hereinafter referred to as "equipment") such a device in which flammable gases or vapours are present which may form an explosive mixture;
(b) spaces with explosion risk (hereinafter referred to as "premises") such as those in which the equipment is located or those in which the explosive mixture may be formed, 3)
(c) work on equipment or premises where tools, tools, machinery and apparatus are used, which may cause the explosion of an explosive mixture, or where an explosive mixture may occur;
(d) an explosive mixture such a mixture of flammable gases or vapours with air (or other oxygenant) that, after initiation, an explosion occurs, or a gas capable of decomposing an explosion.
Principles of protection against explosions
(1) Organisations are required to take precautionary measures to avoid explosive mixtures when operating and working equipment. If the explosive mixture cannot be prevented, precautions must be taken to prevent the explosion initiation.4)
(2) If, despite the measures taken pursuant to paragraph 1, the risk of explosion cannot be prevented, measures shall be taken to reduce its adverse effects (e.g. removal of workers, removal of dangerous substances, inertization, use of anti-explosive devices).
Requirements for the design, location and operation of equipment
(1) The equipment must be protected against adverse effects of static and atmospheric electricity and misguided electric currents. 5)
(2) The device shall be so secured that the method or effects of its operation (e.g. temperature, pressure) cannot cause an explosion.
(3) Equipment in which the explosive mixture is present during operation and the risk of explosion (e.g. inert, exclusion of initiation) is not prevented, must be ensured against the adverse effects of the explosion (e.g. by releasing pressure in an explosion into the open space).
(1) Devices can only be located where perfect ventilation is ensured in a natural or forced way. 6)
(2) The presence of flammable gases or vapours shall always be checked by the organisation when the equipment is put into service or when the flammable gases or vapours are suspected to escape from the installation. In built-in areas, the organisation shall check their occurrence at least once a month.
(3) Equipment in which liquefied flammable gases are produced or stored, or spaces in which such devices are permanently located, shall be equipped with indicators of changes to the characteristics of the environment relevant to the safety of operation and operation (e.g. concentration of flammable substances).
(1) The organisation is required to draw up local operating rules for the operation of facilities, which must include:
(a) the brief characteristics of the substances and sites (s) used which pose an increased risk of explosion;
(b) instructions for the operation of equipment, setting and testing of safety, regulatory, measuring and signalling equipment;
(c) safety and fire-fighting measures when the equipment is put into service or when it is withdrawn;
(d) the manner in which cleaning works are carried out;
(e) the scope and time limits of the checks;
(f) time limits for carrying out revisions and tests;
(g) time limits, scope and method for detecting the presence of flammable gases and vapours on premises;
(h) arrangements for the formation of an explosive mixture or risk of explosion, including the means of leaving the workplace, the provision of first aid and measures to remedy the consequences of the explosion, 7)
(i) a list of works the execution of which requires an order (§ 8).
(2) The organisation must register the establishment.
Professional competence of staff
(1) The organisation is required to inform the personnel responsible for operating the equipment with local operating rules, workplace fire regulations, alarm guidelines or emergency plans, as appropriate, and must train them in the service of the installation. Before entrusting a separate operator to an installation, workers shall be tested from the theoretical and practical knowledge of the operator of the installation.
(2) The organisation shall determine the content and duration of the training according to the nature of the establishment and the extent of the activity carried out and verify the knowledge of operators by examination at least every three years.
(3) Only personnel who have been trained and informed by the organisation to the extent of their activities with regard to the operation of equipment and related safety regulations may work on the facilities.
(4) The provisions of paragraphs 1 to 3 are without prejudice to the provisions of other provisions, 8) which determine the professional competence of workers.
Work on equipment and on premises
(1) Works on equipment and on premises may only be carried out on the basis of a written order issued by a worker authorised by the organisation.
