DECLARATION
Ministry of Transport and Communications
of 15 June 2000
amending the Decree of the Ministry of Transport No. 173 / 1995 Coll., issuing the Railway Regulations, as amended by Decree No. 242 / 1996 Coll.
The Ministry of Transport and Communications provides, pursuant to § 66 (1) of Act No. 266 / 1994 Coll., on Railways, as amended by Act No. 23 / 2000 Coll., ("the Act ') for the implementation of § 22 (5), § 35 (3), § 42 (3), § 43 (1), § 43 (4), § 43 (5) and § 44 (1):
Decree No. 173 / 1995 Coll., issuing the Railway Regulations, as amended by Decree No. 242 / 1996 Coll., is amended as follows:
1. In Paragraph 1 (e), the words "as well as a light means of transport which is not designed to be combined with railway vehicles and is dependent on human strength when moving, 'are added at the end.
2. in § 1 (g) and (i), in § 60 (4), in § 61 (3), in Annex 3, Part II, point 5, the words "driving car" are replaced by the words "driving car."
3. In Section 1 (h), the part of the sentence behind the semicolon reads: "if a special vehicle is a self-propelled vehicle with a rated mass of more than 20 tonnes or a self-propelled vehicle which allows the vehicle to speed more than 10 km / h regardless of the vehicle's mass, it is a special driving vehicle. Braking distance
(1) The braking distance is the distance on which the train must stop safely from the speed at which it is allowed to travel in a given section of the line. The braking distance shall be determined in a uniform manner according to the technical parameters of the line and shall be shown in the table of track ratios. The stopping distance is 400 m, 700 m and 1,000 m.
(2) The braking distance shall be determined in the design documentation of the construction, reconstruction or modernization of the track or track, which has been verified in the construction control of the building concerned. '
11. in the first sentence of Article 12 (4), the words "or their use must be documented by technical equipment" shall be added after the words "operator counters."

';

17. In Article 21, paragraphs 2 to 5 are added:
"(2) If the requirements of the carriers exceed the maximum capacity of the runway in one of the sections of the runway, the railway operator shall notify the Transport and Tariff Bulletin of this fact and shall analyse at the same time the causes of track capacity exhaustion. Within two months of notification of an overrun of the maximum runway capacity, the railway operator shall, after consultation with existing and prospective carriers, propose to the railway owner short-term and medium-term measures to ensure the necessary runway capacity, consisting in particular of conducting trains on other line sections, changing train time positions, increasing the specified train speed and improving the parameters of track components.
(3) Within six months of carrying out the analysis of the causes of the track capacity limitation referred to in paragraph 2, the railway operator shall, after consulting existing and prospective carriers, draw up a plan to increase the runway infrastructure capacity, in which it shall propose measures to increase track capacity, including the timetable for their implementation, and forward it to the railway owner to be secured.
(4) If, within the time limits referred to in paragraphs 2 and 3, the railway operator does not take measures to increase the capacity of the runway or if these measures are not economically viable, the carrier shall only pay basic charges for the use of the railway road.
(5) If the carrier does not use the assigned train paths by timetable at least 75% within one month, the railway operator shall be entitled to propose a change to the runway contract and to reduce the agreed number of trains. ';
18. in § 24 (a) the text in brackets reads: "(the provisions of § 16 apply mutatis mutandis)."

