of 22 June 2022
o Protected Landscape Area of the Blansky Forest
The Government orders pursuant to § 25 (3) of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation:
§ 1
Protected Landscape Area Blansky Forest
In order to ensure the conservation of nature and landscape, the Protected Landscape Area of the Blansky Forest is announced.
§ 2
Mission and object protection of the protected landscape area
(1) The mission of the protected landscape area is:
(a) maintaining and improving the natural, cultural and historical values and natural functions of the landscape while developing an environmentally optimal use of the landscape and its natural resources; and
(b) the maintenance of the diversity of non-living nature and of ecosystem and species diversity, in particular the preservation and improvement of the status of valuable forest, non-forest and wetland communities, rare plant species, fungi and animals, including the contribution to the protection of the European site of the Blanske Forest, as well as the preservation of landscape elements, in particular of tree lines along the road.
(2) Protected landscape areas are the object of protection
(a) a harmoniously shaped landscape with a typical landscape impact given by the geomorphology of the terrain, creating a semi-closed system of hills with a central boiler, with complexes of forests on ridges and alternating smaller settlements, forest and agricultural areas, supplemented by scattered greenery and trees in the Křemský boiler and outlying parts of the Blanske Forest, including cultural and historical components of the landscape, in particular the location and urban composition of settlements and typical local buildings of folk architecture;
(b) natural features of the landscape,
(c) water flows, water surfaces and wetlands with natural aquatic regime, natural morphology, hydrological functions and biotech;
(d) forest ecosystems of leafy and mixed submountain forests with high natural value and species diversity, acidic and flowery beech forests, rubble forests, snake and limestone forests;
(e) non-forest communities, dry and rocky lawns, mesophilic and moist meadows with high species diversity; and
(f) natural habitats or habitats of species which are the subject of protection of the European major site of the Blanske forest.
§ 3
Definition of the protected landscape area
(1) The protected landscape area is situated in the territory of the South Bohemian Region.
(2) The designation of the border of the protected landscape area on the basis of a copy of the cadastral map is set out in the Annex to this Regulation and, including the electronic form, it is stored in the central list of nature protection1).
§ 4
Breakdown of the protected landscape area
(1) The territory of the protected landscape area is divided into 4 zones of graduated nature conservation.
(2) The I. zone includes mainly areas with the most significant natural values, biodiversity or high ecological stability of the countryside, in particular the areas of natural and man-made few forest ecosystems with a high proportion of autochthon trees and a varied species, spatial and age composition, and natural and nature nearby grassland ecosystems created and maintained by agricultural management and other particularly significant areas in terms of biodiversity and extremely valuable areas of conservation cultural and historical components of the landscape.
(3) In particular, the territory of economically exploited forest, meadow and aquatic ecosystems with a higher share of the nature of nearby communities and local conservation of natural values, other naturally valuable areas which are economically used in a gentle manner and are mostly linked to the territory of the I Nature Conservation Zone, and areas of value from the point of view of the landscape, in particular preserved scattered housing.
(4) The III zone includes, in particular, human activities, significantly modified ecosystems, intensely exploited agricultural parcels, in particular arable land, and forest land outside the built-up territory of municipalities not included in other areas of nature conservation, territory with scattered rural development and development with special-purpose structures for forestry, agriculture, water management or transport infrastructure and smaller sites with preserved urban structure.
(5) The IV zone is included in the human activity of a strongly modified part of nature and built-up areas not included in other zones of nature conservation.
§ 5
Closer protection conditions
(1) Only with the prior consent of the competent authority of nature protection may the entire territory of the protected landscape area
(a) modify or alter the watercourses, in particular to create new transverse barriers, steps and thresholds, or to move the sediment;
(b) de-mud ponds and other water tanks or store extracted sediment;
(c) remove lithoral crops and floating or immersed vegetation of ponds and other water tanks;
(d) to carry out land works, changes in terrain or mining, similar to them and related to them, where they may cause a change in the water regime or are carried out outside the built-up territory of the municipality, with the exception of landscaping operations carried out on the basis of a permit or other act under a building law;
(e) exploit minerals or carry out geological work, mining or mining activities carried out in a mining manner;
(f) indicate pedestrian, cycling, equestrian, cross-country or other similar lines, routes or paths outside the built-up territory of the municipality;
(g) organise and organise events involving more than 100 participants outside the established territory of the municipality;
(h) carry out the marking of rock-climbing terrain and the maintenance of rock-climbing equipment or their replacement, including permanent and transitional means of securing;
(i) conduct climbing activities outside the climbing terrain marked in accordance with point (h);
(j) keeping or releasing wild ducks;
(k) to carry out an air application of biocides, fertilisers or airborne liming; or
(l) to place new lamps outside enclosed objects and public lighting whose luminous flux is directed above the horizontal passing through the centre of the lamp.
(2) In the territory of the I and II protected landscape area, only with the consent of the competent nature conservation authority
(a) to sever grassland on all types of land, or to recover and replant it outside the established territory of the municipality;
(b) carry out take-offs, landings or flights with sports flying equipment outside the established territory of the municipality; or
(c) operate aircraft capable of flying without a pilot or aircraft model outside the established territory of the municipality, except for flights to ensure the safety of the State, the protection of persons and their health, property or public order, and flights for the needs of nature conservation authorities.
(3) In the territory of the III zone of the protected landscape area, only with the consent of the competent nature conservation authority
(a) carry out activities which may reduce surface or groundwater levels outside the established territory of the municipality, with the exception of activities carried out under a permit or other act under a building or water law;
(b) to plant timber outside forest land, the built-up territory of the municipality or the built-up area, other than fruit trees, shore crops and accompanying greenery along the road;
(c) to sever permanent grassland or to reconstruct and accede outside the established territory of the municipality;
(d) use chemical agents to treat arable land outside the growth period of the main crop; or
(e) use biocides in road maintenance.
§ 6
Repeal
The Decree of the Ministry of Culture of the Czech Socialist Republic No. 197 / 1989 Coll., on the establishment of the protected landscape area of the Blansky Forest, is repealed.
§ 7
Efficacy
This Regulation shall enter into force on 1 July 2022.
