DECLARATION
of 13 June 2023
amending Decree No. 207 / 2001 Coll., implementing Act No. 301 / 2000 Coll., on Matrices, Names and Surnames, and amending certain related acts, as amended
According to § 96 (m) of Act No. 301 / 2000 Coll., on Matrices, Name and Surname and on the Amendment of Certain Related Acts, as amended by Act No. 312 / 2013 Coll. and Act No. 279 / 2019 Coll.:

1. In Article 2, the dot is deleted at the end of point 22 and the following point 23 is added:
"23. A birth certificate with the same sex parents' particulars. ';
2. In Article 2a (1), the words "and model 20 'are replaced by", 20 and 23';
3. In Section 2a, the following paragraph 5 is added:
"(5) Where data on parents of the same sex (7) are entered in the matrix forms set out in Annex 2 in models 5, 6, 17, 19 and 22), the words" father "and" mother "shall be crossed with a horizontal line.
7) For example, Act No. 91 / 2012 Coll., on Private International Law, as amended. '
4. In Paragraph 24 (1), at the end of the first sentence, the words "where the birth certificate is issued to a person whose parents are of the same gender (7), the birth certificate shall be issued on the form set out in Annex 2, model 23 '.
5. In Annex No 2, Model 5, "Father 'is replaced by" Father / Parent' and "Mother 'is replaced by" Mother / Parent'.
6. In Annex No 2, Model 6, "father 'is replaced by" father / parent' and "mother 'is replaced by" mother / parent'.
7. In Annex No 2, Model 17, "father 'is replaced by" father / parent' and "mother 'is replaced by" mother / parent'.
8. In Annex No 2, Model 19, "OTEC 'is replaced by" OTEC / RODIC' and "MOTHER 'is replaced by" MOTHER / RODIC'.
9. In Annex No 2, Model 22, "father 'is replaced by" father / parent' and "mother 'is replaced by" mother / parent'.
10. In Annex 2, the following model 23 is added:

Transitional provisions
1. Matrix forms The Protocol on the conclusion of marriage and the Protocol on the entry into registered partnership according to models 17 and 22 of Annex 2 to Decree No 207 / 2001 Coll., as effective before the date of entry into force of this decree, may be used until 31 December 2025.
2. Matrix Forms List of Matrix Book of Birth, List of Matrix Book of Marriage and List of Matrix Book of Partnerships according to Models 5, 6 and 19 of Annex 2 to Decree No. 207 / 2001 Coll., as effective before the date of entry into force of this Order, may be used until 31 December 2033.
3. Where data on parents of the same sex are recorded, the matrix forms referred to in points 1 and 2 may be used only if they indicate the changes referred to in points 5 to 9 of Article I.
Efficacy
This Decree shall take effect on 1 July 2023.