31. Paragraph 37, including the title, reads:
Braking and speed of train running
(1) A train with a specified speed of more than 40 km / h must be braked by the continuous self-braking.
(2) The train must be so braked that its braking effect ensures a safe stopping of the train at a stopping distance.
(3) The braking performance of the train is determined by braking percentages. The braking percent tables for the national and regional runway shall determine the required braking performance of the train, expressed as the braking percentage of the train, depending on the authorised speed of the train, its type and length, on the determined track slope and the stopping distance on that line. The brake percent tables are given in Annex 2, which is part of this decree.
(4) The actual braking percentage of each train shall be determined by calculating the formula:
Actual braking percentage = total braking weight train total train weight. 100
The total braking mass of the train brake applied by the continuous brake shall be equal to the sum of all brake weights of each train groove vehicle with a self-actuating continuous (pressure) brake applied to the train's continuous brake and, in the case of a train with manually braking vehicles, the sum of the brake weights of each vehicle operated by the hand brake. The total mass of the train shall be equal to the sum of the mass of each train groove vehicle, the mass of the load on the vehicles and, in the case of vehicles carrying passengers, the sum of the average mass of passengers (80 kg per person) according to the vehicle occupancy.
(5) The actual braking percentages of the train shall be higher or at least equal to the required braking percentages based on the tables in Annex 2 to this Regulation and for specific line sections and for specific trains shall be indicated in the timetable referred to in Section 35 (2) (e) of this Regulation.
(6) For lines with a gradient of more than 40 °, for a tractor and a narrow gauge track, the required braking performance of the train shall be determined by means of its instruction depending on the authorised speed and gradient of the track.
(7) The train must not exceed the maximum permissible speed, which is determined as the lowest value of
(a) track speeds on a given line section;
(b) the maximum operating speed of the train's train;
(c) permitted speed according to the braking percent tables, depending on the type and length of the train, on the determined track path and the braking distance on that line;
(d) the speed permitted by signals, written orders or orders of the telecommunications equipment concerned.
(8) On lines with a braking distance of 1 000 m, the maximum permissible speed may be greater than 120 km / h, up to and including 160 km / h, provided that the warning signal "Warning 'or signals which indicate a reduced speed shall be preceded by a warning signal on the lead train by means of a train protection device from the previous signal so that the information on the signal allows the driver of the railway vehicle to reduce the speed of the train to a specified speed for the train and the track section at the latest at the signal" Warning' or at the signal indicating a reduced speed. The train alarm must ensure that the reception is registered by signals ordering speed reductions.
(9) The continuous brake performance shall be verified by a brake test carried out by a competent person. The brake test shall be carried out before the train leaves the initial service station. The brake test shall also be carried out
(a) if there is a change in the station from which the train is operated, except for trains operated as a complete separate unit;
(b) if the train has been disconnected, except for the suspension of vehicles at the end of the train.
(10) The brake test carried out on the trains referred to in § 22 (2) (b), (c), (d), (e) and (f) and on the train sets shall be recorded. The minutes shall contain:
(a) the train number and the name of the transport station where the test was carried out and the date of the test;
(b) braking mode,
(c) mass, brake weight and number of axles or train length;
(d) the number and type of brakes involved on the train;
(e) the braking percentages required;
(f) actual braking percentage;
(g) signatures of the qualified persons who carried out the test.
(11) The methods and procedures for securing the train in the event of a failure of the continuous brake so that the train can be reliably secured against the run on the most unfavourable gradient of the line section shall be laid down by the carrier by internal regulation. "
32. In Paragraph 39 (3), the words "on the national and regional runway 'shall be inserted after the words" by transport stations'.

39. Paragraph 52, including footnote 8, reads:
(1) The railway operator shall, according to the requirements of each carrier and district office, draw up a timetable proposal for the number and time position of each train, which shall forward it to the individual carriers and the district authorities within 200 days of the scheduled timetable. It shall indicate in the proposal the trains the management of which makes the carrier conditional on the conclusion of a public service contract or which the district authorities require in addition to the offer of carriers and for which it will be necessary to conclude a public service contract (Section 39 of the Law). The annex to the proposal shall state the reasons why individual carriers of the required trains have not been incorporated into the timetable design at all or have been incorporated in a different time position.
(2) The carrier shall be entitled to make their introduction conditional on the conclusion of a public service contract with the county competent authority in the train management requirements; In that case, the proposal shall provide evidence of the expected demonstrable loss arising from the operation of the train (Section 39a of the Act).
(3) According to the results of the selection procedure with the relevant carriers, the county authorities shall conclude written public service contracts in order to ensure the basic transport services of the district district by public rail passenger transport referred to in paragraph 1 no later than 160 days before the scheduled timetable is fixed and shall, on the basis of each contract concluded, transmit to the railway operator the agreed numbers and the time position of the train management. According to the public service obligations agreements concluded and the requirements applied by each haulier, the railway operator shall draw up a final timetable to be discussed with the county authorities in order to ensure coordination with the scheduled public scheduled scheduled services (8) no later than 120 days before the scheduled timetable. The agreed final timetable shall be published by the railway operator.

