GOVERNMENT REGULATION
of 16 January 2017
amending Government Regulation No 74 / 2015 Coll., on the conditions for granting subsidies on animal welfare measures, as amended
The Government mandates pursuant to § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Government Regulation No. 74 / 2015 Coll., on the conditions for granting subsidies for animal welfare measures, as amended by Government Regulation No. 113 / 2015 Coll. and Government Regulation No. 62 / 2016 Coll., is amended as follows:
1. in Article 11 (1) (b), the words "on which" shall be replaced by the words "with the numbers of permanent objects in which they are" shall be replaced by ";
2. In Paragraph 12 (2), the words "; the age of the sows shall be calculated from the day following the date of birth 'shall be added at the end of the text in point (c).
3. In Paragraph 14 (1) (b) (1), the word "meets' is replaced by" meets in the retention period 'and the words "on the applicant's holding' are inserted after the word" sub-measure '.
4. in Article 17 (3) (a) and Article 17 (3) (b), the words "or title" shall be inserted after the words "the subject matter."
5. In Article 17 (6), the words "or title 'are inserted after the words" Article 10 (1) (b)'.
6. In Paragraph 17 (10), the word "three 'is replaced by" 6' and "3 'is replaced by" 6'.
7. Paragraph 17 (14) reads as follows:
"(14) If the Fund finds that the applicant has failed to comply with the deadline laid down in Article 8 (2), but has reported no later than 30 days after the end of the commitment period, it shall decide, in the context of a given sub-measure or title for that holding:
(a) a 3% reduction in the subsidy if the applicant has not submitted 1 report within a given period;
(b) a 5% reduction in the subsidy if the applicant has not submitted two reports within a given period;
(c) a 10% reduction in the subsidy if the applicant has not submitted 3 reports within a given period;
(d) a 20% reduction in the subsidy if the applicant has not submitted 4 reports within a given period; or
(e) failure to grant a subsidy if the applicant has not submitted 5 or more reports within a given period. ';
8. In Article 17, paragraphs 15 and 16 are added:
"(15) If the Fund finds that the dairy cow referred to in the application for a subsidy referred to in Article 11 (1) (a) has been granted a childbirth period of between 1 and 15 December of the calendar year for which the subsidy is to be granted, it shall reduce the subsidy calculated in accordance with Article 16 by 10%; the reduction is applied to the livestock unit of such dairy cows.
(16) The limit for determining the calculation of the reduction or non-grant referred to in Article 31 of Commission Delegated Regulation (EU) No 640 / 2014 under the sub-measure referred to in Article 2 (e) shall be 15 weaned piglets. ';
9. In Annexes 3 and 6, the column headed "Date of registration 'is added to the second and third tables.
10. In Annexes 4, 5 and 7, the column headed "Date of registration 'is added to the second table.
11. In Annex No 8, Part II, Table 2, the word "Cows' is replaced by" Cows 3) 'and the word "heifers' is replaced by the word" heifers 3) '.
12. In Annex No 8, Part II, under Table 2, the following footnote 3 is added:
"(3) The number of animals in free housing shall not exceed the number of boxes."
Transitional provisions
1. The procedure for applications for grants initiated in 2015 pursuant to Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation and not final before that date, shall be completed in accordance with Government Regulation No. 74 / 2015 Coll., as effective before the date of entry into force of this Regulation.
2. The procedure for applications for grants initiated in 2016 under Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, and until that date definitively completed, shall be completed in accordance with Government Regulation No 74 / 2015 Coll., as effective from the date of entry into force of this Regulation, with the exception of the requirements set out in points 1, 2, 5 and 9 to 12, as regards Section 12 (2) (c), § 17 (6) and Annexes 3 to 8 to Government Regulation No 74 / 2015 Coll., as effective before the date of entry into force of this Regulation, which shall apply first to the procedure for applications for grants submitted in 2017.
Efficacy
This Regulation shall enter into force on 1 March 2017, with the exception of Article I (1) as regards Article 11 (1) (b), (2) as regards Article 12 (2) (c), (5) as regards Article 17 (6), and points 9 to 12 as regards Annexes 3 to 8, which shall take effect on 1 April 2017.
