DECLARATION
of 15 June 2011
amending Decree No 369 / 2009 Coll., on the details of the marketing of seed and planting plants, as amended by Decree No 298 / 2010 Coll.
The Ministry of Agriculture provides, pursuant to § 3 paragraphs 11, 3a paragraphs 4 and 11, § 3b paragraphs 7, § 3c paragraphs 5, § 4 paragraphs 7 and 15, § 5 paragraph 9, § 6 paragraph 10, § 6a paragraph 7, § 7 paragraph 6, § 7a paragraph 5, § 8 paragraph 3, § 11 paragraph 3, § 12 paragraph 9, § 13 paragraph 6, § 14 paragraph 6, § 15 paragraph 6, § 16 paragraph 11, § 17 paragraph 14, § 18 paragraph 12, § 19 paragraph 6 and § 22 paragraph 10 of Act No. 219 / 2003 Coll., on the marketing of seeds and seedlings and on the modification of certain laws (Act on the circulation of seeds and seed and seed), as amended by Law No 178 / 2006 Coll.
Čl. I
Decree No. 369 / 2009 Coll., on the details of the marketing of seeds and propagating plants, as amended by Decree No. 298 / 2010 Coll., is amended as follows:
1. At the end of footnote 1, the sentence "Commission Directive 2009 / 145 / EC providing for certain derogations for the authorisation of marginal varieties of vegetables and vegetable varieties which are traditionally grown in certain areas and areas and which are threatened by genetic erosion and vegetable varieties which themselves do not have value for commercial growing but are developed for cultivation under special conditions and for the marketing of seed of those varieties. 'is added to the new line.
2. In the reference under Section 2, "7 and 10 'is replaced by" 8 and 11'.
3. In Article 4 (1), "paragraphs 2 and 3 'are replaced by" paragraphs 2 and 4'.

"(4) The quantity of seed of each conservation variety of vegetable species put into circulation per year may not exceed the quantity of seed required for vegetable production per area
(a) 40 hectares for onions, echalion, broccoli, kale, Brussels sprouts, Brussels sprouts, kohlrabi, cauliflowers, sauerkraut, red cabbage, turnip grenadier, kohlrabi, paprika, head chicory, chicory for pucks, industrial chicory, sugar melon, large fruit gourd, cardoon, carrots, hearth carrot, lettuce, tomato, basil, common shrub bean, wood peas, round peas, sugar peas, field beans,
(b) 20 hectares for shallots, leeks, garlic, salad beet, chard, watermelon, cucumber, pickling cucumber, gourd, fennel, eggplant, spinach, or
(c) 10 hectares for onions, collards, celeriac, celery, celery, asparagus, curled endives, escariol, parsley, quail, radish, radish, radish, radish, rind, black root, pollack, sugar maize and pecan maize. "
Paragraph 4 shall become paragraph 5.
7. The following Section 4a is inserted after Section 4:
„§ 4a
Placing in circulation seed of varieties developed for cultivation under special conditions
(1) The maximum net weight of the small package shall be:
(a) 250 grams for scarlet beans, shrub beans, wood peas, round peas, sugar peas, garden peas, spinach, sweetcorn, pecan maize,
(b) 25 grams for onions, echalion, shallot, onion, leek, garlic, kerbil, beetroot, chard, vodka, Chinese cabbage, cucumber, cucumber, cucumber, turnip, gourd, carrots, carrots, fodder, salad, parsley, radish, radish, radish, black root, goat lettuce, or

(2) The Institute shall carry out a subsequent check of the varietal identity and varietal purity of seed of a variety developed for cultivation under specific conditions put into circulation by a growing test to the extent of at least 5%. "
8. In the reference under section 8, "10 'is replaced by" 11'.

Other requirements:
- the recorded presence of other cereals and deaf oats including other weeds and their hybrids and fatuoids in pieces per 100 m2 shall be recorded in the record of the result of the crop show;
- the propagation crop must not be grown (including cultural species) in such a way as to allow it to assess the authenticity and purity of the variety;
- for the use of pollen sterility in basic RM of hybrid rye varieties, the minimum level of pollen sterility of the parent component shall be 98%;
- in the case of the production of seed of hybrid varieties of wheat, barley, oats and self-washed triticale of category C using a chemical hybridization agent, the minimum purity of the variety of each component of wheat, barley and oats shall be 99,7% and the self-washed triticale shall be 99,0%, the minimum level of hybrid seed of all the species designated shall be 95% and shall be determined in accordance with normal international methods where such methods exist. In cases where the hybrid is determined during seed testing prior to seed certification, the determination of the hybrid during field inspection is not necessary;
- for seed of hybrid varieties of wheat, barley, oats and self-washed triticale produced without the use of a chemical hybridization agent, the minimum varietal purity (% of hybrid) of seed of category C shall be 90%, checked with an official subsequent growing test;
- seed of hybrid varieties of rye shall be recognised as certified propagating material only if the results of the official growing test of an official sample of basic propagating material which has been carried out during the growing season of the seed declared for certification in category C have been duly taken into account in order to establish whether the seed of category E meets the requirements for basic propagating material laid down in this Decree, concerning authenticity and purity as regards the characteristics of the components, including pollen sterility;
- the paternity component is removed after flowering, but no later than before the second crop show.

