DECLARATION
of 31 January 2018
amending Decree No. 206 / 2012 Coll., on professional competence for the handling of products
The Ministry of Agriculture, in cooperation with the Ministry of Health, provides pursuant to § 88 (4) of Act No. 326 / 2004 Coll., on Phytosanitary Care and on the amendment of certain related laws, as amended by Act No. 199 / 2012 Coll. and Act No. 299 / 2017 Coll., ("the Act ') for the implementation of § 86b (3) of the Act:
Decree No. 206 / 2012 Coll., on professional competence for the handling of preparations, is amended as follows:
1. in Article 1, the following point (b) is inserted after point (a):
'(b) the fields of apprenticeship, secondary education or higher education, after which a person is considered to be a holder of a first or second degree certificate for a period of 3 years,';
Points (b) to (d) shall be renumbered (c) to (e).
2. In Article 1, the words "the content and scope of the basic course," shall be inserted at the beginning of point (d).
3. In Section 1, at the end of the text in point (e), the words "and how to demonstrate the completion of an employer's course 'are added.
4. In Article 1, at the end of point (e), the dot is replaced by "a 'and the following point (f) is added:
"(f) the content and scope of the employer's course."
5. After Paragraph 1, the following Section 1a is inserted:
Area of apprenticeship, secondary education or higher education, after which a person is considered to hold a first or second degree certificate for 3 years
(1) The fields of education providing secondary education with a certificate after which a person is considered to hold a first-degree certificate for 3 years are:
(a) 41 - 51 - H / 01 Farmer - farmer,
(b) 41 - 55 - H / 01 Agricultural machinery repairman; and
(c) 41 - 52 - H / 01 Gardener.
(2) The fields of education providing secondary education with a graduate examination or university Master's degree programmes, after which a person is considered to hold a second degree certificate for a period of 3 years, are:
(a) 41 - 04 - M / 01 Plant health;
(b) 41 - 41 - M / 01 Agri-enterprise,
(c) 41 - 42 - M / 01 Vineyard,
(d) 41 - 44 - M / 01 Gardening,
(e) 41 - 45 - M / 01 Mechanisation and services; and
(f) a Master's Master's degree programme focusing on phytotechnics. ';
6. In Article 3 (5), the words "State Plant Health Administration 'are replaced by the words" Institute', after the first sentence, the sentence "Written test contains 25 questions in the field of product handling and 15 questions in the field of public health protection 'and the words" public health' are added, otherwise the tested shall be repeated by a written test at a different date. The examination may be carried out no later than 12 months from the date of completion of the basic course for the issue of the second degree certificate. '
7. In Section 4, the word "Scope 'is replaced by" Content and scope of the basic course, scope'.
8. In Section 4, the following paragraphs 1 to 4 are inserted:
"(1) The content of the basic course for the issue of the third degree certificate and the content of the additional training for the extension of the third degree certificate is set out in Annex 1 to this Decree.
(2) The scope of the basic course for the issue of a third-degree certificate is 18 teaching hours. The time for the test is not included in this period.
(3) The scope of additional training for the extension of the third degree certificate is 8 teaching hours. The time for the test is not included in this period.
(4) 45 minutes shall be deemed to be the teaching hour referred to in paragraphs 2 and 3. ';
Paragraphs 1 to 5 shall be renumbered paragraphs 5 to 9.
9. In Article 4 (5), the words "State Plant Health Administration 'are replaced by the words" Institute'; at the end of the text of the fifth sentence, the words "other time 'are added and at the end of the paragraph the sentence" The examination may be completed no later than 12 months from the date of completion of the basic course for the issue of the third degree certificate.';
10. in Article 4 (6) and (8), "1" is replaced by "5" and in paragraph 6, "maximum" is deleted.
11. in Article 4, paragraph 7 is deleted;
Paragraphs 8 and 9 shall be renumbered paragraphs 7 and 8.
12. In Article 4, at the end of paragraph 7, the sentence "The examination may be carried out no later than 12 months after the date of completion of the supplementary training for the renewal of the third-degree certificate."
13. in Article 5 (2), the words "State Plant Health Administration" are replaced by the words "Institute."

Technical security requirements for basic courses and additional training
The training facilities shall ensure the organisation of basic courses and additional training of the classroom with the possibility of electronic presentations, Internet connection, space capacity for theoretical teaching and technical capacity for practical teaching. '
15. The following Section 6a is inserted after Section 6:
Content and scope of the course organised by the employer and method of proving completion of the course organised by the employer
(1) The content of the course organised by the employer is set out in Annex 1 to this decree.
(2) The range of courses organised by the employer is 6 hours. 45 minutes shall be considered a teaching hour.
(3) Immediately after completion of the course organised by the employer, the employer shall notify the Institute in writing of the number of persons who have completed the course and are thus considered to be holders of a first-degree certificate.
(4) For the purpose of demonstrating the completion of the course organised by the employer in the course of the inspection, the employer shall keep a list of persons who have completed the course for 3 years from the date of the course organised by the employer. This list shall include the name, date and place of birth and the permanent residence of all persons who have completed the course, their signatures and the signature of the training instructor. ';
16. In the heading of Annex No 1, the words "the content of the basic course for the issue of the third degree certificate 'shall be inserted after the words" the validity of the second degree certificate', the words "and the content 'shall be replaced by the words" the content' and the words "and the content of the course organised by the employer 'shall be added at the end.
17. In Annex 1, point A., at the end of point 1, the words "and public health and environmental legislation 'shall be added.
18. In Annex 1, point A. (3), the following point (a) is inserted:
'(a) the label of the product, including the package leaflet and the safety data sheet (including the elements of the hazard marking),';
Points (a) to (c) shall be renumbered (b) to (d).
19. In Annex 1, point A., at the end of point 6, the words ", withdrawal periods and protective distances' shall be added.
20. In Annex 1, point A. (7), the words "the existence of protection zones for surface water and groundwater 'shall be inserted after the words" for example'.
21. In Annex 1, points B and C, the words "and the environment 'shall be inserted after the words" health'.
22. In Annex 1, point B, the word "or 'is replaced by a comma and the words" or third' are inserted after the word "second '.
23. In Annex 1, point D is added:
"D. The timetable for the various topics of the course organised by the employer, including the scope of topics relating to the protection of public health and the environment, shall be published by the Ministry in the Ministry's Journal, taking into account the different responsibilities of holders of the first degree of competence certificate."
24. in Annex No 2, the words "educational institutions' are replaced by the words" educational establishments' and the words "5 years' are replaced by the words" 3 years'.
25. In Annexes 3 and 4, the words "State Plant Health Administration 'are replaced by the words" Central Control and Testing Institute of Agriculture', the words "SRS 'are deleted, the words" Stamp' are inserted after the words "Name 'and the words" State Plant Health Administration' are replaced by the words "Central Control and Examination Institute of Agriculture '.
Efficacy
This decree shall take effect on the 15th day following its publication.
