DECLARATION
of 12 January 2010
amending Decree No. 205 / 2009 Coll., on the detection of emissions from stationary sources and on the implementation of certain other provisions of the Air Protection Act
According to Article 55 (2) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Act on Air Protection), as amended by Act No. 92 / 2004 Coll., Act No. 695 / 2004 Coll., Act No. 385 / 2005 Coll., Act No. 212 / 2006 Coll., Act No. 180 / 2007 Coll., Act No. 25 / 2008 Coll., Act No. 483 / 2008 Coll. and Act No. 223 / 2009 Coll., Implementation § 5 (12), § 9 (10), § 11 (4) and § 17 (11) Act:
Decree No. 205 / 2009 Coll., on the detection of emissions from stationary sources and on the implementation of certain other provisions of the Air Protection Act, is amended as follows:
1. In Article 4 (4) of the Introductory Part of the provision, the word "incineration 'shall be inserted after the word" U' and the word "sources' shall be inserted after the word" under another legislation (1) '.

Footnotes 1 to 9 shall become footnotes 2 to 10, including the footnotes.
2. Paragraph 6 (4) reads as follows:
"(4) For combustion sources with a rated heat output of up to 5 MW including combustion exclusively light fuel oil, natural gas, hydrogen, propane, butane or their mixtures, biogas, diesel, liquefied natural gas or liquefied petroleum gases, the mass concentrations of carbon monoxide and nitrogen oxides may also be measured by means of a potentiometric direct measurement of the electrochemical cell apparatus. ';
3. In Article 7 (6), the words "combustion sources with a rated output of less than 5 MW including only light fuel oil, natural gas, liquefied natural gas or liquefied petroleum gases' are replaced by the words" combustion sources pursuant to Article 6 (4) '.
4. In Paragraph 8, the sentence "Where these sources burn exclusively natural gas, they shall be subject to a single measurement of emissions of solid pollutants and sulphur dioxide. '
5. Paragraph 9 (4) reads as follows:
"(4) In assessing compliance with the emission limit, account shall be taken of continuous measurement outages if they do not exceed 5% of the total operating time of the source in the calendar year. If the failure of continuous emission measurement exceeds 10 days in a calendar year, the combustion source operator with a rated thermal input of 100 MW and above shall notify the inspection without undue delay of the method of ensuring the reliability and proper functioning of the continuous measurement system. An invalid day in terms of measurement means the day on which more than 3 average hourly values are invalid due to failure or maintenance of the continuous measurement system. An invalid hourly value consists of two invalid 30-minute mean values within one hour. '
6. In Annex No 1, Part I, in the table for group 6.3, in the third column, after "mg ', the symbol" TEQ' is added.
7. In Annex 5, Part I, the words "and a binding opinion 'shall be inserted in the title and in the introductory sentence after the word" authorisation'.
8. In Annex No 7, in Table 4, row 5, the letter "X 'is replaced by the letter" N' and row 6, the letter "Y 'is replaced by the letter" E'.
9. In Annex 7, point 18 in the explanatory notes under Table 4 is renumbered as point 17.
Efficacy
This decree shall take effect on the day of its publication.