Other requirements:

Requirements for the characteristics of seed crops for species included in the schemes of the Organisation for Economic Cooperation and Development for certification of seed in international trade:

- The minimum time interval between the cultivation of cereal crops of the same species on one parcel is two years. In the case of multiplication of the same variety and category, seed may be propagated, except for hybrid seed crops, on the same parcel without a time limit, provided that satisfactory varietal purity is maintained.

- Propagating crops of self-washed species must be isolated from other cereal crops by a fixed barrier or free space sufficient to prevent mechanical mixing during harvesting.
- Crop crops must be overlooked at least once, at the stage after the sweep.
- Number of shows of hybrid varieties - is the same as Tables 3.1a and 3.1b, for category E the shows are carried out for all components involved in the resulting variety.
- Crops intended for the production of certified propagating material of hybrid varieties of wheat, barley, oats must be isolated from undesirable sources of pollen. The parent component shall be at least 25 m away from any other variety of the same species, except the polluting parent component.
- In the case of the production of hybrid varieties of rye, the minimum isolation distance corresponds to Table 3.2a., the Institute may amend those distances if there is sufficient protection against unwanted extraneous spraying or if the possibility of extraneous spraying is excluded due to a clear difference in flowering time.
- Certification is subject to checking of species and variety identity and purity by the entry and exit vegetation test.

Other requirements:
- where pollen sterility is used in the production of the hybrid variety, the level of sterility of the pollen sterile component shall be at least 98%,
- the varietal purity of hybrid varieties shall be determined in accordance with an approved procedure suitable for the maintenance system concerned.
At least one of the following assessments shall be carried out:
● post-harvest checks carried out before seed certification using internationally agreed seed hybrid tests, excluding rye,
● the determination of the hybrid in the crop where hybrid seed is produced (see the calculation scheme below); This shall be combined with other assessments, including the results of the field inspection and isolation control. It should be noted that hybrid must not be compared to varietal purity and there is not necessarily a close correlation between these phenomena.
- Crops complying with the 95% hybrid standard shall be eligible for seed certification subject to any further tests. Exceptionally, the Institute, which requires isolation distances of at least 100 m, may recognise the level of the hybrid established on the field as a level of varietal purity of the hybrid provided that the level found is not less than 90%.
- In the second seed production inspection of F1 hybrids using a chemical hybridization agent carried out at the time of maturation of the seeds, the percentage of sterility of the parent component and / or the percentage of hybrid seed shall be determined as follows:
● Percentage of sterility equals: 100 (1- a / b)
● where and is the number of fertilised grains in the specified number of ears taken as a sample from the female parent's plants which have been protected by bags which are impermeable to pollen, or by isolation tents placed after the application of CHA, but before the flowering of any parent;

- Crops of non-hybrid varieties must be overlooked at least once at the stage where varietal purity may be determined. If the maize crop is followed by another maize crop from the previous year, at least one additional show must be carried out to detect the presence of pre-crop additives.
- The seed crops of category E - hybrid parent lines must be overlooked at least twice, the first pre-flowering show and the second during flowering.
- The seed crops of category E - hybrids must be overlooked at least three times. The first show before flowering, the second at the beginning of flowering and the third at the end of flowering.
- Crop crops for seed production category C hybrid varieties must be overlooked at least three times. If the maize crop is followed by another maize crop from the previous year, at least one additional show must be carried out to detect the presence of pre-crop additives.

- Purity of the species for sorghum: The number of plants of another species of sorghum, the seeds of which are difficult to differentiate in laboratory testing or which are easily drenched with cultivated species, shall not exceed 3 plants per 100 m2 for seed production of category E and 10 plants per 100 m2 for seed production of category C.
- In the case of hybrid maize varieties, they do not meet the requirements of crops where, at the stage of the inspection, 5% or more of the plants of the parent component are able to be pollinated, the number of plants of the parent component which have produced or are still producing pollen exceeds 0,5% for category E and 1% for category C at any inspection, or if it exceeds 1% for category E and 2% for category C at the sum of observations from 3 shows. Lats of 50 mm or more length, side twigs and combinations of both, shall be regarded as dusting lats if dusters exceed plums and pollen dust.
- In the production of seed of category C hybrid varieties, the pollen sterile component may be used in one of the following ways:
by mixing seed obtained using a pollen sterile component with seed obtained using a pollen ferrous component in such a way that the ratio between the seed of the pollen sterile component and the seed of the pollen fertile component does not exceed 2: 1;
By using a paternity component that contains at least one line restoring pollen fertility, at least one third of the plants grown from the resulting hybrid produce pollen that appears to be in order in all respects.
- Crops that are heavily weeds do not match the required limits.