(2) The command shall contain:
(a) the name, surname and capacity of the worker responsible for carrying out the work;
(b) the description of the workplace and the working group to carry out the work, the type of work and the duration of the order;
(c) the method of checking and securing workers and workplaces during the period of work and, where appropriate, the method of checking the workplaces after work is completed;
(d) warning of threat;
(e) preventive safety and fire-fighting measures by type of work and safety and fire-fighting measures in the event of a threat.
(3) Before the work begins, the organisation shall inform the workers who will carry out the work with the content of the order for work and warning signs indicating the presence of flammable gases and vapours.
(4) Before commencing work, the organisation shall provide the personnel with prescribed personal protective equipment, tools, tools, machinery and apparatus, and in accordance with the measures specified in the order for work, safety equipment, isolation breathing apparatus, extinguishing, rescue and emergency assistance.
(5) Work may only be started after the preventive safety and fire-fighting measures specified in the order for work have been complied with.
(6) Work on equipment must be carried out under the permanent supervision of the responsible officer, who is aware of the correct and safe way of carrying out the work and who is able to implement the prescribed measures when there is a threat. At the same time, they must check the use of prescribed personal protective equipment, tools, tools, machinery and equipment.
(7) Personal protective equipment and measuring and signalling equipment used in works where explosive mixtures may occur shall not be the initiator of the explosion.
(8) In works where explosive mixtures may occur, tampering with materials that could trigger an explosion (e.g. mechanical spark, static electricity discharge) is prohibited. In the event that heat energy is generated in these works, it shall be so removed as to avoid the initiation of the explosion.
(9) In the case of works where an explosive mixture may occur, the surface temperature of the device without the risk of explosion in the premises shall not exceed a temperature lower by 10% (but at least 10 °) than the lowest ignition temperature of the explosive mixture.
(10) If it is not possible to prevent the formation of an explosive mixture, only tools, tools, machines and apparatus which are made so that, when used or in contact with the material, they do not cause the initiation of the explosion ("non-explosive design ') shall be used. If the non-explosive design of the tools is secured by a protective non-sagging layer, the integrity of that layer shall be examined 9) at least every three years. It is prohibited to use tools and tools whose protective non-sparking layer is broken.
(1) Only after the oxygen content has been determined and work in equipment and in premises where tools, tools, machinery and apparatus are used, which may cause explosion, can be used only after detection of substances forming an explosive mixture in the working area.
(2) The characteristics of the environment (in particular the concentration of the flammable substance) when performing the work in the premises and premises must be checked throughout the duration of the work.
(3) When increasing the concentration of flammable gases and vapours during work over 25% of the lower explosive limits, work must stop and workers must leave the work area.
(4) Input shall be prohibited in spaces where the concentration of flammable gases and vapours exceeds 50% of the lower explosive limit.
(5) The provisions of paragraphs 3 and 4 do not apply to cases in which the possibility of explosion is removed (e.g. inert).
(6) If gases or vapours are also harmful and their concentrations exceed the maximum permitted concentrations, 10) the worker entering the facility must be familiar with this and, in addition to the prescribed personal protective equipment, they must be equipped with respiratory protection, a safety belt with a hinge in the back, 11) a rope and be secured by another worker. The other end of the rope must be secured in a safe place.
(7) During work on equipment, sufficient oxygen (min. 19%) must be provided in the working area, otherwise the worker must use an insulating breathing apparatus. The working space shall not be ventilated with oxygen.
(8) The organisation shall inform the operator of the operation before the work begins.
(1) The organisation is required to undertake training before being assigned to work or by a separate operator
(a) workers using insulating breathing appliances in the manufacture of works;
(b) operators of equipment and personnel performing work and activities in emergency situations in the implementation of measures to reduce the adverse effects of the explosion.
(2) The training of these workers should be repeated at least once a year.
(3) The scope and manner of training shall be determined by the organisation.
The organisation shall draw the supplier's attention to the hazards arising from the nature of the installation. This shall be without prejudice to the responsibility of the supplier for the implementation of security measures resulting from the nature of the work.
Efficacy
This Decree shall take effect on 1 June 1987.
