GOVERNMENT REGULATION
of 8 June 2015
amending Government Regulation No 515 / 2004 Coll., on material support for the creation of new jobs and material support for retraining or training of employees in the context of investment incentives, as amended
The Government orders pursuant to § 111 (12) of Act No. 435 / 2004 Coll., on Employment, as amended by Act No. 367 / 2011 Coll. and Act No. 136 / 2014 Coll.:
Government Regulation No. 515 / 2004 Coll., on material aid for the creation of new jobs and material support for retraining or training of employees in the context of investment incentives, as amended by Government Regulation No. 578 / 2004 Coll., Government Regulation No. 338 / 2006 Coll., Government Decree No. 68 / 2008 Coll., Government Decree No. 97 / 2010 Coll. and Government Decree No. 10 / 2014 Coll., is amended as follows:
1. Paragraph 1 (1), including footnote 1, reads as follows:
"(1) The amount of material support to the employer to create new jobs under investment incentives is
(a) 300 000 CZK per new job created in a privileged industrial zone approved by the Government under the Investment Incentives Act;
b) CZK 200,000 per new job created in the Territorial Area (1) with an unemployment rate of at least 50% higher than the average unemployment rate in the Czech Republic,
c) 100 000 CZK per new job created in the territorial area 1) with an unemployment rate of at least 25% higher than the average unemployment rate in the Czech Republic.
1) Paragraph 111 (11) of Act No. 435 / 2004 Coll., on Employment, as amended. '
2. Paragraph 2 (1) to (3), including footnotes 2 and 3, states:
"(1) The amount of material support for retraining or training of employees under investment incentives shall be:
(a) in a territorial area with an unemployment rate of at least 50% higher than the average unemployment rate in the Czech Republic, 50% of the costs of retraining or training employees (2);
(b) in a territorial area with an unemployment rate of at least 25% higher than the average unemployment rate in the Czech Republic, 25% of the costs of retraining or training employees (2).
(2) If, at the time of the submission of the application for material support, the applicant is an organisation designated under the Investment Incentives Act
(a) small enterprise (3), the amount of physical aid referred to in paragraph 1 shall be increased by 20 percentage points,
(b) medium-sized enterprise (3), the amount of material aid referred to in paragraph 1 shall be increased by 10 percentage points.
(3) In the case of retraining or training of workers with disabilities or disadvantaged workers, the amount of physical aid referred to in paragraph 1 shall be increased by 10 percentage points, but not more than 70% of the costs of retraining or training such staff (2).
(2) Article 31 of Commission Regulation (EU) No 651 / 2014 of 17 June 2014 declaring certain categories of aid compatible with the internal market in accordance with Articles 107 and 108 of the Treaty.
(3) Annex I to Commission Regulation (EU) No 651 / 2014 of 17 June 2014. '.

The average proportion of unemployment for the purposes of this Regulation shall be the average proportion of unemployment for the two half years preceding the date of submission of the employer's intention to obtain investment incentives under the Investment Incentives Act. The average unemployment rate shall be determined on the basis of the statistics of the Ministry of Labour and Social Affairs. ';

4. In Paragraph 5 (1), the word "Ministry 'is replaced by" Labour Office';
5. In Article 5 (2), the words "Commission of the European Communities (6) 'are replaced by the words" European Commission( 6)';
footnote 6:
"(6) Article 4 (1) (n) of Commission Regulation (EU) No 651 / 2014 of 17 June 2014. ';
Transitional provision
For the promise of investment incentives provided in the procedure under Act No. 72 / 2000 Coll., on investment incentives and amending certain laws (the Investment Incentives Act), as amended, initiated before the date of entry into force of this Regulation, Government Regulation No. 515 / 2004 Coll., as effective before the date of entry into force of this Regulation, shall apply.
Efficacy
This Regulation shall enter into force on the day of its publication.
