DECLARATION
of 16 January 2020
amending Decree No 105 / 2008 Coll., on the legal and financial requirements of pupils in military secondary schools, as amended
According to Section 166 of Act No. 221 / 1999 Coll., the Ministry of Defence provides:
Decree No. 105 / 2008 Coll., on the Natural and Financial Requirements of Pupils of Military Secondary Schools, as amended by Decree No. 198 / 2010 Coll., Decree No. 165 / 2014 Coll. and Decree No. 155 / 2018 Coll., is amended as follows:
1. in Article 1, the following paragraph 3 is added:
"(3) The cash requirements shall be provided in the form of a recurring incentive allowance, one-off incentive remuneration or compensation in cash for non-granted in kind. ';
2. The heading of Section 17 reads: "Incentive allowance and incentive remuneration."
3. in Article 17 (2) (c):
"(c) the pupil has not been required to receive educational measures for breach of the duties laid down in the school or internal school rules (10) of the class teacher, school director or school director,"
4. In the second sentence of Article 17 (3), "conditions' is replaced by" conditions'.
5. In Article 17, the following paragraph 4 is inserted after paragraph 3:
"(4) Where a pupil has been imposed on a class teacher, school director or school establishment for infringement of the obligations laid down in the school rules or internal school rules (10), the school shall not grant him an incentive allowance for a period of 5 calendar months for which he would otherwise have been responsible, starting from the calendar month following the month in which the education measure became an obstacle to the provision of an incentive allowance. ';
Paragraphs 4 and 5 shall become paragraphs 5 and 6.
6. Paragraph 17 (5) and (6) read:
"(5) The incentive allowance shall be paid on a monthly basis during the teaching period as a recurring amount of:
a) CZK 2,500, if the assessment of student education results in any subject is not higher than the classification level of benefit 2 - commendable and the average of the classification levels of benefit is not higher than 1,50,
b) CZK 2,000, if the assessment of student education results in no subject is higher than the classification level of benefit 3 - good and the average of the classification levels of benefit is not higher than 1.50,
c) CZK 1,500, if the assessment of student education results in any subject is not higher than the classification level of benefit 3 - good and the average of the classification levels of benefit is not higher than 2,00,
d) 700 CZK, if the assessment of student education results in any subject is not higher than the classification level of benefit 3 - good and the average of the classification levels of benefit is not higher than 2.50; or
e) 200 CZK, if the assessment of the student's education results in any subject is not higher than the classification level of benefit 4 - sufficient and the average of the classification levels of benefit is not higher than 3.00.
(6) In order to achieve language competence according to NATO STANAG 6001 provided for in the framework or school education programme, the school will provide a one-off incentive fee of
a) CZK 2 000 for the level of language competence SLP 2222 from the English language,
b) CZK 1,000 for the level of language competence of SLP 1111 from other foreign languages. "
7. In Article 17, the following paragraph 7 is added:
"(7) The incentive remuneration referred to in paragraph 6 shall be granted to the pupil in the calendar month following the month in which the pupil reaches the specified level of linguistic competence. ';
Transitional provision
If, before the date of entry into force of this Decree, the pupil is entitled to an increase in the incentive contribution by obtaining the level of linguistic competence laid down in the framework or school training programme, he shall be paid, throughout the course of his studies, an amount equal to that increase in the months in which the incentive contribution is paid, even after the date of entry into force of this Decree, regardless of whether the incentive allowance is granted in the month of payment.
Efficacy
This Decision shall enter into force on 1 February 2020.
