of 13 June 2017
amending Decree No. 370 / 2002 Coll., on the lawful production of a gas weapon, expansion weapon and ammunition
According to § 79 (4) of Act No. 119 / 2002 Coll., on firearms and ammunition (Act on Weapons), as amended by Act No. 229 / 2016 Coll.:
Amendment of the Decree on the lawful production of gas weapons, expansion weapons and ammunition
Decree No. 370 / 2002 Coll., on the permitted production of a gas weapon, expansion weapon and ammunition, is amended as follows:
1. In the title of the Decree, the words "and the requirements for the modification of a weapon for film or theatre activities' shall be added after the word" ammunition 'and repealing certain Regulations of the Ministry of Industry and Trade'.
2. The opening sentence is worded as follows: "The Ministry of Industry and Trade provides, pursuant to § 79 (4) of Act No. 119 / 2002 Coll., on firearms and ammunition (Act on Weapons), as amended by Act No. 229 / 2016 Coll. '.
3. In Paragraph 2 (1), the words "and the missile are free of active charges, in particular explosive, incendiary, luminous, smoke, flash, acoustic or chemical," shall be added at the end of the text in point (a).
4. In Article 2 (1) (b), the words "signal ammunition for signal weapons' shall be inserted after the words" weapons'.
5. The following Section 2a is inserted after Section 2, including the title:
Weapon modification requirements for film or theatrical activities
(1) The weapon for film or theatrical activity referred to in Section 9 (2) (e) of the Arms Act must be adapted to:
(a) the barrel has made it possible to charge and detonate a bullet or a training charge in a given calibre with a spherical or mass missile; and
b) the main part was an inseparable barrier which does not allow the bullet to be inserted into the barrel and fired by means of a cartridge, while simultaneously preventing the bullet from passing through the charge in a given calibre with a spherical or mass round which is not a training charge.
(2) Compliance with the requirements referred to in paragraph 1 shall not be deemed to comply with the requirements of the permitted production performance of an expansion weapon under Paragraph 1. ';
Transitional provision
Paragraph 2a of Decree No. 370 / 2002 Coll., as effective from the date of entry into force of the Order, shall not apply to weapons modified or imported into the Czech Republic before the date of entry into force of the Order.
Repeal of certain Regulations of the Ministry of Industry and Trade
They shall be deleted:
1. Decree of the Ministry of Industry and Trade No. 371 / 2002 Coll., laying down the procedure for the destruction and destruction of weapons, ammunition and the production of their cuts, as amended by Decree No. 632 / 2004 Coll.
2. Decree of the Ministry of Industry and Trade No. 632 / 2004 Coll., amending Decree No. 371 / 2002 Coll., laying down a procedure for the destruction and destruction of weapons, ammunition and the production of their cuts.
Transitional provision
Proceedings initiated prior to the date of entry into force of this Order and pending shall be treated in accordance with Decree No 371 / 2002 Coll., as effective before the date of entry into force of this Order.
FINAL PROVISIONS
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 on the procedure for the provision of information in the field of technical and information society services, as amended.
EFFECTIVE
This Decision shall enter into force on 1 August 2017.
