on the inspection of the public order of national committees
The Government of the Slovak Socialist Republic orders pursuant to Paragraph 6a (3) of Act No. 69 / 1967 Coll., on National Committees, as amended by the Act of the Slovak National Council No. 159 / 1971 Coll.:
A national committee in a city with more than 20 000 inhabitants or in a municipality whose district is a significant *) spa place may set up an inspection of the public order of the national committee (hereinafter referred to as "inspection ') to ensure local public order matters. Any other municipal national committee or local national committee may do so only with the agreement of the Regional National Committee Council after the advice of the Regional National Committee.
(1) Inspections shall carry out the following tasks:
(a) supervise the maintenance by citizens and organisations of the regulations on the protection of public policy, the implementation of which falls within the competence of the national committee, draws attention to the shortcomings identified, takes measures to eliminate them;
(b) carry out the tasks assigned to it by the national committee in the security of local public order matters within its competence;
(c) take measures to prevent offences in matters of public order and help to eliminate their causes;
(d) notify the competent authority of the national committee of the offences detected in the performance of its duties.
(2) Inspections in particular:
(a) supervise the maintenance of order, purity and hygiene on the streets and other public areas, in publicly accessible buildings and to the extent specified by the national committee, as well as the protection of air against pollution;
(b) monitor that the streets and other public areas are properly lit;
(c) monitor the state, proper maintenance and cleaning of public walkways and roads;
(d) oversee the correct identification of dangerous places and the timely removal of general dangerous disturbances and defects in public spaces;
(e) monitor that public utility establishments are not damaged or destroyed;
(f) check that citizens and organisations have prescribed permits to carry out stalls and other outpatient sales and that the conditions for such sales are complied with;
(g) checks that citizens and organisations are authorised to carry out works, excavations, the composition of materials, goods, packaging, etc. in public spaces, to determine whether the conditions and time limits laid down for such works are respected;
h) oversees the compliance with the prohibition on the administration of alcoholic beverages to young people in hospitality and catering establishments, *) drivers and drunk persons;
(ch) ensure that the opening and closing hours are observed in shops, premises, sales stands, etc., and that they are not closed without authorisation;
(i) monitor the correct use of the national flag, national emblem and city emblem and their colours;
(j) monitor compliance with the prohibition of visiting theatrical and film performances by minors;
(k) to check compliance with order and security measures in spa and recreational facilities and premises.
(1) The inspection is a special service of the National Committee which established it.
(2) The organisation and tasks of the inspection, the duties of the head of inspection and the relations of the inspection with the authorities of the national committee shall be governed by the rules of organisation to be issued by the national committee.
(3) In issuing the Organising Regulations, the National Committee shall be based on the Model Organisational Regulations issued by the Ministry of the Interior of the Slovak Socialist Republic ("the Ministry of Interior '); the national committee shall take into account the scope of the inspection tasks arising from the needs of the city or municipality.
(1) An inspection worker can become a Czechoslovak national over 21 years old, committed to a socialist social establishment, upstanding and physical and mentally competent for the tasks of an inspection worker.
(2) The inspection staff may carry out their duties only after the promise has been made. The promise is: "I promise in my honour and conscience that I will actively contribute to the protection of public order; in my activities, I will comply with the laws and other laws, maintain state and professional secrecy, carry out consistently and accurately the commands and instructions of my superiors and carry out my duties conscientiously and properly. '
(3) The pay ratios of inspection staff shall be adapted by a separate regulation.
(1) For inspection staff, the uniform and rank shall be established in accordance with the model and degrees established by the Ministry of Interior.
(2) The inspection staff shall be visibly marked on the left-hand sleeve of the inspection when carrying out their duties. The tape is blue, 105 mm wide, with yellow letters "IVP" of height 35 mm and width 20 mm and bearing a round stamp of the national committee.
(3) In carrying out their tasks, inspection staff shall be public officials.
(1) The inspection staff shall be entitled to:
(a) to call on the citizen to refrain from acting in violation of public policy;
(b) to remind the citizen in the place of the public order;
(c) to invite a citizen who has grossly violated public policy in order to prove his identity and, if he cannot prove it in a credible manner, to bring him to the National Committee or, where appropriate, to the Public Security Service;
(d) require clarification from anyone who can help to clarify the facts necessary to establish an infringement to ensure evidence;
(e) impose and collect fines in block proceedings on the basis of mandates of the district (city) national committee for offences detected in the course of service.
(2) The inspection staff shall, in particular, apply the means of education and prevention in the performance of their tasks; the operation is carried out only if it is strictly necessary and a successful outcome can be expected from it, in a manner appropriate to the circumstances.
Inspection personnel shall be required:
(a) maintain laws and other laws in the performance of tasks, comply conscientiously with the orders and instructions of the superiors; to act with discretion and politeness and respect the seriousness, honor and dignity of citizens,
(b) report without delay to its directly superior the defects and deficiencies which threaten or impede the performance of the activity and the imminent damage;
(c) action if damage is imminent and urgent action is needed to prevent it; need not do so if they are prevented by an important circumstance or would put themselves or other persons at serious risk;
(d) maintain confidentiality regarding the facts which they have learned in connection with the performance of their tasks and which require them to remain secret from unauthorised persons in the general interest or in the interests of interested parties, unless they are expressly exempt from this obligation by the national committee.
The inspection shall cooperate in ensuring the protection of public policy as directed by the National Committee with the relevant Public Security Territory Service; in the performance of its tasks, it shall also cooperate with other authorities, in particular the air purity authorities *) and with the health service authorities. * *)
(1) Everyone is obliged to follow the instructions and calls of the staff to the inspections they issue in the performance of their tasks.
(2) The inspection staff shall, when carrying out their duties, demonstrate upon request by means of an inspection document issued by the National Committee in accordance with the model established by the Ministry of Interior.
National committees which have already set up an inspection before the application of this Regulation shall adjust its organisation and activity in accordance with this Regulation.
This Government Regulation shall enter into force on the day of its publication.