In the case of a groove vehicle which does not have a licence, the carrier shall ensure that the technical inspection is marked with the date and mark of the inspection point directly to the designated location on the groove vehicle. 55. in Paragraph 68 (2):
"(2) The person driving the railway vehicle shall be shown to be aware of changes in the construction technical parameters of the railway structures and structures on the track referred to in paragraph 1 which have a direct impact on the safety and continuity of the operation of the railway transport at the latest before the first journey on the railway section concerned. 82. In Annex 3, Part I, point 2:
'2. The brake on the track shall ensure that the braking effect is such that the track vehicles with the highest mass stop from the permitted speed to the braking distance of the line on which the track vehicles are operated. The control of one brake system shall not be linked to the control of the other brake systems.
2.1. Driving vehicles shall be equipped with an automatic, auxiliary and manual (locking) continuous brake. Electric or motor units, designed for a speed exceeding 160 km / h, shall be equipped with an automatic and manual (locking) and additional brake equipment, which is an electropneumatic brake, a magnetic rail brake, an anti-shear device and a safety system for neutralising the performance of the rescue brake.
2.2. Passenger wagons shall be equipped with an automatic continuous brake, including a rescue brake, and a manual brake. Passenger wagons, designed for a speed exceeding 160 km / h, shall be equipped with an additional brake equipment which is an electropneumatic brake, a magnetic rail brake, an anti-skid device and a safety system to neutralise the performance of the rescue brake.
2.3. Freight wagons shall be equipped with an automatic continuous brake to prevent wheel locking by means of a stop device to adjust the force to brake stops or disc brake jaws according to the vehicle's total mass. Freight wagons intended for the transport of dangerous goods shall be equipped with a manual brake operated from the platform and other freight wagons with a manual brake including its accessories as required by the carrier. '
83. In Annex 3, Part I, point 5, the second sentence is replaced by the following: "Where the operation of such vehicles is considered on the national road, regional and passenger trains, the braking system used shall allow the train vehicle to be co-operated with the automatic pressure brake and shall guarantee that when the automatic pressure brake is used, the brake will be automatically applied on the track of the vehicle at which the person driving the railway vehicle is located. '
84. In Annex 3, Part I, point 8, in the first sentence, the comma and the words "driving wagon 'are inserted after the words" driving railway vehicle'.
85. In Annex 3, Part I, point 9, under 9.7, the word "nominal 'shall be deleted; in entry 9.23, the word" pro' shall be replaced by "and method '; in entry 9.29, the words" or volume' shall be inserted after the word "reflective '; in entry 9.39, the words" special vehicle shall be inserted after the word'; and in note 2, the words' or regional 'shall be inserted after the words' and for historical railway vehicles or their replicas not used in regular operation ';
86. In Annex 3, Part I, point 10
entry 10.1.1. reads as follows:
"10.1. 1. The mass of the groove vehicle shall be taken to be the" mass of the driving vehicle in service '. By weighing the figure found on the mass of the driving vehicle, according to the original weighing document, shall not differ from that shown on the vehicle by - 1% to + 3%.';
Lot 10.2.1. reads as follows:
"10.2. 1. The mass of the groove vehicle shall be the mass of the empty vehicle. An indication of the mass of an empty vehicle marked on the vehicle shall be consistent with the mass of an empty vehicle according to the original weighing document with a tolerance of" ± 1%. ";
